Regulations of Suqian Municipality on the Administration of Farmers' Markets
Chapter I General Provisions Article 1 In order to strengthen the management of farmers' markets, standardize the order of farmers' markets and promote the healthy development of farmers' markets, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, construction, operation, supervision and management of farmers' markets in central cities of cities and counties within the administrative area of this Municipality. Article 3 The term "farmer's market" as mentioned in these Regulations refers to a trading place with fixed stalls, shops and corresponding facilities, which is mainly engaged in the wholesale and retail of edible agricultural products.

The term "farmers' market operators" as mentioned in these Regulations refers to legal persons and unincorporated organizations that provide venues, facilities and services for operators in the market and engage in the management of farmers' markets.

The floor operators mentioned in these Regulations refer to natural persons, legal persons or unincorporated organizations that independently engage in business activities in the farmers' market. Article 4 The people's governments of cities and counties (districts) shall lead the planning, construction, supervision and management of farmers' markets, establish a coordination mechanism for the management of farmers' markets, and study and solve major problems in the construction and management of farmers' markets.

The market supervision and management department is the lead unit of the management coordination mechanism of the farmer's market, and is responsible for registering the farmers' market promoters and floor operators according to law, and supervising and managing the operating order and food safety in the floor.

The commercial department is responsible for the preparation of special plans for farmers' markets, the formulation of norms for the construction of farmers' markets, and the guidance for the construction and upgrading of farmers' markets.

The urban management department is responsible for the supervision and management of the city appearance and environmental sanitation of the farmers' market.

The agricultural and rural departments are responsible for the supervision and management of animal epidemic prevention in farmers' markets, guiding the management of live poultry in farmers' markets, environmental disinfection in slaughterhouses and the harmless treatment of dead poultry.

The health department is responsible for the supervision and management of patriotic health and disease vector prevention and control in the farmer's market.

The public security organ shall supervise and manage the farmers' market and its surrounding public security order.

Natural resources and planning, housing and urban and rural construction, emergency management, fire rescue and other relevant departments and institutions shall supervise and manage the farmer's market within their respective functions and duties.

Sub-district offices shall assist all functional departments to do a good job in the supervision and management of farmers' markets in this area, and guide and urge farmers' market promoters in this area to implement management responsibilities. Article 5 The farmers' market has the nature of public welfare. City and county (District) people's governments shall formulate supporting policies to promote the construction, management and development of farmers' markets. Article 6 Farmers' market promoters and market operators are encouraged to use modern information technologies such as the Internet of Things and artificial intelligence to conduct intelligent management and operation such as transaction traceability, measurement supervision and price monitoring. Chapter II Planning and Construction Article 7 The people's governments of cities and counties shall reserve space for the construction of farmers' markets when making land spatial planning, and shall plan and construct farmers' markets as public service facilities when implementing the construction of new urban areas and the transformation of old urban areas. Article 8 The municipal and county commerce departments shall, jointly with the natural resources and planning departments, work out a special plan for the farmers' market in accordance with the principles of unified planning, rational layout, convenient living and convenient trading, and report it to the people's government at the same level for approval before implementation. Article 9 The municipal commerce department shall, jointly with the municipal market supervision and management, the municipal housing and urban and rural construction, the municipal urban management and other departments, formulate the norms for the construction and acceptance of farmers' markets according to the relevant provisions of the state and the province, and announce them to the public after being approved by the Municipal People's Government. Tenth farmers' market construction norms shall make provisions on the following matters:

(a) the construction standards of food testing, fire safety, parking lots, public toilets, garbage collection, sewage treatment, water and electricity and other equipment and facilities;

(two) according to the types of goods, delimit the regional layout of fresh, live, raw, cooked, dry and wet functional transactions in the market;

(3) Areas engaged in live poultry trading shall be equipped with facilities that meet the requirements of animal epidemic prevention and independent ventilation systems, wastewater filtration and oil separation pretreatment systems;

(4) There should be facilities to prevent the overflow and precipitation of stored water in areas where fresh aquatic products and pickled foods are operated;

(five) areas engaged in edible agricultural products, equipped with vector prevention facilities in line with national standards;

(six) other matters stipulated by laws and regulations. Eleventh new construction, renovation and expansion of farmers' markets shall meet other conditions stipulated by the special planning, construction norms and laws and regulations of farmers' markets. Twelfth farmers market land use rights and housing ownership shall not be arbitrarily divided and transferred. When obtaining the land use right, the construction land of the farmer's market should be clearly defined in the land transfer contract or the approval document of land allocation, and the land use right of the farmer's market shall not be divided and transferred without authorization.

Do not change the use of the farmers' market without authorization. If it is really necessary to change the use of the farmers' market, the commercial department shall hold a hearing in conjunction with natural resources and planning, market supervision and management, housing and urban and rural construction, urban management and other departments. , and after listening to the opinions of interested parties, report to the people's government at the same level for approval. Thirteenth city and county (District) people's governments shall arrange funds for the construction of farmers' markets and support the construction, reconstruction and expansion of farmers' markets; Explore the implementation of government repurchase, government equity investment and other ways to transform the farmer's market for public welfare. Fourteenth completed farmers' markets do not meet the construction norms of farmers' markets, and should be upgraded in accordance with the construction norms.
