Article 1 These Measures are formulated in accordance with the Tourism Law of the People's Republic of China, the Opinions of the Central Civilization Committee on Further Strengthening Civilized Tourism and relevant laws, regulations and normative documents in order to promote the construction of tourism integrity and enhance citizens' awareness of civilized travel.
Article 2 China tourists who violate domestic and foreign laws, regulations, public order and good customs in the process of traveling at home and abroad, resulting in serious social adverse effects, shall be listed as "uncivilized behavior records of tourism". Mainly includes:
(a) disturbing the order of aircraft, vehicles, ships or other public transport;
(2) Destroying public health and public facilities;
(3) Violating the social customs and national living habits of the tourist destination;
(four) damage, destruction of cultural relics in tourist destinations;
(5) Participating in gambling, pornography and drug activities;
(six) do not listen to dissuasion and warning to engage in activities that endanger the personal and property safety of themselves and others;
(seven) the destruction of the ecological environment, in violation of the provisions of wildlife protection;
(eight) in violation of the provisions of tourist sites, seriously disrupting the order of tourism;
(nine) other acts that have caused serious social adverse effects as determined by the tourism authorities in the State Council.
Because of the guardian's major fault, the ward has uncivilized tourism behavior, and the guardian is included in the "uncivilized tourism behavior record".
Article 3 The acts of the staff engaged in tourism management and service (hereinafter referred to as "tourism professionals") that have caused serious social adverse effects due to violation of laws and regulations, work norms, public order, good manners and professional ethics in the process of tourism management and service shall be included in the "uncivilized behavior record of tourism". Mainly includes:
(a) price fraud, forced trading, and deception to induce tourists to spend;
(2) Insulting, beating or coercing tourists;
(three) do not respect the religious beliefs, ethnic customs and customs of tourist destinations or tourists;
(4) spreading vulgar tastes and advocating superstitious ideas;
(five) other uncivilized tourism acts identified by the tourism authorities in the State Council.
Article 4 The information content of "uncivilized tourism behavior record" includes:
(a) the name, gender and domicile province of the uncivilized behavior party;
(two) the specific performance of uncivilized behavior, the impact and consequences of uncivilized behavior;
(3) the time limit for uncivilized behavior records.
Fifth the State Council tourism authorities to establish a national "tourism uncivilized behavior record". Provincial tourism administrative departments can set up "uncivilized tourism behavior records" within their respective administrative areas.
Article 6 Local tourism authorities at all levels shall, jointly with relevant departments, integrate social resources, investigate and verify uncivilized tourism behaviors of people who have domicile or habitual residence within their administrative areas, and report to the tourism authorities at the next higher level in time.
Uncivilized tourism behaviors reported by the media or the public shall be investigated and verified by the tourism authorities in the place where the uncivilized behaviors occurred, and the tourism authorities in the place where the parties are domiciled or registered shall cooperate.
Uncivilized tourism behaviors occurring abroad shall be investigated and verified by the tourism authorities in the State Council or the tourism authorities in the domicile or habitual residence of the parties concerned through diplomatic agencies and tourism offices abroad.
Seventh tourism authorities at all levels shall keep confidential the relevant information of informants. Encourage and support the public, news media and business units such as tourism, transportation, catering, shopping, entertainment and leisure to report uncivilized tourism behavior to the tourism authorities.
Eighth "tourism uncivilized behavior record" shall be approved by the "tourism uncivilized behavior record review committee" before it can be formed. The tourism uncivilized behavior record review committee consists of government departments, legal experts, tourism enterprises and tourists' representatives. The main review items include:
(a) whether uncivilized behavior events should be included in the "uncivilized behavior record of tourism";
(two) to determine the information retention period of the uncivilized behavior record of tourism;
(3) Whether the Record of Uncivilized Tourism Behavior has been notified to the relevant departments;
(4) Dynamically adjust the record period of the "uncivilized behavior record of tourism".
Ninth "uncivilized tourism behavior records" information retention period is 1 to 5 years, and dynamic management is implemented.
(1) If the parties involved in uncivilized tourism violate the criminal law, the information shall be kept for 3 to 5 years;
(two) if the parties involved in uncivilized tourism behavior are subject to administrative punishment or court judgment, the information shall be kept for 2 to 4 years;
(three) uncivilized tourism behavior has not been punished by laws and regulations, but it has caused serious social impact, and the information retention period is 1 to 3 years.
Tenth "tourism uncivilized behavior record" after the formation of the State Council tourism authorities can be "tourism uncivilized behavior record" information to the public.
Eleventh "tourism uncivilized behavior record" is formed, the tourism authorities shall inform or serve the relevant information to the parties themselves, and inform them that they enjoy defend oneself. The parties have the right to reply within 30 working days after receiving the notice of reply. The tourism authorities shall give a written reply within 30 working days after receiving the written reply. If the defense reasons are adopted, the recording period may be adjusted or the recording may be cancelled according to the defense reasons of the parties.
During the defense period, the information disclosure will not be affected.
Twelfth "tourism uncivilized behavior record" after the formation, according to the degree of remedial measures taken by the recorded person to recover the adverse effects, the social effect of civilized tourism publicity and guidance, after consideration by the review committee, the recording period can be shortened.
Thirteenth state functionaries who intentionally provide false information or tamper with, damage, illegally use or publish "uncivilized tourism behavior records" information shall be given administrative sanctions in accordance with relevant regulations; If the circumstances are serious, legal responsibility shall be investigated according to law.
Fourteenth after the promulgation of these measures, the Record of Uncivilized Tourism Behavior shall be managed with reference to these measures. The "uncivilized behavior record of tourists" established before the promulgation of these Measures shall remain valid.
Fifteenth these Measures shall be implemented as of the date of promulgation, and the National Tourism Administration shall be responsible for the interpretation. The Interim Measures for the Administration of Uncivilized Behavior Records of Tourists issued by the National Tourism Administration in April shall cease to be implemented as of the date of promulgation of these Measures.
