article 1 in order to strengthen the management of urban kitchen waste, maintain a clean and tidy urban appearance and environment, prevent and control environmental pollution, promote the recycling of resources, and ensure people's health, these measures are formulated in accordance with the law of the people's Republic of China on the prevention and control of environmental pollution by solid waste, the regulations of the State Council on the administration of urban appearance and environmental sanitation and the regulations of Shenyang on the administration of urban appearance and environmental sanitation, and other relevant laws and regulations, combined with the actual situation of this municipality. Article 2 The term "kitchen waste" as mentioned in these Measures includes food waste and waste edible oil.
food waste refers to food waste, food residue, expired food, livestock and poultry products that fail inspection and quarantine, etc. generated by food processing, food service and unit catering (hereinafter referred to as kitchen waste generating unit).
Waste edible oils and fats refer to animal and vegetable oils and various oil-water mixtures that can no longer be eaten. Article 3 These Measures shall apply to the generation, collection, transportation, disposal and management activities of kitchen waste in the city and other areas where urbanization management is implemented. The scope of urbanization management areas shall be designated by the Municipal People's Government, and other areas may be implemented with reference to these measures. Article 4 The municipal environmental sanitation department is the administrative department in charge of the management of urban kitchen waste in this Municipality, and is responsible for the daily management and supervision of urban kitchen waste.
the district people's government is responsible for the management of kitchen waste within its jurisdiction, and the district environmental sanitation department is responsible for the supervision and management of the collection, transportation and disposal of kitchen waste within its jurisdiction.
the street office is responsible for the daily supervision of the fixed-point delivery and collection of kitchen waste within its jurisdiction.
planning, development and reform, finance, food and drug supervision (market supervision), environmental protection, public security, urban management and law enforcement, transportation, quality supervision and other competent departments shall, according to their respective responsibilities, do a good job in the supervision and management of kitchen waste. Article 5 The principles of unified leadership, regional responsibility, departmental coordination and public participation shall be implemented in the management of kitchen waste in this Municipality.

Article 6 Any unit or individual has the right to report violations of these measures, and the municipal and district environmental sanitation departments shall establish a complaint reporting system to accept complaints and reports from the public about the illegal activities of kitchen waste generation, collection, transportation and disposal. Article 7 The kitchen waste shall be managed by the combination of separate delivery, fixed-point collection, unified transportation, centralized disposal and self-on-site disposal. Eighth kitchen waste collection, transportation and disposal of paid services, kitchen waste generating units shall pay the garbage disposal fee according to the relevant provisions of the state. Article 9 It is advocated to reduce the amount of kitchen waste by listing clean vegetables and improving processing technology. Encourage the research, development and application of kitchen waste disposal technology and equipment. Encourage qualified kitchen waste generating units to invest in the construction of kitchen waste on-site disposal facilities. Encourage social units to participate in the integrated management of the collection, transportation and disposal of kitchen waste, and promote the resource utilization and harmless treatment of kitchen waste. Article 11 The municipal and district environmental sanitation departments shall, jointly with the relevant departments of development and reform, planning, etc., formulate a plan for the treatment of kitchen waste according to the overall urban and rural planning and the local national economic and social development planning, and make overall arrangements for the layout, land use and scale of kitchen waste collection, transportation and disposal facilities. Public opinions should be widely solicited when making plans for the treatment of kitchen waste. Eleventh kitchen waste generating units shall, in accordance with the provisions, declare the types, output and flow direction of kitchen waste to the local competent department of environmental sanitation. Article 12 A kitchen waste generating unit shall abide by the following provisions:
(1) Set up a kitchen waste collection container that meets the standards, collect and store the kitchen waste separately, and the collection container shall be equipped with an electronic tag, sealed well, clean in appearance, and keep the surrounding environment of the collection container clean and tidy;
(2) set up pollution prevention facilities such as oil-water separation devices or grease traps that meet the specified requirements. Waste edible oils and fats shall be collected in separate containers, and shall not be mixed with other kitchen wastes for collection and storage;
(3) Other provisions made by laws, regulations and rules. Thirteenth units engaged in the collection, transportation and disposal of business kitchen waste shall obtain the permission of the municipal environmental sanitation department according to law. Units that have not obtained permission shall not engage in the collection, transportation and disposal of business kitchen waste.
units engaged in the collection, transportation and disposal of commercial kitchen waste shall obtain franchise rights through fair competition such as bidding according to law. Article 14 The kitchen waste generating unit shall sign a collection and transportation agreement with the unit that has obtained the business license for the collection and transportation of kitchen waste, and confirm the type and quantity of the delivered kitchen waste. Article 15 Units engaged in the collection and transportation of commercial kitchen waste shall meet the following conditions:
(1) Equipped with special vehicles for the collection and transportation of kitchen waste that meet the requirements of this Municipality, transported in a closed manner to prevent spillage, and installed and used necessary systems such as vehicle locator, driving recorder, loading and unloading metering, etc. in accordance with regulations;
(2) It has a sound technology, quality, safety and monitoring management system and has been effectively implemented;
(3) having a legal road transport business license and vehicle driving license;
(4) having a fixed office and parking place for machinery, equipment and vehicles;
(5) Other conditions stipulated by laws, regulations and rules.
