Regulations of Changchun Municipality on Fire Control of Public Entertainment Places
Article 1 In order to strengthen the fire control safety management of public entertainment places, prevent and reduce fires, and ensure personal and property safety, these regulations are formulated in accordance with the Fire Prevention Law of the People's Republic of China and other laws and regulations, and in combination with the actual situation of this Municipality.
Article 2 The public entertainment places mentioned in these Provisions refer to the following places for public use:
(1) performance and projection places such as theaters, video halls and auditoriums;
(2) Dance halls, karaoke halls and other places of song and dance entertainment;
(3) nightclubs, music cafes, restaurants and bathing places with entertainment functions;
(4) indoor recreation places;
(5) commercial sports venues such as fitness, entertainment, competitions and performances;
(6) Other public entertainment places.
article 3 these provisions shall apply to the fire control management of public entertainment places within the administrative area of this municipality.
Article 4 The public security organs of cities, counties (cities) and districts are the fire control departments of the people's governments at the corresponding levels. The fire control institutions of public security organs shall exercise fire control supervision according to law.
article 5 the fire control work in public places of entertainment shall follow the policy of "putting prevention first and combining prevention with elimination", and implement the fire safety responsibility system.
Article 6 Units and individuals operating public entertainment places must fill in the Approval Form for Fire Safety in Public Entertainment Places, and after passing the examination by the county (city) and district public security fire control institutions, the municipal public security fire control institutions will issue the Fire Safety Permit for Public Entertainment Places.
the fire safety permit for public entertainment places is subject to the annual examination system.
article 7 the construction, reconstruction, expansion or interior decoration of public entertainment places must be examined and approved by public security fire control institutions before construction, and can only be used after the project is completed and accepted by public security fire control institutions.
commercial public entertainment venues shall participate in fire insurance and public liability insurance in accordance with the relevant provisions of the Insurance Law of the People's Republic of China.
Article 8 The fire resistance rating of buildings in public entertainment places shall not be lower than Grade II.
article 9 public entertainment places shall not be set up in buildings such as ancient cultural relics, museums, libraries, exhibition halls, warehouses for important and dangerous goods, and shall not be rebuilt in residential buildings.
article 11 when public entertainment places are adjacent to or attached to other buildings, they shall be set up in independent fire zones.
Article 11 In addition to other provisions of these Provisions, the establishment of public entertainment places in underground buildings must meet the following requirements:
(1) Only the underground floor is allowed;
(2) The ceiling and wall surface for interior decoration shall be made of non-combustible materials;
(3) There shall be no less than two safety exits leading to the ground, and the width of each staircase shall not be less than 1.5 meters;
(4) Mechanical smoke prevention and exhaust facilities shall be set up;
(5) An automatic fire alarm system and a fire alarm device shall be set up;
(6) it is forbidden to use liquefied petroleum gas.
article 12 the number, evacuation width and distance of safety exits in public entertainment places must comply with the provisions of the code for fire protection design of buildings or the code for fire protection design of high-rise civil buildings.
Article 13 No threshold or steps shall be set at the exit, and the evacuation doors shall be opened outwards, and rolling doors, revolving doors, side sliding doors and hanging doors shall not be used. Door curtains, screens and other obstructions that affect evacuation shall not be set at the door.
article 14 the emergency exits, evacuation walkways and stairs must be equipped with standard light evacuation signs. Indicating signs should be located at the top of doors, evacuation walkways and corners on the wall below one meter from the ground. The spacing of indicating signs on the walkway shall not be more than 21 meters.
Fifteenth public entertainment places must be equipped with fire emergency lighting, and the continuous power supply time shall not be less than twenty minutes.
Article 16 Electrical equipment in public entertainment places must be installed and maintained by electricians with professional certificates. The wiring of electrical equipment shall be equipped with protective devices such as overload, leakage and short circuit, and unqualified safety devices are strictly prohibited. Electricity consumption shall not exceed the rated load, and temporary lines shall not be connected without authorization.
the laying of electrical lines and the installation of electrical appliances and air-conditioning equipment must strictly follow the relevant construction and installation regulations and take fire prevention and heat insulation measures.
article 17 the setting of the distribution room in public entertainment places and the installation of all kinds of lamps and audio equipment must comply with the provisions of the code for fire protection design of buildings.
Article 18 The interior decoration design and construction of public entertainment places must meet the following requirements:
(1) The ceiling shall be made of non-combustible materials (gypsum board installed on steel keel can be used as non-combustible materials);
(2) The walls, floors and partitions shall be made of non-combustible materials;
(3) Curtains (curtains), curtains and furniture wrapping should be made of flame retardant fabric or treated with flame retardant;
(4) The ceiling, wall and floor of the kitchen should be made of non-combustible materials.
Article 19 When public entertainment places are in business, it is forbidden to carry out equipment maintenance, welding, painting, painting or non-emergency maintenance.
Article 21 Public entertainment places where gas appliances are allowed to be used shall be equipped with automatic gas alarm cut-off valves, and comply with the relevant provisions on safe gas use.
if liquid fuel is used, effective fire separation measures should be taken. Open flame lighting shall not be used in public entertainment places.
Article 21 When public entertainment places are open, the safety exits and evacuation walkways should be kept clear, and it is forbidden to lock, block and pile up sundries. .
Article 22 The decoration and business activities of public entertainment places shall not affect the identification and use of safety evacuation signs, safety exits and evacuation passages, and shall not change the position of fire control facilities or affect their normal use. When decorations are consistent with fire hydrant doors, obvious signs should be set up.
article 23 inflammable, explosive and other dangerous articles shall not be brought into or stored in public entertainment places.
Article 24 Employees' dormitories shall not be set up in public entertainment places.
Article 25 When a public entertainment venue is open, it shall not exceed the rated number of people.
Article 26 After the business of public entertainment venues is closed every day, the staff should clean up and inspect the venue, remove flammable and combustible sundries, and inspect all electrical appliances. If there is no need for continuous power supply, the power supply should be cut off and records should be made.
Article 27 Public entertainment places should strictly implement the night duty patrol system, so as to make timely inspections and eliminate risks in time.
article 28 the use of electrical equipment in public entertainment places should strictly abide by the relevant norms. Overload operation is prohibited. When power needs to be increased, it must be examined and approved by the public security fire control institution before the original line can be rectified.
Article 29 The legal representative or principal person in charge of public entertainment places is the person in charge of fire control safety, who is fully responsible for the fire control work of his own unit and must perform the fire control safety duties stipulated in the Fire Protection Law of the People's Republic of China.
Article 31. Those who have made outstanding achievements and contributions in the fire control work in public entertainment places shall be rewarded.
article 31 public security fire control institutions shall supervise and inspect the compliance of public entertainment places with fire control laws, regulations and these provisions, and notify public entertainment places to eliminate fire hazards in time when finding fire hazards.
Article 32 Any staff member of public security fire control institutions who abuses his power, neglects his duty or engages in malpractices for personal gain shall be given administrative sanctions according to law. If a crime is constituted, criminal responsibility shall be investigated according to law.
Thirty-third public entertainment venues in violation of the provisions of any of the following acts, shall be ordered to make corrections within a time limit; If it fails to make corrections within the time limit, the responsible person shall be given a warning or fined between RMB 111 and RMB 1111:
(1) Personnel in key fire safety positions such as electricians and fire control room operators operate in violation of regulations;
(2) the person in charge of fire prevention fails to perform his duties;
(3) the person in charge of fire prevention lied, failed to report or deliberately delayed reporting the fire situation;
(4) employees' dormitories are set up in public entertainment places.
article 34 public entertainment venues that violate these regulations and commit any of the following acts shall be ordered to make corrections within a time limit; If it fails to make corrections within the time limit, it shall be ordered to suspend business, and the responsible person shall be fined from 211 yuan to 2111 yuan; A fine of more than 3,111 yuan and less than 21,111 yuan shall be imposed on the responsible unit:
(1) Failing to eliminate fire hazards in time;
(2) failing to allocate fire-fighting facilities and equipment in accordance with relevant regulations;
(3) the evacuation passage and the safety exit cannot be guaranteed to be unblocked;
(4) storing inflammable and explosive dangerous goods or using liquefied petroleum gas in underground buildings.
article 35 public entertainment places that seriously endanger fire control safety shall be ordered to make corrections within a time limit if they commit any of the following acts; If it fails to make corrections within the time limit, it shall be ordered to stop the construction, and the responsible person shall be fined between 2,111 yuan and 31,111 yuan in 211 yuan, and the responsible unit shall be fined between 5,111 yuan and 31,111 yuan: < P > (1) The newly built, rebuilt, expanded, decorated or renovated project is constructed without the approval of the public security fire control institution or the unqualified audit;
(2) after the completion of the project, it is used without fire control acceptance or unqualified acceptance;
(3) lowering the technical standards for fire control without authorization, and using building components, building materials or decorative and decoration materials that do not meet the national or industrial standards for fire prevention.
article 36 if the installation of electrical equipment and gas appliances or the laying of lines and pipelines do not meet the technical specifications for fire safety, it shall be ordered to make corrections within a time limit; If no correction is made within the time limit, it shall be ordered to stop using it.
article 37 units that violate these regulations and cause fires and losses to others' lives and property and state property shall be fined according to 5%-11% of the fire losses, and the responsible person and the legal representative of the unit shall be fined from 211 yuan to 1,111 yuan.
article 38 if a party refuses to accept the decision on administrative punishment in violation of these provisions, he may apply for administrative reconsideration or bring a lawsuit according to law within 15 days from the date of receiving the decision on administrative punishment. If it fails to apply for administrative reconsideration or neither bring a lawsuit nor execute it within the time limit, the organ that made the decision on administrative punishment shall apply to the people's court for compulsory execution.
article 39 the municipal public security fire control institutions shall be responsible for organizing the implementation of these provisions.
Article 41 These Provisions shall come into force as of the date of promulgation.
