Article 3 The market supervision and management departments of the people's governments at or above the county level shall supervise and inspect price activities according to law and impose administrative penalties on price violations.

Article 4 When imposing administrative punishment on price violations, the provisions of administrative punishment procedures shall be observed, so that the facts are clear, the evidence is conclusive, the nature is accurate and the procedure is legal.

Article 5 an operator who violates the provisions on clearly marked prices and commits any of the following acts shall be ordered to make corrections, his illegal income shall be confiscated and he may be fined not more than 5,111 yuan:
(1) the price is not marked;
(2) the price is not clearly marked according to the prescribed contents and methods;
(3) Failing to show the license for charging;
(4) failing to publicize the items, standards, basis and price reporting telephone number of commodity prices or service charges in the business premises or public places as required;
(5) selling goods at a higher price than the marked price or charging unspecified fees;
(6) unable to provide price reduction records or relevant approved price information;
(7) printing price tags or price lists without authorization;
(8) using the contents and methods of pricing without producer supervision;
(9) other acts in violation of the provisions on clearly marked prices. Article 6 A business operator who commits one of the following price frauds shall be ordered to make corrections, his illegal income shall be confiscated, and he may also be fined less than 5 times of his illegal income; If there is no illegal income, a warning shall be given and a fine of less than 51 thousand yuan may be imposed; If the circumstances are serious, it shall be ordered to suspend business for rectification:
(1) using deceptive or misleading language, words, pictures, audio and video, units of measurement and other means to price;
(2) The marked market lowest price, ex-factory price, wholesale price, special price, best price and other prices are unfounded or incomparable;
(3) using price tags or price lists with different prices at the same trading place for the same commodity or service;
(4) raising commodity prices in disguised form or charging extra fees. Article 7 An operator who commits one of the following price frauds shall be ordered to make corrections, his illegal income shall be confiscated, and he may also be fined less than 5 times of his illegal income; If there is no illegal income, it shall be given a warning and may be fined up to RMB 1,111,111; If the circumstances are serious, it shall be ordered to suspend business for rectification:
(1) selling the marked discounted goods or services at a reduced price is inconsistent with the actual situation;
(2) Fictitious original price, fictitious reasons for price reduction, false preferential discounts, false claims of price reduction or price increase, etc.;
(3) When selling goods or providing services by means of extra-price gifts, the name, specification, grade, quantity, service items and service contents of the donated goods are not truthfully marked;
(4) charging fees without service facts;
(5) falsely claiming that the prices of commodities and services subject to market-regulated prices are government-guided prices or government-set prices. Article 8 Where an operator, in violation of Article 14 of the Price Law of the People's Republic of China, sells or purchases goods or provides services by means of raising or lowering the grade, and raises or lowers the price in disguise, he shall be ordered to make corrections, his illegal income shall be confiscated, and he may also be fined not more than five times the illegal income; If there is no illegal income, a warning shall be given and a fine of not less than 1,111 yuan but not more than 1,111 yuan may be imposed; If the circumstances are serious, it shall be ordered to suspend business for rectification or revoke its business license. Article 9 An operator who fails to implement government-guided or government-set prices and commits any of the following acts shall be ordered to make corrections, his illegal income shall be confiscated, and he may be fined not more than five times his illegal income; If there is no illegal income, a fine of not less than 21,111 yuan but not more than 1,111 yuan may be imposed; If the circumstances are serious, it shall be ordered to suspend business for rectification:
(1) Compulsory or disguised compulsory service and charging;
(2) charging fees in disguised form in the form of deposit or mortgage in violation of regulations;
(3) charging fees for not providing services in accordance with regulations;
(4) Failing to apply for a toll license according to the regulations or charging the toll license without annual verification. Article 11 An operator who fails to implement government-guided or government-set prices and commits any of the following acts shall be ordered to make corrections, his illegal income shall be confiscated, and he may be fined not more than 5 times his illegal income; If there is no illegal income, a fine of more than 21,111 yuan and less than 211,111 yuan may be imposed; If the circumstances are serious, it shall be ordered to suspend business for rectification:
(1) setting prices beyond the fluctuation range of government-guided prices;
(2) It is higher or lower than the price set by the government;
(3) setting commodity prices within the scope of government guidance and government pricing without authorization;
(4) setting up service charging items that fall within the scope of government guidance or government pricing without authorization, charging fees not indicated in the charging license or raising the charging standards;
(5) implementing government-guided prices and government-set prices in advance or later;
(6) independent charging items or self-determined standard fees;
(7) raising the charging standard in disguised form by breaking down the charging items, repeating the charging and expanding the charging scope;
(8) Failing to fill in the bill of charges as required, extending the charging time limit and increasing the charging frequency;
(9) continuing to charge fees for the fees explicitly cancelled by the government;
(11) altering, forging, buying or selling the approval documents of government prices and fees;
(11) other acts of not implementing government-guided prices and government-set prices.
