In accordance with the provisions of the Labor Law and the Circular of the Ministry of Labor and Social Security of the People's Republic of China on the Conversion of the Average Monthly Working Hours and Wages of Employees for the Whole Year, there are 104 days/year of statutory public holidays and 11 days of statutory holidays, and the working hours and overtime wages are calculated according to the following methods, which must be enforced by any enterprise: a. Calculation of the working hours of the system: Yearly working days: 365 days - 104 days ( rest days) - 11 days (legal holidays) = 250 days Quarterly working days: 250 days ÷ 4 quarters = 62.5 days/quarter Monthly working days: 250 days ÷ 12 months = 20.83 days/month b. Conversion of daily and hourly wages: Calculation of the number of hours of work: multiply the working days of the month, quarter, or year by the daily number of eight hours. Daily wage: Monthly wage income ÷ Monthly payroll days Hourly wage: Monthly wage income ÷ (Monthly payroll days x 8 hours). Monthly payroll days = (365 days - 104 days) ÷ 12 months = 21.75 days c. Calculation of overtime pay: Overtime pay for each day of extended working hours: (actual working hours - 8 hours) × hourly wage × 150% Overtime pay for statutory public holidays: daily wage × 200% Overtime pay for statutory holidays: daily wage × 300%
