This method is divided into 6 chapters ***46 articles, including general provisions, application for hygiene license, examination of issuance of hygiene license, management, supervision and inspection of hygiene license, supplementary provisions, etc. The Measures clearly stipulate that if a food producer or operator is sentenced to revoke his hygiene license for violating food hygiene laws and regulations, his legal representative or principal responsible person shall not apply for a hygiene license within three years, and the health administrative department will not accept it, further emphasizing and clarifying the seriousness of the examination of hygiene licenses, and urging food producers and operators to establish a sense of integrity.
In addition, specific provisions have been made in the following aspects:
First, all units and individuals engaged in food production and business activities shall declare to the administrative department of health and go through the formalities for applying for health licenses according to regulations; Only after examination and approval by the administrative department of health can they engage in food production and marketing activities and bear the responsibility of food hygiene in food production and marketing.
Second, the health administrative department must strictly follow the authority, scope, conditions and procedures stipulated by laws, regulations and rules, and follow the principles of openness, fairness, impartiality and convenience.
Third, from the health management system, personnel health status, training, places, health facilities and other aspects. The measures respectively stipulate the necessary conditions for applying for licenses for different categories such as production, processing, management, catering and canteens, and the contents that the health administrative department should review when implementing the health license.
Fourth, the "Measures" also established a food hygiene licensing supervision and inspection system, including between superior and subordinate health administrative departments and within the health administrative departments at the same level, and accepted social supervision. Any unit or individual has the right to report illegal acts in the process of issuing and managing health licenses, and the health administrative department will promptly verify and handle them. Fifth, the behavior of food entrusted processing is stipulated, especially the stricter hygiene requirements are put forward for the entrusted party, which requires that the hygiene license numbers of both parties must be marked on the products.
