How do you think about WeChat public number mandatory ordering?

When I was dining in a restaurant, I had to pay attention to the public number before I could order food by scanning the code. In this regard, the platform reminds developers to check whether there is a problem of "forced attention to the public number for code ordering" and to make timely corrections in order to provide users with a good ordering experience. The platform will also start verifying such issues on January 17, 2022, and public numbers that violate the law will be restricted from scanning the QR code to open the public number. In other words, after January 17, 2022, theoretically, we will no longer encounter such problems. Why theoretically? Because as early as July-August 2021, the WeChat Pay team "took action" - one after another to send merchants "on the scanning code ordering process forced to pay attention to the WeChat public number of the deadline for rectification notice ". Initiative industry participants to complete the merchant service process of self-examination and deadline for rectification and optimization, to protect the rights and interests of consumers, and continue to improve the experience of code-sweeping food ordering. The general background at that time was: the Rule of Law Daily published an article titled "code-sweeping food ordering collection of personal information is not an individual case experts recommend carrying out special rectification", and caused extensive discussion on the Internet. Although WeChat Pay team actively responded, but interestingly, only require participants to do self-discipline, and there is no specific supporting punitive measures. WeChat's action, compared with the slogan shouting in July and August this year, has taken a "huge step". But this kind of problem from the first time by consumers to discuss, complain, to now has been a year, WeChat only late to take this difficult step, for a moment, do not know whether to encourage, or criticize. Just hope that WeChat can fulfill its promise. 2022 January 17 began to verify such problems, the violation of the public number will be restricted to sweep the QR code to open the public number ability. What are the problems with mandatory sweep code ordering? In fact, as early as March 25, 2021, an article from the CCA already answered this question: "Sweep code ordering" should not be a "single choice question" to alert "consumer convenience" into "Consumer Troubles"[1] is excerpted as follows: First, only to provide "code ordering" is suspected of excessive collection of consumers' personal information. Article 111 of the Civil Code: "The personal information of natural persons is protected by law. Any organization or individual who needs to obtain another person's personal information shall obtain it in accordance with the law and ensure the security of the information, ......." Article 29 of the Law on the Protection of Consumer Rights and Interests states, "Operators shall follow the principles of lawfulness, legitimacy, and necessity in collecting and using consumers' personal information, express the purpose, manner, and scope of the collection and use of the information, and obtain the consumers' consent. ...... "It is not necessary for consumers to provide information unrelated to food and beverage consumption, such as cell phone numbers, birthdays, names, geographic locations, address books, etc., when they visit a restaurant. Some restaurants no longer provide manual ordering, requiring on-site dining consumers to pay attention to the public number or small program, and then scanning code ordering, thereby obtaining consumers' personal information, not only violates the legal provisions of the collection and use of personal information, the principle of lawfulness, legitimacy, and necessity, suspected of excessive collection of personal information of consumers, but also, if the storage of the poor, the consumer personal information is also leaked, the risk of loss. Second, only providing "code ordering" infringes on consumers' right to fair trade. According to Article 10(1) of the Consumer Protection Law, "Consumers have the right to fair trade." Article 16, paragraph 2, "operators to provide consumers with goods or services, should abide by social morality, good faith, to protect the legitimate rights and interests of consumers; shall not set unfair and unreasonable trading conditions, shall not be forced to trade." The fact that restaurant operators do not provide manual ordering services, but only provide code-sweeping ordering, not only violates business practices, but also makes the on-site dining consumers can only pay attention to or bind the operator's public number or applet, and passively authorize the operator to obtain their personal information. This practice infringes on the consumer's right to fair trade, is to set unfair and unreasonable trading conditions, on-site dining consumers a compulsory trading behavior. Third, the failure to provide on-site menus undermines consumers' right to know. Article 8, paragraph 1 of the Consumer Protection Law provides that "consumers have the right to know the true situation of the goods they buy, use or services they receive." Consumers have reflected that some restaurants, while only providing code-sweeping ordering, do not provide on-site diners with intuitively accessible on-site menus and dish prices, and consumers can only see specific menus and know dish prices after scanning the code to follow the restaurant. The menu is an important reference basis for consumer decision-making, and whether to accept the food service is directly related to the restaurant should provide intuitive on-site menu for consumers to understand the dishes and prices, decide whether to dine. Do not provide on-site menu, scanning code attention before browsing the dishes and prices of the practice, infringing on the consumer's right to know. Fourth, the application of new technology should not be an obstacle to the consumption of special consumer groups. Due to the complexity of the operation of smart phones, sweep code ordering is not universal. Elderly people and minors often need the assistance of others to complete the process of code ordering, which to a certain extent affects their consumption experience and consumption realization. Their awareness of the potential risks behind "code-sweeping" is also weak, and they are more likely to be victims of personal information leakage or even payment security issues. Operators can use new technologies to improve operational efficiency and provide convenience to consumers, but they should first comply with the law and safeguard consumer rights and interests. The application of new technologies should not become a tool to limit the rights of consumers, should not become an excuse to seize consumers' personal information, and should not become a barrier to public consumption.
