The term "construction waste" as mentioned in these Regulations refers to the dregs, wastes and other wastes generated by units and individuals in the process of building, rebuilding, expanding and dismantling various buildings, structures and pipe networks, as well as the repair and decoration of houses, roads, bridges, greening and water conservancy projects.
If the construction waste specified in the preceding paragraph belongs to hazardous waste, it shall be disposed of in accordance with relevant laws and regulations. Article 3 The disposal of construction waste shall follow the principles of reduction, recycling and harmlessness.
Units and individuals that produce construction waste shall bear the responsibility for disposal.
Encourage the development of new building methods, promote prefabricated buildings, and increase the proportion of fully renovated new houses. Article 4 This Municipality implements the source classification of construction waste.
The Municipal People's Government shall formulate construction waste classification standards, classification schemes and collection and transportation system specifications, and the district and county (city) people's governments shall be responsible for organizing the implementation, so as to improve the level of resource utilization and harmless disposal. Article 5 The municipal, district and county (city) people's governments shall incorporate the comprehensive utilization project of construction waste into the development plan of circular economy and high-tech industries, and give support in science and technology, finance, taxation, finance and land use in accordance with relevant laws and regulations.
Encourage the priority development of comprehensive utilization products of construction waste.
Construction projects that use government funds should give priority to the use of construction waste comprehensive utilization products that meet national standards on the premise of meeting the use functions. Article 6 The management of construction waste shall be based on the principle of territorial and district management.
City, district and county (city) people's governments shall establish a coordination mechanism to study and deal with major problems in construction waste management, and arrange special funds for construction waste disposal, supervision and other activities in the financial budget.
Urban management department is the administrative department in charge of urban construction waste management in this Municipality. Chapter II Discharge of Construction Waste Article 7 Construction units, construction units and individuals are encouraged to adopt new technologies, new processes, new materials and new equipment to reduce the amount and discharge of construction waste.
If construction waste can be directly used, it should be directly used; If it cannot be directly utilized, it shall be comprehensively utilized or disposed of harmlessly by producers, operators or other subjects with corresponding conditions.
Encourage recycling enterprises to use mobile devices to dispose of construction waste on site. Eighth construction units should bear the cost of construction waste disposal.
The construction unit of a construction project shall specify the specific requirements of the construction unit for the discharge and classified management of construction waste on the construction site in the bidding documents and contracts.
The construction unit of the demolition project shall contract the demolition project to the construction unit with corresponding qualification grade, and urge the construction unit to implement the responsibility of construction waste disposal in accordance with the provisions of the preceding paragraph. Article 9 The construction unit or the transportation unit shall choose the transit deployment site, resource utilization site, fixed landfill site announced by the urban management department or the receiving site confirmed by the urban management department of the receiving place to dispose of the construction waste, and sign a consumption contract. Article 10 The construction unit shall select the transportation unit recognized by the urban management department, sign a construction waste transportation contract, and specify the transportation volume, transportation responsibility, transportation cost, disposal site or place of construction waste. Construction waste shall not be handed over to individuals or unauthorized transport units for transportation. Eleventh the construction unit shall, twenty days before the start of the construction project and demolition project, apply to the district, county (city) urban management department where the project is located for the Construction Waste Disposal (Discharge) Permit with the following materials:
(a) the "construction project planning permit" or the demolition project filing documents;
(2) A classified disposal plan for construction waste, indicating the place, type, quantity, transportation unit and disposal plan of construction waste;
(3) Transport contracts and consumption contracts;
(4) Responsibility for city appearance and environmental sanitation.
The construction unit shall discharge construction waste within the scope specified in the construction waste disposal (discharge) permit. Twelfth construction units should be equipped with construction waste discharge management personnel at the construction site, and strengthen the management of the construction site in accordance with the following provisions:
(a) according to the classification scheme to collect and pile up construction waste;
(two) timely backfill engineering muck, removal of construction waste, can not be timely backfill or removal, the implementation of dust, seepage, landslide and other measures;
(three) the implementation of mud separation, standardize the discharge of engineering mud, conditional should be dried;
(4) The roads at the entrance and exit of the construction site are hardened and equipped with vehicle washing equipment to ensure that the transport vehicles leave the site cleanly. Thirteenth demolition project construction units should be equipped with construction waste discharge management personnel at the construction site, and strengthen the management of the construction site in accordance with the following provisions:
(a) according to the classification scheme to collect and pile up construction waste;
(two) the implementation of recycling measures for construction waste that can be recycled;
(three) timely removal of all kinds of garbage, can not be removed in time, take dust, seepage, landslide and other measures;
(four) within thirty days after the completion of the demolition project, the construction waste will be transported away.
After the completion of the relocation project and the garbage removal, the neighborhood offices and the Town People's Government where the project is located shall be responsible for the follow-up environmental sanitation management after the acceptance of the urban management department.
Demolition of buildings and structures of chemical, metal smelting, pesticide, electroplating and dangerous chemicals production, storage and use enterprises shall be subject to environmental risk assessment and special acceptance by the environmental protection department.
