In order to ensure the safe use of post-disaster reconstruction funds by governments at all levels in our city and the aid funds from all walks of life, and ensure the quality of post-disaster reconstruction projects, strict supervision and management, According to the spirit of Sichuan Provincial People's Government's Notice on the Bidding Work of National Investment Projects for Post-disaster Reconstruction (Z.F.F. [2118] No.21) and other documents, we hereby notify you of further strengthening the bidding supervision of post-disaster reconstruction projects in our city as follows.

1. Raise awareness and strictly implement the relevant provisions on bidding for construction projects

The bidding supervision for post-disaster reconstruction projects is an important part of the earthquake relief work and one of the important guarantees for winning the earthquake relief work. All departments at all levels should stand at the height of stressing politics and the overall situation, unify their thinking and understanding, enhance their sense of mission and responsibility in supervisory duties, and conscientiously do a good job in bidding supervision of post-disaster reconstruction projects.

The confirmed emergency projects must also be awarded by the competitive way confirmed by the regulatory authorities. All counties, districts and departments shall not exceed their authority to determine emergency projects, and shall not use other methods to contract at will.

2. Implementing responsibilities and further strengthening supervision

(1) Strengthening supervision in advance, and strictly checking and filing related matters such as bidding. The relevant project examination and approval departments and administrative departments should conscientiously perform their duties according to law and take the initiative to intervene in the prior guidance and supervision of bidding and other activities. Entrust bidding, the bidding agency must be determined by comparison. If the total project amount reaches the scale standard of 51 million, it should be determined by public comparison. If the scale standard is below, it will be determined by invitation comparison. Cross-county (district) projects, township (town) party committees and governments rebuild office buildings, and counterpart support projects of various provinces and cities are approved by the municipal investment authorities. In addition to the organization form of bidding, bidding project and preliminary contracting scheme, etc., it must be reported to the relevant project examination and approval departments and administrative departments for examination and filing according to the authority. The contracting scheme of emergency projects confirmed by the municipal government, as well as matters related to directly determining the contractor's qualifications without bidding and bidding in accordance with the provisions of document No.21 [2118] of Sichuan Government, should be reported to the relevant regulatory authorities for examination and filing. The relevant regulatory authorities shall strictly examine the application materials and filing materials put forward by the tenderee during the examination and filing, and strictly limit other contracting methods other than public bidding. In case of comparison and selection, in principle, the comparison and selection rules of bidding first and then randomly selecting the invitees shall be implemented. After approval, the examination and approval department shall report the approval documents and filing matters (including sub-approval documents) to the Recruitment Supervision Committee.

(2) strengthen supervision in the process and strictly control the supervision of bid opening and evaluation. Bidding, comparison announcement, bidding documents, comparison or other competitive negotiation schemes shall be reported to the project examination and approval department, the administrative department and the recruitment supervision Committee before they are released or sold, and the relevant departments shall carefully review their legality and standardization. In particular, it is necessary to carefully review whether the bidding documents and comparison schemes conform to the relevant provisions of the Opinions of the Sichuan Provincial People's Government on Strictly Regulating the Bidding Work of National Investment Construction Projects (Chuanfufa [2117] No.14); Whether the relevant time limits such as announcement and publicity meet the requirements; Whether there are unreasonable clauses in the bidding documents and schemes that exclude some potential bidders or deliberately set benefits for some potential bidders; Whether the evaluation criteria and methods are specified in the bidding documents and schemes, and whether they are reasonable; Whether the substantive requirements are marked; Whether the main contract terms are standardized and legal, etc. All bidding, comparison, competitive negotiation and other activities of post-disaster reconstruction, except for projects managed by the state and the province, must be conducted in Guangyuan Public Resource Trading Center set up by the Administrative Service Center of the Municipal People's Government, and all the required experts must be drawn from the Sichuan Bid Evaluation Expert Database. Activities such as bid opening, bid evaluation and negotiation must be carried out under the supervision of relevant supervision departments. Supervisors should boldly perform their duties and earnestly strengthen the supervision of the bid evaluation site. The bid evaluation committee shall evaluate the bid independently and be responsible for its own evaluation results. Relevant administrative supervisors shall not leave the bid evaluation site without authorization, and must perform their duties in place and be responsible for their duties. Supervisory organs should strengthen supervision over the relevant state organs, state civil servants and other personnel appointed by state administrative organs who participate in the on-site supervision of bid evaluation, urge them to perform their duties conscientiously, give full play to their roles, and investigate the responsibilities of relevant departments and personnel according to law and discipline if they do not perform their duties conscientiously and cause adverse consequences.

(3) Pay attention to post-event supervision and strictly control contract performance. All relevant administrative supervision departments should strictly follow the relevant laws, regulations and capital construction procedures, strengthen the supervision of the contract performance stage, and earnestly implement five systems: First, implement the construction system of project manager, project director and main technical person in charge. The project owner can sign the contract only after the winning bidder provides the original qualification certificate of the above-mentioned personnel promised in the bidding documents, and can return it only after the main project of the contract is completed. Second, subcontracting and illegal subcontracting are strictly prohibited. Without the approval of the administrative department, the project owner shall not agree that the winning bidder changes the project manager, project director and main technical person in charge. If the winning bidder's project manager, project director and main technical director stationed at the construction site are inconsistent with the commitments in the bidding documents, it shall be regarded as subcontracting. The third is to standardize the design change work. Strictly implement the relevant provisions of design change management, and fulfill the approval procedures. Major design changes that break through the scope of the original project feasibility study must be reported to the original project examination and approval department for examination and approval. The fourth is to strictly increase the management of engineering quantity. The increase of engineering quantity must be handled by the procedure of declaration by the construction unit, signature by the supervisor, approval by the owner, and evaluation by the budget approval department in conjunction with the administrative department. The increased quantities and price shall be publicized in the construction project trading place where the project is implemented. Fifth, the quality management of post-disaster reconstruction projects should strictly implement the relevant state regulations and implement the lifelong responsibility system for project quality. The person in charge of the administrative leadership of the project quality, the legal representative of the project, the legal representatives of the survey, design, construction and supervision units and the suppliers of equipment and materials shall be responsible for the project quality for life according to their respective responsibilities.

Third, strict discipline, severely investigate and deal with violations

All levels and departments should strictly grasp the scope and standards of emergency projects in accordance with the requirements of documents such as SJFFA [2118] No.21, and strictly guard against any evasion of bidding in the name of emergency projects. The relevant project examination and approval departments and administrative departments should strengthen supervision and investigation, seriously investigate and deal with unauthorized contracting without the examination and filing of relevant departments, seriously investigate and deal with the acts of contracting projects under the guise of the qualifications and qualifications of foreign aid provinces and cities, and seriously investigate and deal with all kinds of subcontracting, subcontracting, inflated engineering quantities and other violations. For enterprises and individuals who violate laws and regulations in post-disaster reconstruction projects, the relevant administrative departments should investigate and deal with them according to law. Within three to five years, the owners of state-invested construction projects in the city shall not accept their bids and participate in comparison and selection, nor shall they be determined as contractors of emergency projects; Strengthen the supervision of bidding agencies, and seriously investigate and deal with problems such as "intermediary miss, illegal operation". Supervisory organs at all levels should seriously investigate and deal with the illegal intervention and intervention of leading cadres in bidding work, strengthen supervision of various administrative departments, and seriously investigate and deal with some violations of discipline and law, such as ineffective supervision, ineffective investigation, or illegal operation by taking advantage of their positions and functions; Those involved in crimes shall be handed over to judicial organs for handling.
