Provisions of Chongqing Municipality on the Administration of Urban Water Garbage

article 1 in order to strengthen the management of garbage in urban waters and reduce water pollution, these provisions are formulated in accordance with the regulations of Chongqing municipality on the administration of urban environmental sanitation. Article 2 These Provisions shall apply to the cleaning, collection, salvage, transportation and disposal of garbage in the urban waters of this Municipality (hereinafter referred to as urban waters).

the cities mentioned in these provisions refer to urban areas, suburbs, county (autonomous county, city) planning areas and towns.

the water areas mentioned in these provisions refer to the areas that are composed of water bodies, beaches and bank slopes within the coastline of rivers, lakes and reservoirs, and the areas along the rivers, lakes and reservoirs, such as ports, docks and bazaars, where the garbage may enter the water bodies under the action of natural forces.

the garbage mentioned in these provisions refers to the wastes generated in the daily life of the city and the activities of providing services for the daily life of the city, and the muck, spoil, waste materials and other wastes generated in the construction activities, excluding industrial solid wastes and hazardous wastes. Article 3 The principle of combining unified leadership with territorial management, and the responsibility of professional departments with the responsibility of responsible units shall be implemented in the management of garbage in urban waters. Article 4 The people's governments of counties (autonomous counties and cities) shall incorporate the management of urban water waste into their economic and social development plans and organize their implementation. Article 5 The municipal administrative department of urban environmental sanitation shall be responsible for the supervision and management of urban water garbage, and its daily work shall be the responsibility of the municipal environmental sanitation management institution.

the competent administrative department of urban environmental sanitation of counties (autonomous counties and cities) shall be responsible for the supervision and management of garbage in urban waters within their jurisdiction according to the division of responsibilities.

the administrative departments of environmental protection, maritime affairs, water conservancy, fishery administration, ports, etc. shall, according to their respective responsibilities, cooperate with the supervision and management of garbage in urban waters. Article 6 The responsibility system shall be implemented in the management of garbage in urban waters:

(1) The administrative department of urban environmental sanitation of districts and counties (autonomous counties and cities) shall be responsible for the public sites of river beaches and bank slopes;

(2) the salvage, collection and transportation of river surface garbage shall be the responsibility of the municipal environmental sanitation management institution in the main city and the local environmental sanitation management institution in other areas;

(3) The ship owner or operator is responsible for the collection and treatment of ship garbage;

(4) the management unit shall be responsible for the collection and treatment of garbage in urban waters outside the above scope. Article 7 The area of responsibility for garbage management in urban waters is:

(1) Shoreline beaches extend from the shoreline to the water body to the waterline, and both sides reach the end point where the shoreline is used;

(2) The buildings (structures) in the water area extend 5 meters around according to their positions. Article 8 Within the responsibility area of urban water area garbage management, the responsible unit shall perform the following obligations:

(1) sign a letter of responsibility for water area environmental sanitation management with the local urban environmental sanitation administrative department, and identify the responsible person;

(2) to formulate the water cleaning system in the area of responsibility;

(3) Set up garbage and feces collection or treatment facilities as required;

(4) Remove garbage in time and keep the waters in the area of responsibility clean;

(5) discourage or report violations of these provisions. Article 9 Ships (including barges) or floating facilities such as water entertainment and catering in urban waters shall abide by the following provisions:

(1) Establish and improve the garbage management system, and equip full-time (part-time) personnel to take charge of garbage management affairs;

(2) configure garbage storage containers or garbage bags suitable for garbage disposal, and register garbage collection and transportation as required;

(3) discharge the feces after harmless treatment in accordance with relevant regulations;

(4) The collection, transportation and disposal of toxic, hazardous, inflammable and explosive wastes in ship garbage shall comply with the relevant provisions of the state;

(5) When washing the deck or cabin, it shall be cleaned in advance, and the cargo residues shall not be discharged into the waters;

(6) The ship garbage and excrement from the port with epidemic situation shall be cleaned by the health and quarantine institution in advance before being consigned for removal. Article 11 Ports and docks shall, in accordance with the requirements of environmental sanitation management, build necessary environmental sanitation facilities such as public toilets and garbage collection facilities that meet the standards and keep the environment clean and tidy.

In the bazaars, parking lots, passenger stations and commercial service facilities of rivers, lakes and reservoirs along the Yangtze River, operators should set up their own sanitation facilities such as toilets, closed garbage containers and waste bins in accordance with the standards for sanitation facilities stipulated by the state, which are open to the public for use, and are responsible for management and maintenance, so as to keep the business premises clean and tidy. Article 11 The collection, salvage, transportation and treatment of garbage and excrement from ships and environmental sanitation management responsibility areas in urban waters may be entrusted to water environmental sanitation service units for paid services. Article 12 Units engaged in water environmental sanitation services shall ensure that garbage and excrement are collected daily and transported in a closed manner, and shall not pollute the environment, and shall accept the supervision of the competent administrative department of urban environmental sanitation, the maritime department and the entrusting unit. Thirteenth units and individuals in urban waters must collect, salvage, transport and dispose of garbage in accordance with the provisions of the administrative department of urban environmental sanitation, and may not mix toxic harmful waste with domestic garbage. Article 14 The following acts are prohibited within urban waters:

(1) Scattering wastes such as peels, scraps of paper, cigarette butts and various food packages;

(2) Dumping garbage, feces, littering animal carcasses, etc.;

(3) Dumping toxic, harmful, inflammable and explosive articles;

(4) damaging, closing or moving environmental sanitation facilities without authorization.
