Measures for the Administration of Food Hygiene License in Jiangsu Province (for Trial Implementation) Chapter I General Provisions Article 1 In order to standardize the application, issuance and management of food hygiene licenses, maintain normal food production and operation order and protect consumers' health, according to the Food Hygiene Law of the People's Republic of China (hereinafter referred to as the Food Hygiene Law) and the Administrative Licensing Law of the People's Republic of China (hereinafter referred to as the Administrative Licensing Law) Article 2 Any unit or individual engaged in food production and marketing activities within the administrative area of Jiangsu Province (hereinafter referred to as "food producers and marketers") shall apply to the administrative department of health for a hygiene license according to law, and obtain a food hygiene license after examination and approval by the administrative department of health (hereinafter referred to as "hygiene license") before engaging in food production and marketing activities within the permitted scope, and bear the responsibility for food hygiene in food production and marketing. Article 3 Health administrative departments at all levels shall, in accordance with the authority, scope, conditions and procedures stipulated in laws, regulations, rules and these Measures, follow the principles of openness, fairness, impartiality and convenience, and strictly manage health licenses. Fourth health administrative departments at all levels shall not set up health permits repeatedly or in disguised form by filing, registration or registration. Article 5 Any unit or individual has the right to report illegal acts in the process of issuing and managing health licenses, and the health administrative department shall promptly verify and handle them. Article 6 Citizens, legal persons or other organizations shall enjoy the right of representation, defend oneself and the right to request a hearing according to law when the health administrative department implements the health administrative license. The hearing procedure shall be implemented in accordance with the provisions of the Measures for the Administration of Health Administrative Licensing. Seventh health administrative departments at all levels to implement the food hygiene license funds, should be included in the fiscal budget at the corresponding level. If fees can be charged according to regulations, they shall be charged according to the published legal items and charging standards.
