Regulations of Kunming Municipality on the Administration of Muslim Food

chapter I general provisions article 1 in order to standardize the production and operation of halal food, strengthen the management of halal food, promote the healthy development of halal food industry and safeguard national unity, these regulations are formulated in accordance with the food safety law of the people's Republic of China, the regulations of the State Council on urban ethnic work and other laws and regulations, and in combination with the actual situation of this municipality. Article 2 The term "halal food" as mentioned in these Regulations refers to the food that is produced, processed, stored, transported and sold (hereinafter referred to as production and operation) according to the customs of muslim food, such as Hui and other ethnic minorities. Article 3 These Regulations shall apply to the production and operation of halal food and its supervision and management activities within the administrative area of this Municipality. Article 4 The people's governments of cities and counties (cities, districts) shall establish and improve the working mechanism of supervision and management of halal food, and implement the responsibility of supervision and management.

halal food supervision and management funds are included in the fiscal budget at the same level. Fifth city and county (city, district) administrative departments of ethnic affairs shall be responsible for the supervision and management of halal food within their respective administrative areas.

quality supervision, industry and commerce, commerce, agriculture, health, food and drug supervision, public security and other administrative departments shall, according to their respective responsibilities, do a good job in the supervision and management of halal food. Article 6 The people's governments of cities and counties (cities, districts) shall encourage and support the industrialization and large-scale production and operation of Muslim food. Article 7 Islamic associations and halal food industry associations shall cooperate with relevant administrative departments to do a good job in the supervision and management of halal food. Article 8 All ethnic groups should respect each other's eating habits, enhance national unity and promote social harmony. Chapter II Production and Operation Article 9 The production and operation of halal food shall implement the quasi-operation management system of halal food.

anyone who engages in the production and operation of Muslim food shall, in addition to obtaining relevant licenses according to law, apply to the local administrative department of ethnic affairs of the county (city, district) for the Muslim Food Business Permit.

those who have not obtained the halal food business license shall not produce and operate halal food, and shall not affix the word "halal" or design on the enterprise name, shop name, products and their packaging, or use words or logos with halal meaning. Article 11 To apply for a halal food permit, the following conditions shall be met:

(1) a notice of pre-approval of the name of an enterprise or individual industrial and commercial household;

(2) It has obtained a food production license, a food circulation license or a catering service license according to law;

(3) There are special places, processing tools, measuring instruments, storage containers and means of transport for the production and operation of halal food;

(4) Individual industrial and commercial households that produce and operate halal food should be ethnic minority citizens with muslim food habits;

(5) The legal representative of the enterprise or the main production and operation managers have ethnic minority citizens with muslim food habits;

(6) Personnel in key positions such as purchasing, slaughtering, storage and main production shall be ethnic minority citizens with muslim food habits.

a Muslim restaurant run by a unit shall meet the conditions specified in items (3) and (6) of the preceding paragraph. Article 11 To apply for a halal food permit, the following materials shall be submitted:

(1) A written application;

(2) notice of pre-approval of the name of an enterprise or individual industrial and commercial household;

(3) documents of food production license, food circulation license or catering service license;

(4) commitment letter of Muslim food quality;

(5) proof of citizenship as stipulated in items (4), (5) and (6) of article 11 of these regulations.

the Muslim restaurant run by the unit itself shall provide the materials specified in items (1) and (4) of the preceding paragraph, as well as the citizenship certificates of personnel in key positions such as purchasing, slaughtering, storage and main production. Twelfth county (city, district) administrative departments of ethnic affairs shall, within 11 working days from the date of receipt of the application, issue the "halal food business license" to meet the conditions; For those who do not meet the requirements, explain the reasons in writing. Thirteenth "halal food business license" by the municipal administrative department of ethnic affairs unified production.

the annual inspection system is implemented for the halal food permit, and the validity period is three years.

if the validity period expires and needs to be extended, an application shall be submitted to the original issuing department within 31 days before the expiration of the validity period. Fourteenth units and individuals engaged in the production and operation of halal food shall hang the "halal food business license" in a prominent position in the production and operation places.

it is forbidden to transfer or lease the halal food permit. Fifteenth units and individuals that produce and operate halal food change their business scope or terminate their production and operation, and shall go through the formalities of change or cancellation at the original issuing department. Sixteenth halal food production sites shall not produce and operate halal taboo food. Seventeenth halal food raw materials should meet the requirements of halal. Eighteenth halal food advertisements, publications, promotional materials, packaging and other printed products shall not contain content that infringes on the customs and habits of ethnic minorities who eat halal food.

when printing the articles mentioned in the preceding paragraph, a printing enterprise shall check the client's halal food permit. Nineteenth shall not bring taboo halal food into the halal restaurant or halal food franchise places. Twentieth supermarkets, shopping malls, farmers' markets or bazaars set up Muslim food areas or counters according to consumer demand; Muslim food should be stored in special counters and managed by special personnel.
