chapter I general provisions article 1 these regulations are formulated in accordance with the law of the people's Republic of China on the prevention and control of environmental pollution by solid waste, the law of the people's Republic of China on the prevention and control of environmental pollution by solid waste, the law of the people's Republic of China on environmental protection and other laws and administrative regulations, and in combination with the actual situation of this province. Article 2 These Regulations shall apply to the prevention and control of environmental pollution by solid waste within the administrative area of this province.
these regulations are not applicable to the prevention and control of environmental pollution by radioactive solid waste.
these regulations apply to the prevention and control of pollution caused by liquid waste; However, the relevant laws and regulations are applicable to the prevention and control of pollution of wastewater discharged into water bodies, and these regulations are not applicable.
if there are provisions in laws and administrative regulations on the prevention and control of environmental pollution by solid waste, such provisions shall prevail. Article 3 The prevention and control of environmental pollution by solid waste shall adhere to the principles of reduction, recycling and harmlessness.
all units and individuals should take measures to reduce the output of solid waste, promote the comprehensive utilization of solid waste, and reduce the harmfulness of solid waste. Fourth solid waste pollution prevention and control adhere to the principle of pollution responsibility.
Units and individuals that generate, collect, store, transport, utilize and dispose of solid waste shall take measures to prevent or reduce the environmental pollution caused by solid waste, and shall be responsible for the environmental pollution caused by it according to law. Article 5 People's governments at all levels shall be responsible for the prevention and control of environmental pollution by solid waste within their respective administrative areas, and shall strengthen their leadership in the prevention and control of environmental pollution by solid waste, organize, coordinate and urge relevant departments to perform their duties of supervision and management of environmental pollution by solid waste according to law, incorporate the completion of the prevention and control targets of environmental pollution by solid waste into the annual assessment, and implement the target responsibility system and evaluation system for environmental pollution prevention and control by solid waste.
the people's governments at or above the county level shall incorporate the prevention and control of environmental pollution by solid waste into the national economic and social development plan and the ecological environmental protection plan, and formulate and implement economic and technical policies and measures conducive to the prevention and control of environmental pollution by solid waste.
encourage and support the resource utilization and harmless disposal of solid waste, improve the comprehensive utilization rate of solid waste, and minimize the amount and danger of solid waste landfill.
encourage and support scientific research, technological development and information construction in the prevention and control of environmental pollution by solid waste, and popularize advanced prevention and control technologies, production processes and equipment.
encourage and support various social investors to participate in the investment, construction and operation of solid waste treatment and disposal projects. Article 6 The competent department of ecological environment shall exercise unified supervision and management over the prevention and control of environmental pollution by solid waste within their respective administrative areas.
the competent departments of the people's governments at or above the county level, such as development and reform, industry and information technology, public security, natural resources, housing and urban construction, transportation, water conservancy, agriculture and rural areas, commerce, health, emergency management, market supervision, education, environmental sanitation and postal services, are responsible for the supervision and management of the prevention and control of environmental pollution by solid waste within their respective functions and duties. Seventh advocate green and low-carbon lifestyle and consumption, guide the public to enhance the awareness of ecological environmental protection, do a good job in the classification of domestic waste, and participate in the prevention and control of environmental pollution by solid waste. Article 8 The provincial people's government may establish a joint prevention and control mechanism for cross-regional solid waste pollution with the people's governments of relevant provinces, autonomous regions and municipalities directly under the Central Government, coordinate cross-regional cooperation in the prevention and control of solid waste pollution, and promote the prevention and control of solid waste pollution.
the relevant departments of the provincial people's government can establish a communication and coordination mechanism with the relevant departments of the people's governments of relevant provinces, autonomous regions and municipalities directly under the central government, and negotiate to solve the specific issues of cross-regional cooperation in the prevention and control of environmental pollution by solid waste.
encourage cities (states) and counties (cities, districts) within the administrative region of this province to carry out regional cooperation according to the principle of proximity, establish a joint prevention and control mechanism for environmental pollution caused by solid waste, co-ordinate the construction of facilities and places for centralized disposal of solid waste, and strengthen the sharing of solid waste management information and joint law enforcement. Article 9 People's governments at all levels shall strengthen the prevention and control of environmental pollution by solid waste, and arrange necessary funds for the following matters according to the principle of division of powers:
(1) Scientific research and technological development for the prevention and control of environmental pollution by solid waste;
(2) domestic waste classification;
(3) Construction of centralized solid waste disposal facilities;
(4) Emergency disposal of hazardous wastes such as medical wastes generated by emergencies such as major infectious diseases;
(5) Other matters related to the prevention and control of environmental pollution by solid waste.
performance management and audit supervision should be strengthened in the use of funds to ensure the efficiency in the use of funds. Tenth departments in charge of ecological environment and other departments responsible for the supervision and management of the prevention and control of environmental pollution by solid waste shall announce the ways and channels of reporting complaints to the public.
any unit or individual has the right to complain and report illegal acts such as illegal dumping, transfer, disposal and storage of solid waste that cause environmental pollution.
the department that receives the report shall handle it in time and keep the relevant information of the informant confidential; Reward those who report their real names and verify them.
if an informer reports to his unit, the unit shall not take revenge on the informer by dissolving or changing the labor contract or by other means.
