In order to protect the retail business environment of fireworks and firecrackers in our county, and establish a safe, orderly and standardized circulation order of fireworks and firecrackers market, we will do a good job in the examination and approval of retail business license of fireworks and firecrackers in our county during the Spring Festival of 2023, and put forward the following requirements, please follow them. According to the requirements of Regulations on the Safety Management of Fireworks and Firecrackers (Order No.455 of the State Council), Measures for the Implementation of Fireworks and Firecrackers Business License (Order No.65 of the former State Administration of Work Safety), Measures for the Safety Management of Fireworks and Firecrackers in Zhejiang Province (Order No.266 of the People's Government of Zhejiang Province) and Detailed Rules for the Safety Management of Fireworks and Firecrackers in Zhejiang Province (for Trial Implementation), combined with the practice of our county last year, In the urban built-up areas where the county people's government is located, the National Pioneer Park in the county economic development zone and other economic development zones (industrial parks) at or above the provincial level where urbanization management is implemented, and the towns and contiguous village built-up areas where the township people's government is located, it is forbidden to operate and set off fireworks and firecrackers.

First, set up distribution points.

The retail distribution of fireworks and firecrackers shall be examined and approved in accordance with the principles of unified planning, ensuring safety, rational layout, total amount control and convenience for the masses. In 2023, all business units can only apply for seasonal retail licenses and no longer approve long-term retail licenses. In addition to the scope of prohibiting the operation and discharge of fireworks and firecrackers specified in the notice of Qingyuan County People's Government ([2021] No.7), an administrative village has only one operating point in principle, and the seasonal retail units of the previous year have priority under the same conditions. Administrative villages that have set up their own points and meet the safety conditions will no longer consider adding outlets.

Second, safety training and assessment

The person in charge and safety management personnel of the newly established fireworks retail store must undergo safety training and education, and pass the examination of Lishui Emergency Management Bureau, and obtain the examination certificate; Those who have obtained the qualification certificate must attend retraining every year and pass the examination.

Third, the material declaration

The retail unit applying for the "Fireworks Business (Retail) License" shall submit the following application materials and be responsible for its authenticity:

(a) the fireworks business (retail) license application;

(two) a copy of the industrial and commercial business license or industrial and commercial pre-approval certificate (* * * enjoy the materials, do not have to submit);

(3) List of persons in charge and safety management personnel and their identity information (used to approve training and assessment certificates);

(four) a description of the security situation around the retail outlets (schematic diagram or measured map);

(5) Legal certification materials of retail premises (property right certificate, lease agreement or certification materials issued by township streets and comprehensive law enforcement departments);

(6) Safety management system;

(seven) enterprise safety management responsibility.

IV. Examination and Certification

After the registration deadline, the county emergency management bureau will promptly organize personnel to conduct on-the-spot investigation on whether the retail place applied by the applicant meets the requirements of distribution and operation conditions. Those who are qualified will be informed to file a formal application, and those who are unqualified will be informed in person or by telephone. After accepting the application, make a decision on whether to issue the Fireworks Business (Retail) License within 2 days from the date of accepting the application, and inform the applicant in writing. The validity period of the Seasonal Fireworks and Firecrackers Business (Retail) License shall not exceed 30 days (before the Spring Festival 15 days, after the Spring Festival 15 days). To apply for seasonal retail, the establishment and rectification of retail premises must be completed 25 days before the Spring Festival. If you don't do it within the time limit, you will be deemed to have given up automatically and will no longer be admitted.

Verb (short for verb) timing

(a) the deadline for registration is 65438+February 9, 2022, and the registration place is the window of the county emergency management bureau on the third floor of the county administrative service center.

(2) Before June 65438+February 65438+June 2022, the preliminary examination of retail premises, personnel safety training and assessment will be completed.

(3) Before February 23, 2022, 65438+, all applicants sorted out the application materials and submitted them to the window of the County Emergency Management Bureau on the third floor of the County Administrative Service Center. After the deadline, it will no longer be accepted.

Work requirements of intransitive verbs

(a) adhere to the principles of openness, fairness, justice and administration according to law. In strict accordance with the provisions of laws and regulations and the requirements of this circular, we should be serious and responsible, organize the examination and issuance of licenses according to procedures, prohibit retail outlets from being located in the same building as residents' places of residence in the form of "front shop, back room" and "back room", and concentrate on contiguous operation, supermarket sales and non-compliance sales of retail outlets in crowded places and key buildings, and encourage retail outlets to adopt special detachable board houses to ensure that the safety conditions of fireworks and firecrackers retail units meet the requirements.

(2) Strengthen safety supervision to ensure foolproof. The county emergency management bureau takes the approval and issuance of business licenses as the carrier to urge fireworks and firecrackers business units to strengthen safety production and improve safety conditions; Cooperate closely with public security, municipal supervision, comprehensive law enforcement and other departments, resolutely investigate and deal with illegal business practices, and ensure the stability of the safety situation in the field of fireworks and firecrackers in our county.

(III) All townships (towns) and street emergency management stations shall promptly notify the administrative villages and communities under their jurisdiction of the spirit of the document, and will no longer accept the business (retail) license of fireworks and firecrackers within the time limit, and at the same time, do a good job in the management of illegal discharge of fireworks and firecrackers in the territorial jurisdiction during the Spring Festival.

Legal basis:

According to "People's Republic of China (PRC) Air Pollution Prevention Law", "Regulations on the Safety Management of Fireworks and Firecrackers" and other laws and regulations, the county government decided to prohibit the discharge of fireworks and firecrackers in the designated forbidden area. The relevant matters are hereby notified as follows:

1. Banning time: from the date of promulgation of this notice.

Second, the restricted area:

1. The area from the west of Changzhuang Street in Changzhuang Town to the east of Suodian intersection of Suijing Road, and from the junction of Zhusui and Hexing Town to the south of Hexing Street;

2. Location of township governments.

3. No unit or individual may produce, store, transport, sell or set off fireworks and firecrackers in the forbidden area. It is forbidden to carry fireworks and firecrackers on public transport and mail fireworks and firecrackers.
