Measures for the classified management of domestic waste in Putian City

article 1 in order to strengthen the classified management of domestic waste and improve the ecological environment, these measures are formulated in accordance with the law of the people's Republic of China on the prevention and control of environmental pollution by solid waste, the regulations on the management of urban and rural domestic waste in Fujian province and the regulations on the management of urban and rural environmental sanitation in Putian city, and combined with the actual situation of this municipality. Article 2 These Measures shall apply to the production activities such as classified delivery, collection, transportation and disposal of domestic garbage in the urban built-up areas of this Municipality. Township, town and village (residential) can refer to the implementation. The term "domestic waste" as mentioned in these Measures refers to the solid waste generated in daily life or in the activities of providing services for daily life and the solid waste regarded as domestic waste according to laws and regulations. Article 3 The classified management of domestic waste shall follow the principles of governance according to law, unified planning, participation of the whole people, overall planning of urban and rural areas, adaptation to local conditions and reduction of source. Article 4 The municipal and county (district) people's governments shall strengthen the supervision over the classified management of domestic waste, incorporate it into the national economic and social development plan, establish a coordination mechanism, improve the treatment system, and include the classified management of domestic waste in the scope of government target responsibility assessment. The funds required for the classified management of domestic waste shall be included in the fiscal budget at the corresponding level. The people's governments of townships and towns and sub-district offices shall be responsible for the supervision and implementation of the classified delivery, collection, transshipment and disposal of domestic garbage within their respective jurisdictions. The village (neighborhood) committees shall cooperate with the people's governments of townships and towns and street offices to do a good job in the propaganda and guidance of domestic waste classification, and urge the units, village (neighborhood) people and property service enterprises under their jurisdiction to consciously abide by the provisions of these measures. Article 5 The Municipal Urban Management Bureau is the administrative department in charge of the classified management of domestic waste in this Municipality, and is responsible for organizing the implementation of these Measures. Unified development of the city's domestic waste classification guidelines, clear classification, collection, transportation, disposal rules and other production matters, and announced to the public. County, district city appearance and environmental sanitation administrative departments are responsible for the guidance, publicity, training, assessment and supervision of domestic waste classification within their respective jurisdictions, formulate and implement the domestic waste classification management plan, clarify the domestic waste delivery mode, collection time, transportation routes and other matters within their respective jurisdictions, and implement the system of responsible areas and responsible persons. Article 6 The administrative department of natural resources shall be responsible for bringing the sanitation facilities determined in the special environmental sanitation plan into the national spatial planning. The administrative department of commerce shall be responsible for formulating and implementing the development plan and industrial policy of renewable resources recycling industry within its administrative area. The competent administrative department of ecological environment shall be responsible for environmental monitoring and inspection of the operation of domestic waste disposal facilities, and supervise and manage the collection, transportation and disposal of harmful waste. The property administrative department shall be responsible for urging the property service enterprises to carry out the classification of domestic waste, and incorporate the implementation of the environmental sanitation responsibility system into the credit management system of the property service enterprises. The administrative department of education shall incorporate the knowledge of domestic waste source reduction, classified delivery, recycling and harmless treatment into education, teaching and social practice, and cultivate and improve students' consciousness of domestic waste source reduction and classification. Article 7 New construction, renovation and expansion projects shall, in accordance with national and provincial standards and planning conditions, support the construction of facilities for classified collection and transfer of domestic garbage, and design, construct, accept and deliver them synchronously with the main project, and shall not change the nature of use without authorization. Where the construction unit applies for the construction project design plan submitted by the construction project planning permit and supports the construction of domestic waste classified collection and transfer facilities, it shall specify the location, area and use of the domestic waste classified collection and transfer facilities. In urban roads, squares, green spaces and other public plots (domains) or existing residential areas, it is not necessary to go through relevant procedures such as planning, construction and occupation of green spaces to build, modify (expand) facilities such as domestic waste sorting collection houses (kiosks). Article 8 Units or individuals shall classify according to the following requirements: (1) Recyclable materials refer to domestic wastes suitable for recycling and recycling, mainly including waste paper, waste plastics, waste metal, waste glass, waste fabrics, waste furniture, waste electrical and electronic products, etc. (2) harmful waste refers to the domestic hazardous wastes listed in the National List of Hazardous Wastes, which have direct or potential harm to human health and the natural environment, mainly including waste batteries, lamps, waste medicines, thermometers, sphygmomanometers, waste paints, pesticides, disinfectants and their packages; (3) Kitchen waste, also known as "wet waste", refers to perishable household kitchen waste, kitchen waste and other kitchen waste containing organic matter, mainly including discarded ingredients, leftovers, vegetables, fruits, meat and aquatic products; (four) other garbage, also known as "dry garbage", refers to the domestic garbage except recyclables, kitchen waste and harmful waste. Domestic waste generating units or individuals shall put the classified harmful waste, kitchen waste and other garbage into the corresponding identified domestic waste collection containers or specially set delivery points at regular and fixed points; Recyclable materials are put into recyclable materials collection points or sold to renewable resource recycling enterprises. Hazardous waste, medical waste, industrial waste, construction waste and other wastes shall be managed in accordance with relevant laws, regulations and rules, and shall not be mixed with domestic waste. Ninth units or individuals shall abide by the provisions of the classification and reduction of domestic garbage, take the initiative to reduce the production of domestic garbage, and put domestic garbage into classification. The person responsible for the management of classified domestic waste shall, in accordance with the regulations on the management of urban and rural domestic waste in Fujian Province, implement the system of responsible areas and responsible persons. Article 11 Units of classified collection, transportation and disposal of domestic garbage shall collect, transport and dispose of domestic garbage in accordance with the technical specifications for environmental sanitation operations. If the collection, transportation and disposal unit of domestic garbage classification finds that the delivered domestic garbage does not meet the classification standards, it shall require the person in charge of management to correct it immediately; Refuses to correct, have the right to refuse to accept, and report complaints to the local city appearance and environmental sanitation department. Relevant units should dispose of it within 24 hours. Eleventh recyclables, harmful waste, large garbage should be collected regularly according to the time agreed by the collection and transportation enterprise and the person in charge of domestic garbage classification management. Kitchen waste and other garbage should be collected regularly every day and cleared daily. Recyclable materials shall be transported by the unit, individual or the person responsible for the classification management of domestic waste, or the recycling enterprise shall make an appointment to collect and transport them at home; Harmful waste is transported by units that meet the requirements for hazardous waste transportation; Kitchen waste and other garbage are transported by units that meet the requirements for domestic waste transportation. It is forbidden to pile up and sort domestic garbage in public areas such as sidewalks and green parks. Article 12 The classified transport unit of domestic waste shall abide by the following provisions: (1) Transport vehicles shall be transported in a sealed manner, and the types of domestic waste transported shall be marked in a prominent position on the vehicle body; (two) transport the domestic waste to the designated transfer station or disposal site, and it is strictly forbidden to transport the classified domestic waste in a mixed way; (three) according to the classification of domestic waste, collection volume, operation time and other reasonable allocation of transport vehicles, determine the frequency of transport, so that Nissan Nissin; (four) in the process of transportation, domestic garbage shall not be discarded or scattered along the way. After the operation, the vehicles and sites shall be cleaned in time to keep the domestic garbage transport vehicles, transfer facilities and the surrounding environment clean and tidy; (5) Establish a management ledger, record the source, type, quantity and destination of domestic garbage, formulate an emergency plan for classified collection and transportation of domestic garbage, and report it to the local city appearance and environmental sanitation department for the record. Thirteenth newly built large and medium-sized domestic waste transfer stations shall set up separate kitchen waste transfer stations. Temporary storage of garbage in transfer stations should be standardized. Kitchen waste and other garbage shall be stored in a sealed manner for no more than 24 hours. Article 14 Domestic garbage shall be disposed of separately, so as to improve the level of resource utilization and promote recycling: (1) Recyclable materials shall be recycled by renewable resource recycling enterprises or comprehensive resource utilization enterprises; (two) harmful waste city in accordance with the relevant provisions of the state for harmless treatment, which belongs to hazardous waste, shall be disposed of by a qualified hazardous waste disposal unit; (3) The kitchen waste adopts a comprehensive disposal method based on biochemical disposal; (four) other garbage is disposed of harmlessly by means of incineration and power generation. Article 15 Domestic garbage disposal units shall dispose of domestic garbage in categories according to the relevant provisions of the state, provinces and cities, and abide by the following provisions: (1) Receive and dispose of domestic garbage in categories according to the specified time and requirements; (2) Treating sewage, waste gas, waste residue, dust, etc. generated in the process of disposal according to relevant national standards to prevent secondary pollution; (3) Monitoring the environmental impact of water, gas and soil on a regular basis as required, and testing and evaluating the performance and environmental protection indicators of domestic waste treatment facilities; (four) to carry out regular maintenance and maintenance of domestic waste disposal facilities and auxiliary facilities and equipment, and report to the relevant administrative departments before shutdown and overhaul to ensure the safe operation of facilities and equipment; (5) establish a management ledger, record the daily domestic waste transport units, the source, type and quantity of domestic waste, formulate an emergency plan for disposal, and report it to the local city appearance and environmental sanitation administrative department for the record. Article 16 The municipal administrative departments in charge of industry and information, commerce, market supervision, cultural tourism, agriculture, postal services, and office affairs management shall, according to their respective functions and duties, establish a mechanism for reducing the domestic waste at the source covering the fields of production, circulation, consumption, etc., formulate incentive measures, and guide and encourage units and individuals to participate in the classification and reduction of domestic waste. Article 17 Establish a coordination mechanism for the recycling system of renewable resources, which is under the responsibility of the administrative department of commerce, with the participation of relevant administrative departments such as development and reform, natural resources, public security, market supervision, ecological environment, industrial information, postal management, housing and urban and rural construction, and urban management, so as to encourage enterprises to recycle plastics, glass and other low value-added recyclable materials and bulky recyclable materials. Establish an information system for recycling renewable resources, providing information such as recycling types, transaction prices and recycling methods. Producers and sellers are encouraged to recycle their products and packages by means of deposit refund, trade-in, online shopping and delivery. Eighteenth city and county (District) people's government shall commend and reward the units and individuals who have made outstanding achievements in the management of domestic waste classification, and the responsible person for management may be implemented by means of awards instead of subsidies. Relevant units can guide individuals to correctly classify and put domestic garbage through convertible points and other means. Encourage units and individuals to participate in the classification, recycling and harmless treatment of domestic waste through donations, voluntary labor and voluntary service, and promote enterprises and social organizations to carry out domestic waste classification services. If the realty service enterprise increases its expenses due to the performance of the duties of the person in charge of management, it may negotiate with the owner or the owners' committee and specify it in the realty service contract. Nineteenth city, county (District) city appearance and environmental sanitation administrative departments, street offices, Town People's government shall establish and improve the supervision and inspection system of domestic waste classification, and conduct regular supervision and inspection of domestic waste classification. City and county (District) people's governments shall establish and improve the comprehensive assessment system for the classification of domestic waste at the corresponding level, incorporate the management of waste classification into the urban and rural environmental sanitation assessment indicators, and regularly publish the assessment results. Twentieth city and county (District) administrative departments of city appearance and environmental sanitation shall, in accordance with the division of responsibilities, establish credit files of service units for classified collection, transportation and disposal of domestic garbage. Incorporate the information such as the service unit's violations and treatment results into the credit file and the credit evaluation system of environmental sanitation service units, conduct annual evaluation on the service quality and credit rating of service units, and publish the evaluation results. Twenty-first city appearance and environmental sanitation administrative departments shall announce the telephone number of reports and complaints to the public, and set up a mailbox for reports and complaints. Units and individuals found in violation of these measures, have the right to report complaints to the administrative department of city appearance and environmental sanitation. The administrative department of city appearance and environmental sanitation shall promptly investigate and deal with it according to law, and inform the informant or complainant of the investigation and handling results. Article 22 Units or individuals that violate the provisions of these measures shall be punished according to law by the county (district) competent department of city appearance and environmental sanitation under any of the following circumstances. Where there are other provisions in laws and regulations, those provisions shall prevail. (a) units and individuals in violation of the provisions of article eighth of these measures, shall be ordered to stop the illegal act, and make corrections within a time limit; If no correction is made within the time limit, the unit shall be fined not less than 5,111 yuan but not more than 51,111 yuan, and the individual shall be fined not more than 211 yuan; (two) the person in charge of the classification management of domestic waste fails to fulfill the obligations of the person in charge of the responsible area in the first paragraph of Article 9 of these Measures, and shall be ordered to make corrections within a time limit; If no correction is made within the time limit, the unit shall be fined not less than 1,111 yuan but not more than 5,111 yuan, and the individual shall be fined not more than 211 yuan; (three) domestic garbage collection and transportation units in violation of the provisions of the first paragraph of article tenth of these measures, shall be ordered to make corrections within a time limit, and be fined ten thousand yuan to thirty thousand yuan. Transportation and disposal of harmful waste in violation of the relevant state regulations on hazardous waste management shall be punished by the administrative departments of ecological environment, transportation and other departments according to law. Article 23 If, in violation of the provisions of these measures, the staff of the administrative department fails to perform the duties of supervision and management or neglects his duty, abuses his power or engages in malpractices for selfish ends in the classified management of domestic garbage, the directly responsible person in charge and other responsible persons shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 24 Whoever obstructs the staff of the city appearance and environmental sanitation administrative department and relevant administrative departments from performing their official duties according to law, or insults or beats environmental sanitation workers, encloses domestic garbage collection and disposal facilities and transport vehicles, obstructs the construction and normal operation of domestic garbage treatment facilities, and violates public security management, shall be given administrative penalties for public security according to law; If the case constitutes a crime, it shall be transferred to judicial organs for criminal responsibility according to law. Twenty-fifth Meizhou Island Management Committee and Meizhou Bay North Shore Management Committee shall implement classified management of domestic waste according to these measures. Article 26 These Measures shall come into force as of March 1, 2122.
