The acceptance of environmental protection for the completion of construction projects is an important part of the "three simultaneities" system of environmental protection for construction projects and an "export" of environmental protection for construction projects. Refers to the acceptance of the implementation of environmental protection facilities and environmental protection measures supporting the main project after the completion of the construction project according to the environmental impact report (form) and its approval documents, daily supervision and management records and environmental supervision report during the construction period.
Self-acceptance of environmental protection enterprises after the completion of construction projects is an important measure to implement decentralization, combination of decentralization and management, optimize service demand, transform government functions and strengthen government supervision in the State Council. It is conducive to giving full play to the main responsibility of enterprise environmental protection, improving the level of enterprise environmental management and promoting the implementation of the "three simultaneities" system of environmental protection for construction projects; By strengthening process supervision, it is the key to ensure that all environmental protection facilities and measures proposed in the environmental impact report (table) and its approval documents are implemented, and environmental pollution and ecological damage are effectively controlled.
Second, the overall requirements
(A) the guiding ideology
Implement the important deployment of decentralization, combination of decentralization and management, and optimization of services in the State Council, urge enterprises to assume the main responsibility of "three simultaneities" in environmental protection, strengthen the supervision of environmental protection departments after the event, and maintain the effectiveness of environmental impact assessment.
(2) Basic principles
1. The main responsibility is clear. As the main body of environmental responsibility of construction projects, enterprises undertake the related work of environmental protection of construction projects, and are responsible for implementing the "three simultaneities" system of environmental protection of construction projects to reduce the impact of construction projects on environmental factors and their ecosystems.
2. Acceptance procedure specification. The environmental protection acceptance upon completion shall be managed by the enterprise as a legal person. The enterprise's self-acceptance shall be carried out in strict accordance with the prescribed procedures formulated by the competent department of environmental protection. The acceptance process is complete and the acceptance procedure is legal.
3. The acceptance criteria are clear. Enterprises should strictly implement the requirements of environmental impact report (form) and its approval documents for their own acceptance. The acceptance materials are complete, the acceptance contents are comprehensive, the standards and specifications are applicable, the contents are not lacking, and the standards are not lowered.
4. Strengthen supervision and management. The competent departments of environmental protection at all levels strengthen the supervision after the event, and use the "double random" spot check mechanism to strengthen the supervision and inspection of the implementation of environmental protection during the construction stage, completion stage and after the completion of the construction project, covering the whole process.
Three, standardize the management of environmental protection enterprises to accept the completion and acceptance of construction projects.
(three) after the completion of the main project of the construction project, the supporting environmental protection facilities must be put into production or operation at the same time as the main project. If trial production or trial operation is needed, the supporting environmental protection facilities must be put into trial production or trial operation at the same time as the main project.
(four) after the completion of the main project of the construction project, before it is officially put into production or operation, the enterprise shall organize the environmental protection acceptance of the completion of the construction project by itself, and prepare the investigation (monitoring) report on the environmental protection acceptance of the completion of the construction project.
Among them, construction projects (ecological impact projects) such as agriculture, forestry, water conservancy, transportation, mining and social fields. If it mainly has an impact on the ecological environment, an acceptance investigation report shall be prepared. If the construction projects (industrial pollution projects) such as thermal power, chemical industry, petrochemical industry, steel and metallurgy mainly cause pollution and harm to the environment due to the discharge of pollutants, an acceptance monitoring report shall be prepared.
(five) the scope of self-acceptance of environmental protection enterprises after the completion of construction projects:
1. Various environmental protection facilities related to the construction project specified in the environmental impact report (table) and its approval documents, including projects, equipment, devices and monitoring means built or equipped for pollution prevention and environmental protection, as well as various ecological protection facilities.
2 environmental impact report (table) and its approval documents and other environmental protection measures that should be taken in accordance with the relevant project design documents.
3. The operation effect of various environmental protection facilities and environmental protection measures related to the construction project.
(6) Basis for self-acceptance of environmental protection enterprises after the completion of construction projects:
1. Regulations on Environmental Protection Management of Construction Projects and other relevant laws and regulations.
2 environmental impact assessment report (table) and its approval documents.
3. Chapter on environmental protection in the preliminary design of the project.
4. Relevant standards such as technical specifications for environmental protection after the completion of construction projects.
5. Other relevant documents issued by the competent department of environmental protection.
(seven) the working procedures for self-acceptance of environmental protection enterprises after the completion of construction projects:
1. After the construction project is completed and before it is put into production or operation, the enterprise shall check the implementation of environmental protection facilities supporting the main project in accordance with the requirements of the environmental impact report (form) and its approval documents.
2. Enterprises shall, according to the technical specifications for acceptance of completed environmental protection formulated by the competent department of environmental protection, compile or entrust institutions with corresponding technical capabilities to investigate the implementation of environmental protection facilities of construction projects, carry out relevant environmental monitoring, and compile the investigation (monitoring) report for acceptance of completed environmental protection. Enterprises, acceptance investigation (monitoring) institutions and their relevant personnel shall be responsible for the conclusion of the acceptance investigation (monitoring) report for life.
3. After the preparation of the acceptance investigation (monitoring) report, the enterprise as a legal person shall organize the acceptance of the environmental protection facilities and measures of the construction project, form a written report for future reference, and announce it to the public.
4. When an enterprise organizes its own environmental protection acceptance for completion, it shall set up an acceptance team to conduct data review and on-site reconnaissance on the environmental protection facilities and other environmental protection measures of the construction project, and form an acceptance opinion. The list of members of the acceptance team is attached. The acceptance opinions shall be agreed by more than 2/3 members of the acceptance group.
The acceptance team consists of project legal person, design unit, construction unit, environmental supervision unit, environmental monitoring unit, environmental impact report (table) preparation unit, change environmental impact report (table) preparation unit, representatives of acceptance investigation (monitoring) report preparation unit and not less than 5 industry experts.
5. Enterprises should rectify the environmental protection issues raised in the acceptance opinions. Environmental protection facilities without acceptance or unqualified acceptance, the main project of the construction project shall not be put into production or use.
6. The enterprise shall, within 30 working days from the date of acceptance, make an acceptance opinion on environmental protection after completion, and upload the acceptance opinion, acceptance investigation (monitoring) report and "three simultaneities" acceptance registration form to the information platform for self-acceptance of environmental protection enterprises after completion of construction projects, and make it public truthfully.
(eight) in line with the following environmental protection acceptance conditions, environmental protection facilities can pass the acceptance:
1. The environmental protection examination and approval procedures in the early stage of construction are complete, and the technical data and environmental protection files are complete;
2. Environmental protection facilities and other measures have been completed or implemented according to the requirements of the approved environmental impact report (table) and design documents, and the environmental protection facilities have passed the acceptance and filing, and their pollution prevention and control capabilities can meet the needs of the main project;
3. Have the conditions for the normal operation of environmental protection facilities;
4. The pollutant discharge meets the requirements of the standards stipulated in the environmental impact report (table) and design documents and the approved pollutant total discharge control indicators;
5. Implement various ecological protection measures according to the requirements specified in the environmental impact report (table), and the recoverable environment destroyed during the construction of the construction project has been restored according to regulations;
6. The environmental impact report (table) proposes to verify the environmental impact of sensitive points of environmental protection, assess cleaner production indicators and supervise the implementation of environmental protection measures during construction, which has been completed as required;
7. If the environmental impact report (table) requires the construction unit to take measures to reduce the pollutant discharge of other facilities, or requires the local government or relevant departments where the construction project is located to take "regional reduction" measures to meet the requirements of total pollutant discharge control, corresponding measures shall be implemented.
(nine) in any of the following circumstances, the environmental protection facilities shall not pass the acceptance:
1. Major changes occur without approval;
2. Failing to implement pollution prevention and control measures, ecological protection measures and environmental risk prevention and control measures according to the approved environmental impact report (table) and its examination and approval opinions;
3 major ecological damage caused in the construction process has not been repaired, or there are major environmental safety hazards that have not been rectified and eliminated.
4. There are others who do not meet the requirements of environmental protection laws and administrative regulations and have not yet accepted the punishment.
(ten) the environmental impact report (table) and its approval documents put forward the construction projects put into production or use by stages, and the corresponding environmental protection facilities shall be accepted by stages.
In case of major changes in the construction project, the environmental impact assessment document shall be re-submitted for approval before the content of the project changes; Do not belong to major changes, into the completion of environmental acceptance management.
(eleven) after the construction project is put into production or use, the enterprise shall monitor the operation of environmental protection facilities of the construction project and make the operation of environmental protection facilities public.
If the operation of the environmental protection facilities of the construction project is inconsistent with the environmental impact report (table), the enterprise shall organize the post-evaluation of the environmental impact in accordance with the requirements of the Administrative Measures for Post-evaluation of the Environmental Impact of Construction Projects (Trial), and the post-evaluation report shall be made public and subject to the supervision and management of the competent department of environmental protection.
Four, strengthen the environmental protection enterprise self acceptance information disclosure and supervision and management.
(twelve) enterprises shall, through websites, newspapers and media platforms, timely announce the implementation of environmental protection facilities and measures for construction projects and accept social supervision.
During the construction of 1., the following information should be disclosed voluntarily: the implementation of major environmental protection facilities; Implementation of environmental protection measures during the construction period; Environmental monitoring and monitoring results during construction.
2. Before putting into production or use, the following information should be disclosed voluntarily: the implementation of various environmental protection facilities; The implementation of environmental protection measures; Environmental monitoring and supervision report; Emergency plan and filing of environmental emergencies; Investigation (monitoring) report on environmental protection acceptance of completion; Opinions on self-acceptance of completed environmental protection enterprises.
3. During the operation period, the following information should be disclosed regularly: the operation of various environmental protection facilities; The discharge of major pollutants; Improvement of emergency drills and emergency plans for sudden environmental incidents; Development of environmental impact post-assessment.
(13) The competent department of environmental protection should strengthen the post-event supervision of construction projects, implement the "double random" spot check mechanism, incorporate the supervision of the implementation of "three simultaneities" of environmental protection of construction projects into the daily supervision plan, urge enterprises to implement the responsibility of information disclosure, unblock social supervision channels, strengthen supervision and restraint on construction units, and protect the public's right to know environmental protection information of construction projects.
(fourteen) the competent department of environmental protection should strengthen the supervision and inspection of the results of self-inspection and acceptance of enterprises. By means of spot check, through comparative monitoring and on-site verification, the effect of self-acceptance of enterprises is regularly evaluated, the problems arising from self-acceptance of enterprises are solved in time, and the supervision of the whole process of construction projects is strengthened.
(15) If the environmental protection facilities that need supporting construction are not completed, fail to pass the acceptance or fail to pass the acceptance, the construction project is put into production or use, or the acceptance of environmental protection facilities is fraudulent, or the acceptance of environmental protection facilities is not disclosed to the public according to law, the competent department of environmental protection shall investigate and deal with them according to the Regulations on Environmental Protection Management of Construction Projects and other relevant provisions, and hand over the relevant responsible persons to the relevant departments to investigate the relevant responsibilities according to law.

In order to implement the newly revised Regulations on the Management of Environmental Protection of Construction Projects and standardize the environmental protection acceptance of construction projects with pollution impact, our department has drafted the Technical Guide for Environmental Protection Acceptance of Construction Projects with Pollution Impact (draft for comments) (hereinafter referred to as the Technical Guide, see annex).
