Regulations of Anshan Municipality on Controlling Smoking in Public Places
Article 1 In order to control and reduce the harm of tobacco smoke, safeguard public health and improve the level of urban civilization, these Provisions are formulated in accordance with the provisions of relevant national, provincial and municipal laws, regulations, rules and international conventions, and combined with the actual situation of this Municipality. Article 2 These Provisions shall apply to the smoking control in public places in the urban areas of this Municipality (hereinafter referred to as smoking control). Article 3 The tobacco control work in public places in this Municipality shall follow the principles of limited places, classified management, unit responsibility and public participation. Article 4 patriotic health campaign committee, Anshan City is the leading, decision-making and deliberative body for tobacco control in public places in this Municipality.

The municipal public health administrative department is responsible for tobacco control in public places in the city. Patriotic health campaign committee Office and Municipal Health Education Institute are responsible for specific work.

The district health administrative department shall be responsible for tobacco control in public places within its jurisdiction according to its management authority.

Education, culture, sports, transportation, food and drug supervision, public security, real estate, industry and commerce, urban management and other comprehensive administrative law enforcement departments shall, in accordance with these provisions and other relevant provisions, carry out the supervision and management of tobacco control in public places. Article 5 Smoking is prohibited in the following places.

(a) the indoor and outdoor areas of nurseries, kindergartens, primary and secondary schools, and the indoor areas of teaching places, student dormitories, restaurants and other schools at all levels;

(2) Indoor and outdoor areas of maternal and child health centers (institutes), children's hospitals and children's welfare homes at all levels and indoor areas of other medical and health institutions;

(3) Indoor areas of sports venues and outdoor seating areas of spectators and competition venues;

(4) Indoor areas of libraries, theaters, exhibition halls, museums, art galleries, memorial halls, science and technology museums, archives, children's palaces, youth activity centers and other public cultural places;

(5) Indoor areas of tourist attractions (spots);

(6) Indoor areas of postal services, telecommunications, securities trading and financial institutions;

(seven) the indoor areas of shopping malls, supermarkets and other commercial places;

(8) Elevator and its waiting area;

(9) Indoor areas of state organs, enterprises, institutions and social organizations;

(ten) in public transport and its ticket office, waiting room and platform and other indoor settings;

(eleven) the indoor areas of hotels, restaurants, video halls, recreation halls (rooms) and bathing places;

(twelve) the indoor area of Internet service places such as Internet cafes;

(thirteen) other places where smoking is prohibited as stipulated by laws, regulations and rules of the state. Article 6 Where it is necessary to set up a smoking room or designate a smoking area, the unit where the public place is located shall abide by the following provisions.

(a) in line with the requirements of fire safety;

(2) Setting up obvious signs;

(3) Effective isolation from places where smoking is prohibited;

(four) away from crowded areas and pedestrians must pass through the channel.

According to the actual situation, with reference to these regulations, no-smoking areas can be set up in public places other than no-smoking places, and relevant management work should be done well. Article 7 The municipal government may, in accordance with these regulations, adjust the scope of no-smoking places according to the actual situation or the needs of holding temporary large-scale activities. Article 8 Units that prohibit smoking shall perform the following duties.

(a) to establish and improve the responsibility system for the management of smoking ban in public places, and do a good job in the publicity and education of smoking ban;

(two) set up a unified no-smoking sign and the report and complaint telephone number of the relevant administrative departments in the eye-catching position of the no-smoking area;

(3) There are no cigarette vending machines, appliances and tobacco advertisements related to smoking in the no-smoking area;

(4) Persuade smokers in non-smoking areas to stop smoking; Those who do not listen to dissuasion are required to leave the place; Do not listen to dissuasion, do not leave the place, report and complain to the relevant administrative departments; Those who do not listen to dissuasion and affect public order shall report to the public security organ. Article 9 Anyone has the right to ask smokers to stop smoking in places where smoking is prohibited. Have the right to ask the units that prohibit smoking and their supervisors to discourage and stop smoking; Have the right to report violations of these provisions. Tenth education, culture, health and other departments and news units should often carry out social propaganda that smoking is harmful to health and expose units and individuals that violate these provisions.

Every year on May 3rd 1 day, World No Tobacco Day, tobacco product operators stop selling cigarettes1day. All units should actively carry out propaganda work. Eleventh tobacco control supervision and management in accordance with the following provisions.

(a) the education administrative department is responsible for the supervision and management of tobacco control in schools at all levels;

(two) the administrative departments of culture and sports and the scenic spot management agencies are responsible for the supervision and management of tobacco control in culture, entertainment, stadiums and tourist attractions (spots);

(3) The institutions undertaking airport and railway health supervision and the traffic administrative law enforcement departments shall, according to their respective duties, supervise and manage the tobacco control work of public transport vehicles and related public places;

(four) the food and drug supervision and management department is responsible for coordinating the supervision and management of tobacco control in catering establishments;

(five) the public security department is responsible for the supervision and management of tobacco control in Internet cafes and other Internet service places, bathing places and hotels;

(six) the real estate administrative department is responsible for the supervision and management of tobacco control in public elevators within the property management area;

(seven) the comprehensive administrative law enforcement departments of industry and commerce and urban management shall seriously investigate and deal with the illegal acts of setting up tobacco advertisements in public places;

(eight) the administrative department of health is responsible for the supervision and management of tobacco control in medical and health institutions at all levels, as well as in other public places as stipulated in these Provisions.
