In order to regulate food and food additives production licensing activities, strengthen food production supervision and management, and ensure food safety, these measures are formulated in accordance with the Food Safety Law of People's Republic of China (PRC) and the Administrative Licensing Law of People's Republic of China (PRC).
Article 35 of the Food Safety Law states that the state implements a licensing system for food production and operation. Engaged in food production, food sales, catering services, shall obtain a license according to law. However, the sale of edible agricultural products does not require a license.
