chapter I general provisions article 1 in order to regulate the order of the tourism market, protect the legitimate rights and interests of tourists, tour operators and related employees, improve the level of tourism services, and promote the high-quality development of the tourism industry, these regulations are formulated in accordance with the Tourism Law of the People's Republic of China, the Tourism Regulations of Hebei Province and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the tourism activities within the administrative area of this Municipality, the business activities of providing tourists with services such as sightseeing, entertainment, accommodation, catering, shopping and transportation, and related supervision and management activities.
the qualifications of travel agencies and tour guides, the rights and obligations of tourists, travel service contracts, travel safety and settlement of travel disputes, and other matters not stipulated in these regulations, if there are provisions in the Tourism Law of the People's Republic of China, the Tourism Regulations of Hebei Province and other relevant laws and regulations, those provisions shall prevail. Article 3 The supervision and management of the tourism market shall adhere to the principles of government leading, territorial management, departmental linkage and industry self-discipline, and create a safe, civilized, honest, standardized, open and orderly tourism market environment. Article 4 The people's governments of cities and counties (districts) shall strengthen the organization and leadership of tourism work, work out the tourism development plan of their respective administrative areas, clarify the responsibilities of supervision and management of the tourism market, establish comprehensive supervision and management mechanisms such as comprehensive coordination of tourism, joint investigation and handling of cases, and unified acceptance of complaints, and make overall plans to solve major problems in the tourism market.
the township (town) people's government and sub-district offices should cooperate with the publicity of tourism civilization, order maintenance, safety emergency, dispute handling and other related work. Article 5 The municipal and county (district) tourism authorities shall perform the following duties:
(1) To guide and promote the orderly development of the tourism market, coordinate the comprehensive supervision and management of the tourism market, and organize the implementation of relevant policies, measures and industry standards for the supervision and management of the tourism market;
(2) promoting the construction of the credit system in the tourism market, organizing the training and quality evaluation of tourism market services, accepting and transferring complaints about tourism services, and improving the quality of tourism services;
(3) investigate and deal with illegal acts in the tourism market according to law;
(4) other duties as stipulated by laws and regulations.
the departments in charge of scenic spots and the relevant departments of public security, market supervision, transportation, development and reform, administrative examination and approval, marine fisheries, urban management and law enforcement of cities and counties (districts) shall, according to their respective responsibilities, do a good job in the supervision and management of the tourism market. Article 6 This Municipality promotes the standardization of tourism services. Travel agencies, scenic spots and operators providing entertainment, accommodation, catering, shopping, transportation and other services for tourists shall implement a quality rating system. The scope, standards, procedures and signs of rating are formulated by the Municipal People's Government in accordance with relevant national and provincial regulations and standards.
The facilities or services provided by tour operators shall not be lower than the quality level actually obtained, and shall not be publicized beyond the quality level obtained. Without obtaining the quality grade, the quality grade mark shall not be used for publicity and management. Article 7 The Municipal People's Government shall promote the construction of a public service system for smart tourism, establish a digital information service platform and update it in time, improve the public service capacity of the tourism industry, and provide necessary information and consulting services such as scenic spots, bathing beaches, routes, transportation, meteorology, accommodation, safety, passenger flow early warning, emergency rescue, consumption warning and complaint telephone for free. Article 8 Tourism industry organizations should strengthen industry self-discipline, establish industry integrity self-discipline rules and industry integrity files, play the roles of providing services, reflecting demands and standardizing behaviors, safeguard the legitimate rights and interests of the industry and the order of fair competition, and accept the guidance and supervision of the tourism authorities. Ninth tour operators should operate according to law, be honest and trustworthy, fair competition, civilized service, and consciously fulfill their statutory and agreed obligations to ensure the safety of tourists and maintain the order of the tourism market. Tenth tourists should abide by the norms of civilized tourism behavior, cherish tourism resources, protect the ecological environment, rational consumption, civilized travel.
this municipality has established a record system for uncivilized tourism behavior. if tourists have serious uncivilized tourism behavior, which has caused bad social impact or damaged the national image, the tourism authorities will include it in the record of uncivilized tourism behavior and announce it to the public. Article 11 The people's governments of cities and counties (districts) shall give full play to the functions of tourist service hotlines and tourist complaint reporting network platforms, clarify the institutions that accept tourist complaints, broaden the channels for accepting complaints and reports, publish telephone numbers and websites of complaints and reports in prominent positions in scenic spots, hotels and travel agencies, and encourage all sectors of society to actively provide clues of all kinds of illegal acts.
any unit or individual has the right to make complaints and reports on acts in violation of the provisions of these regulations, and the tourist complaint accepting institution shall promptly investigate and handle them, and feed back the results of the investigation and handling to the complainants and informants within the time limit stipulated by laws and regulations. Chapter II Travel Agencies and Tour Guides Article 12 The names and signs of travel agencies and other tour operators shall comply with the relevant national and provincial regulations, and the names of tourist distribution service centers, ticketing centers and other influential enterprises and social organizations shall not be used without authorization, so that tourists may mistakenly think that they have specific ties with the above-mentioned entities. Thirteenth travel agencies shall not organize tourism activities at unreasonably low prices, disrupting the order of the tourism market.
the tourism authorities should guide and promote the tourism industry associations to formulate the integrity guidance prices of tourism products such as group travel routes in this city, and announce them to the public regularly, so as to strengthen industry self-discipline and provide reference for tourists.
