Article 12 of the Measures for the Administration of the Registration of Individual Business Names
Individual businesses applying for name registration, the scope of business involves registration of prior authorization, shall apply for pre-approval of the name. The applicant shall submit the name approved by the registration authority to the relevant departments for pre-approval procedures.
Business scope does not involve prior authorization, you can apply for pre-approval of the name, you can also apply for registration with the establishment of individual business or change.
The registration authority for name pre-approval, shall not charge a fee.
Article 13
To apply for pre-approval of the name of an individual industrial or commercial enterprise, the following materials shall be submitted by the applicant or the agent entrusted by the applicant to the registration authority at the place where the business premises are located:
(1) application for pre-approval of the name of an individual industrial or commercial enterprise;
(2) proof of the identity of the proprietor;
(3) if the proprietor entrusts an agent to do the work, the agent shall also submit a letter of entrustment. If the operator entrusts an agent to handle the application, he shall also submit a power of attorney and proof of identity of the agent.
Article 14
After accepting the application for pre-approval of the name of an individual industrial or commercial enterprise, the registration authority shall make a decision on the spot to approve the registration or reject the application. Approved for registration, shall be issued to the "individual business name pre-approval notice"; rejected the application, shall be issued to the "individual business name dismissal notice", and on the spot to the applicant to explain the reasons for dismissal.
Delegated to handle the name of individual business registration of industrial and commercial administration, according to law can not make a decision on the spot, shall be approved or rejected within five days of the decision.
Article 15
The pre-approved name of an individual industrial and commercial enterprise shall be retained for a period of six months. If the applicant fails to register for the establishment or change of an individual industrial or commercial enterprise upon expiration of the retention period, the pre-approved name shall automatically become invalid. The applicant may apply in writing to the registration authority for an extension within one month before the expiration date of the retention period, and the retention period may be extended for six months with the approval of the registration authority.
Pre-approved names of individual industrial and commercial households shall not be transferred or used for business activities during the retention period.
