chapter I general provisions article 1 these measures are formulated in accordance with the relevant provisions of the state and combined with the actual situation of our city in order to promote the sustained and stable development of foreign contracted projects and labor cooperation business in our city, continuously increase foreign exchange resources and foreign exchange income, and strengthen centralized management and business coordination. Article 2 Foreign contracted projects refer to the economic activities that Chinese companies undertake and implement various engineering projects of foreign governments, enterprises, private owners and international organizations abroad by means of bidding and negotiation in accordance with international customary practices or intergovernmental agreements.
Foreign labor service cooperation refers to the economic activities that Chinese companies send all kinds of engineering, production, technical services and tertiary industry laborers abroad according to the provisions of contracts signed with foreign governments, enterprises and private owners. Chapter II Organization and Management Article 3 Shenyang Foreign Economic and Trade Commission (hereinafter referred to as the Municipal Economic and Trade Commission) is the centralized management and coordination department of the city's foreign contracted projects and labor cooperation, and its main responsibilities are:
(1) to implement the national laws, regulations, principles and policies on foreign contracted projects and labor cooperation, and to formulate draft local regulations and rules for the city's foreign contracted projects and labor cooperation business;
(2) investigate and study the international contracted projects and labor cooperation market, analyze the development trend of the contracted projects and labor cooperation market, and formulate development strategies and measures;
(3) to prepare the comprehensive plan of the city's foreign contracted projects and labor cooperation business, including long-term plan and annual plan, and be responsible for organizing the implementation;
(4) coordinating the business relationship between Window Company and various departments engaged in contracted projects and labor cooperation;
(5) to be responsible for the comprehensive statistical work of the city's foreign contracted projects and labor cooperation. Article 4 China Shenyang International Economic and Technical Cooperation Company (hereinafter referred to as Shenyang International Cooperation Company) is a window company authorized by the state to engage in foreign contracted projects and labor cooperation business. Its main responsibilities are:
(1) to implement the laws, regulations and relevant policies of the state, provinces and municipalities on foreign contracted projects and labor cooperation;
(2) to investigate and study the market of international contracted projects and labor cooperation, and to carry out overseas contracted projects and labor cooperation business;
(3) to guide and help all enterprises and institutions in the city to carry out foreign contracted projects and labor cooperation business;
(4) to prepare the long-term plan and annual plan of the company's foreign contracted projects and labor cooperation business;
(5) prepare the statistics and financial statements of the company. Article 5 All enterprises and institutions in the whole city are entities engaged in foreign contracted projects and labor service cooperation, and can sign contracts with foreign countries through Shenyang International Cooperation Corporation. Article 6 Shenyang Foreign Economic Construction Corporation (hereinafter referred to as Shenyang Foreign Construction Corporation) can use the name of Shenyang International Cooperation Corporation to carry out foreign contracted projects and labor cooperation business, and independently organize delegations to go abroad for inspection and negotiation. When signing a contract (agreement) with foreign countries, it must be examined and approved by Shenyang International Cooperation Corporation. Article 7 No company that has not been examined and approved by the Ministry of Foreign Economic Relations and Trade (hereinafter referred to as MOFTEC) may directly sign contracts for contracted projects and labor service cooperation. Article 8 All contracted projects and labor cooperation contracts signed with the Soviet Union and countries in Eastern Europe (hereinafter referred to as the Soviet Union) shall be submitted to the Municipal Economic and Trade Commission for examination and approval, and an approval letter for imported goods shall be issued.
The contracted projects and labor cooperation contracts signed in other countries and regions other than the Soviet Union and Eastern Europe shall be reported to the Municipal Economic and Trade Commission for the record. Article 9 When all enterprises and institutions in the city need to send people abroad for inspection, negotiation, bidding and contract signing to carry out foreign contracted projects and labor service cooperation business, with the consent of the competent authority, Shenyang International Cooperation Company will submit an application report with an invitation letter, a list of people going abroad and other relevant documents, and report to the Municipal Economic and Trade Commission for examination and approval. Article 11 When undertaking contracted projects and labor cooperation business in the countries of the Soviet Union and Eastern Europe, the other party pays the physical objects in our city. For all mechanical and electrical equipment, complete sets of equipment and materials restricted by the state, Shenyang International Cooperation Company shall obtain the consent of the Municipal Mechanical and Electrical Equipment Import Review Office, the Municipal Planning Commission and the Municipal Economic and Trade Commission respectively before signing contracts with other countries. Article 11 The unit that implements the contract for contracted projects and labor service cooperation with the Soviet Union and Eastern Europe shall, on the strength of the approval letter and contract for imported goods, go to the Municipal Economic and Trade Commission to handle the relevant formalities such as importing materials from the Soviet Union and Eastern Europe and applying for import licenses. Chapter III Plan Management Article 12 The Municipal Economic and Trade Commission shall be responsible for the preparation, submission and release of the comprehensive plan for foreign contracted projects and labor cooperation in the whole city, and send a copy to the Municipal Economic and Trade Commission for the record. Article 13 The procedures for reporting and issuing long-term plans and annual plans for foreign contracted projects and labor cooperation compiled by Shenyang International Cooperation Corporation shall be implemented in accordance with the relevant provisions of the Ministry of Foreign Trade and Economic Cooperation. Article 14 The contracted projects and labor cooperation plans prepared by the overseas institutions of Shenyang International Cooperation Corporation shall be submitted to Shenyang International Cooperation Corporation, and at the same time, they shall be copied to the Economic Counseling Office of our embassy (consulate) abroad. Article 15 For projects jointly contracted by window companies, the contract amount indicators shall be compiled by the companies that have signed contracts with foreign countries, and other indicators shall be compiled according to the tasks undertaken by the project implementation unit; When a non-window company is entrusted by the window company to undertake the task of contracting foreign projects and labor cooperation, it must prepare corresponding plans and incorporate them into the plan of the window company; Window company and foreign businessmen or foreign government agencies jointly contracted projects, the company should bear part of the plan. Article 16 The municipal enterprises and institutions shall undertake the project plans arranged by other window companies, and send a copy to the Municipal Economic and Trade Commission for the record when submitting them to the window companies.
