Chapter I General Provisions
Article 1 These measures are formulated in accordance with the Government Procurement Law of the People's Republic of China (hereinafter referred to as the Government Procurement Law) in order to standardize the behavior of government procurement information announcement, improve the transparency of government procurement activities and promote fair competition.
article 2 government procurement information refers to laws, regulations, rules and other normative documents that regulate government procurement activities, as well as data and materials that reflect the status of government procurement activities.
the announcement of government procurement information refers to the public announcement of government procurement information that should be made public in the media designated by the financial department.
article 3 purchasers and procurement agencies shall publish government procurement information in accordance with the laws, administrative regulations and these measures.

article 4 the announcement of government procurement information shall follow the principles of timely information release, unified content specifications, relatively centralized channels and easy access to search.
article 5 financial departments at or above the county level shall be responsible for the supervision, inspection and management of government procurement information announcement activities. However, the following duties shall be performed by the financial departments at or above the provincial level:
(1) determining the scope and content of government procurement information that should be announced;
(2) Designate, supervise and inspect the media that publish government procurement information.
article 6 the Ministry of finance is responsible for determining the basic scope and content of the government procurement information announcement, and designating the national government procurement information publishing media.
the financial department at the provincial level (including cities with separate plans, the same below) is responsible for determining the scope and content of the local government procurement information announcement, and may designate the local government procurement information release media.
except the Ministry of finance and the provincial finance department, no other unit or individual may designate the media for releasing government procurement information.
article 7 government procurement information shall first be published on the government procurement information publishing media designated by the Ministry of finance.
local government procurement information can be announced on the government procurement information release media designated by the provincial finance department at the same time.
Chapter II Scope and Contents of Announcement of Government Procurement Information
Article 8 Except for state secrets, commercial secrets of suppliers and government procurement information that should be kept confidential according to laws and administrative regulations, the following government procurement information must be announced:
(1) Construction laws, regulations, rules and other normative documents related to government procurement;
(2) the catalogue of centralized procurement, the standard of government procurement quota and the standard of public bidding amount published by the people's governments at or above the provincial level;
(3) Directory of government procurement bidding agencies;
(4) bidding information, including public bidding announcement, invitation to bid prequalification announcement, bid-winning announcement, transaction result and its corrections, etc.;
(5) the contact information of the financial department for accepting government procurement complaints and the decision on complaint handling;
(6) the assessment results of centralized procurement institutions by the financial department;
(7) a list of bad behaviors of procurement agencies and suppliers;
(8) other government procurement information that should be announced according to laws, regulations and rules.
article 9 in addition to the contents specified in article 8 of these measures, financial departments at or above the provincial level may, according to management needs, increase the contents of government procurement information that need to be announced.
Article 11 A public tender announcement shall include the following contents:
(1) Names, addresses and contact information of purchasers and procurement agencies;
(2) the name, purpose, quantity, brief technical requirements or nature of the project subject to tender;
(3) supplier qualification requirements;
(4) the time, place and method of obtaining the tender documents and the selling price of the tender documents;
(5) bidding deadline, time and place of bid opening;
(6) Name and telephone number of the contact person of the procurement project.
Article 11 The pre-qualification announcement of invitation to tender shall include the following contents:
(1) The name, address and contact information of the purchaser and procurement agency;
(2) the name, purpose, quantity, brief technical requirements or nature of the project subject to tender;
(3) supplier qualification requirements;
(4) the deadline for submitting qualification applications and supporting materials and the date of qualification examination;
(5) Name and telephone number of the contact person of the procurement project.
Article 12 The announcement of winning the bid shall include the following contents:
(1) Name, address and contact information of the purchaser and procurement agency;
(2) Name, purpose, quantity, brief technical requirements and contract performance date of the procurement project;
(3) the date of bid selection (indicate the number of the tender document);
(4) the date of project bidding announcement;
(5) the name, address and winning amount of the supplier of the construction enterprise;
(6) List of members of the bid evaluation committee;
(7) Name and telephone number of the contact person of the procurement project.
Article 13 The announcement on the correction of procurement information shall include the following contents:
(1) Name, address and contact information of the purchaser and procurement agency;
(2) the name of the procurement project originally announced and the date of the first announcement;
(3) correction items, contents and dates;
(4) contact person and telephone number of procurement project.
article 14 the announcement of the list of bad behavior records of procurement agencies and suppliers shall include the names of the parties, the reasons, the handling organs and the handling results.
Article 15 The announcement of the decision on complaint handling shall include the following contents:
(1) The name of the purchaser and the procurement agency;
(2) the name of the procurement project and the procurement date;
(3) the name of the complainant and the complaint;
(4) the name of the complaint handling organ;
(5) the main contents of the decision.
chapter iii administration of government procurement information announcement
article 16 the announcement of government procurement information must be true, accurate and reliable, and there shall be no false or misleading statements, and no items that must be announced according to law shall be omitted.
article 17 if the same government procurement information is announced separately in the designated release media of government procurement information, the contents must be consistent. Where the contents are inconsistent, the information published in the government procurement information publishing media designated by the Ministry of Finance shall prevail, except as otherwise provided by laws and administrative regulations.
article 18 if the time for announcing the same government procurement information in the designated media for releasing government procurement information is inconsistent, the earliest time for announcing information in the media for releasing government procurement information designated by the Ministry of finance shall be the time for announcement and the time when the parties involved in government procurement should know about relevant matters.
article 19 information such as government procurement laws, regulations, rules and other normative documents, centralized procurement catalogue, government procurement quota standards, and public bidding quota standards shall be announced by the financial department of the people's government at or above the provincial level in the designated release media of government procurement information.
Article 21 The information on bidding and tendering shall be announced by the purchaser or the procurement agency entrusted by him in the media designated for the release of government procurement information.
article 21 the assessment results of centralized procurement institutions and the list of bad behavior records of procurement agencies and suppliers shall be announced by the financial department of the people's government at the same level in the designated media of government procurement information in accordance with relevant regulations.
article 22 information other than those specified in articles 19, 21 and 21 of these measures, which belongs to the supervision and management of government procurement, shall be announced by the financial department of the people's government at the same level; If it belongs to the procurement business, the purchaser or its entrusted procurement agency shall make an announcement.
article 23 where a purchaser or a procurement agency needs to announce the government procurement information, it shall provide the information to the designated publishing media of government procurement information by fax, e-mail, etc., or it may be provided to the designated publishing media of government procurement information by the financial department of the people's government at the same level.
chapter iv administration of designated media of government procurement information
article 24 the designated media of government procurement information shall be responsible for the specific matters concerning the release of government procurement information as stipulated in these measures.
the government procurement information should be published by the designated media, which should reflect the principle of public welfare.
article 25 the designated release media of government procurement information shall release information according to the information content provided by information providers. However, if the information space is too large, the designated release media of government procurement information can be appropriately compressed and adjusted according to the unified technical requirements; Compression and adjustment shall not change the substantive content of the information provided.
Article 26 If the designated release media of government procurement information finds that the information provided by the information provider violates the laws, regulations, rules and these Measures, it shall promptly advise the information provider to modify it; If the information provider refuses to modify it, it shall report to the financial department of the people's government at the same level as the information provider.
Article 27 The online media in the government procurement information release media designated by the financial department shall be released online within 1 working days from the date of receiving the announcement information; The designated newspaper shall be published within 3 working days from the date of receiving the announcement information; The designated magazine shall publish relevant announcement information in a timely manner.
article 28 the designated release media of government procurement information shall make classified statistics on the government procurement information released by them, and submit the statistical results to the financial department of the people's government at the same level on schedule.
article 29 the designated release media of government procurement information shall announce the name and contact information of this media to the public. If the name and contact information are changed, it shall be announced to the public in a timely manner and filed with the financial department responsible for designating it to release government procurement information.
Chapter V Legal Liability
Article 31 If a purchaser or procurement agency is under any of the following circumstances, the financial department of the people's government at the county level shall order it to make corrections within a time limit and give a warning; The directly responsible person in charge and other directly responsible personnel shall be punished by the administrative department or the relevant authorities and notified:
(1) The government procurement information should be announced but not announced;
(2) failing to announce the information on the government procurement information release media designated by the Ministry of Finance first, or failing to announce the information on the government procurement information release media designated by the financial department;
(3) the contents of government procurement information obviously violate the provisions of these measures;
(4) the announcement of the same information in two or more designated media for the release of government procurement information is obviously inconsistent;
(5) failing to announce information within the prescribed time limit.
Article 31 If a purchaser or procurement agency is under any of the following circumstances, the procurement is invalid, and the financial department of the people's government at the county level shall give a warning or informed criticism; If it is the responsibility of the government procurement agency and the circumstances are serious, its qualification for relevant business shall be cancelled according to law:
(1) the potential bidders are restricted or excluded by unreasonable conditions in the bidding information;
(2) The information announced is untrue and contains false or fraudulent contents.
Article 32 The financial department of the people's government at or above the provincial level shall give a warning if the designated media for releasing government procurement information is under any of the following circumstances; If the circumstances are serious, the qualification of the designated media for the release of government procurement information shall be cancelled according to law; If economic losses are caused, it shall bear corresponding liability for compensation according to law:
(1) collecting information release fees in violation of prior agreement or in disguised form;
(2) refusing to release the information provided by the information provider without justifiable reasons;
(3) delaying the release time of government procurement information without justifiable reasons;
(4) publishing government procurement information to change the substantive content of information provided by information providers;
(5) other acts that violate the management of government procurement information.
article 33 if any unit or individual illegally interferes with the announcement of government procurement information, the financial department of the people's government at or above the provincial level shall order it to make corrections within a time limit and give it a warning; Refuses to correct, transferred to the relevant authorities in accordance with the law.
article 34 any unit or individual who finds that the government procurement information dissemination activities do not conform to the provisions of these measures has the right to complain and report to the financial department of the people's government at the same level, and the relevant financial department shall deal with it according to law.
Chapter VI Supplementary Provisions
Article 35 Provincial financial departments may formulate specific implementation measures according to these measures.
article 36 these measures shall come into force as of September 11, 2114. The Measures for the Administration of Government Procurement Information Announcement (Caiku [2111] No.7) promulgated and implemented by the Ministry of Finance on September 1, 2111 shall be abolished at the same time.
