The term "water conservancy project" as mentioned in these Regulations refers to various projects for the development, utilization, control, allocation and protection of surface water and groundwater, including dikes, reservoirs, dams, waterlogging ponds, channels, wells, irrigation stations, hydropower stations, village water supply, sewage treatment plants, hydrological observation and other projects and their ancillary facilities. Article 3 The people's governments at or above the county level shall incorporate the funds for water conservancy project management and protection undertaken by the finance into the fiscal budget at the same level. The water administrative department of the fourth provincial people's government is responsible for the supervision, management and protection of water conservancy projects in the province.
State (city), county people's government and the water administrative department of Haidong District Administrative Office are responsible for the supervision, management and protection of water conservancy projects within their respective administrative areas.
The water conservancy project management institution under the water administrative department of the people's government at or above the county level (hereinafter referred to as the water conservancy project management institution) is specifically responsible for the management, operation and maintenance of water conservancy projects. Article 5 The departments of land and resources, agriculture and animal husbandry, forestry, environmental protection, construction, transportation and public security of the people's governments at or above the county level shall be responsible for the management and protection of water conservancy projects in accordance with the division of responsibilities. Article 6 Water conservancy projects owned by state-owned enterprises and non-state-owned water conservancy projects shall be managed and protected by the owners or users of water conservancy projects, and shall be subject to the supervision and guidance of the water administrative department of the people's government at or above the county level.
Encourage individuals, collectives or other organizations inside and outside the province to manage and operate water conservancy projects through leasing and contracting, and their legitimate rights and interests are protected by law. Seventh any unit or individual has the right to stop, report and accuse the acts of embezzlement and damage to water conservancy projects.
Units and individuals that have made outstanding contributions to the management and protection of water conservancy projects shall be commended or rewarded by the water administrative department of the people's government at or above the county level. Chapter II Project Management Article 8 The management of water conservancy projects follows the principle of combining unified management with hierarchical management.
Provincial water conservancy projects are managed by the water administrative department of the provincial people's government.
Water conservancy projects benefiting from the same administrative area shall be managed by the water administrative department of the people's government of the beneficiary area; Water conservancy projects across administrative regions shall be managed by the water administrative department of the people's government at the next higher level, or by the water administrative department of the people's government authorized by it as the main beneficiary.
The final canal system of small-scale water conservancy projects or irrigation projects in an administrative village shall be managed by the village (animal husbandry) committees or water cooperation organizations. Article 9 After the water conservancy project is completed and accepted, when the construction unit formally hands over to the water conservancy project management organization, it must also hand over the corresponding management facilities, project construction files and documents delineating the scope of protection of water conservancy project management. The basic duties of the tenth water conservancy project management institutions are:
(a) to protect, repair and conserve water conservancy projects according to law to ensure the safety and normal operation of the projects;
(two) the implementation of the project operation plan and flood control and drought relief, water resources dispatching orders;
(three) to carry out engineering inspection and observation, and to establish and improve engineering technical files;
(four) environmental protection and greening work within the scope of project management;
(five) strict water management, ensure safe water supply, improve water efficiency, reduce the cost of water supply, and collect water charges according to regulations;
(six) to take timely measures to deal with engineering safety hazards, and report to the competent department;
(seven) other duties as prescribed by laws and regulations. Eleventh water administrative departments and water conservancy project management institutions shall establish and improve the emergency management mechanism, formulate emergency plans, and timely prevent and deal with emergencies in water conservancy projects. Twelfth state-owned water conservancy projects are divided into three categories: public welfare, quasi-public welfare and operation.
The funds for the management, operation and maintenance of public welfare water conservancy projects shall be borne by the finance at the same level according to the affiliation of water conservancy projects.
The funds required for quasi-public welfare water conservancy projects to play public welfare functions shall be implemented in accordance with the provisions of the preceding paragraph; The funds required for business functions shall be borne by the operators themselves.
The funds for the management, operation, maintenance and conservation of operational water conservancy projects shall be borne by the operators themselves. Thirteenth water conservancy project ownership can be transferred according to law or the implementation of joint-stock reform, management rights can be leased or contracted according to law. Those who have obtained the ownership or management right of water conservancy projects according to law shall not change the main functions of the original design of water conservancy projects without authorization. If it is really necessary to change, it shall be reported to the water administrative department of the people's government at or above the county level for approval and reported to the water administrative department of the people's government at the next higher level for the record. Article 14 If a water conservancy project loses some functions and basic functions or seriously affects the ecological environment, and it is really necessary to be degraded or scrapped, the water administrative department of the people's government at or above the county level shall organize safety appraisal and technical demonstration in accordance with the relevant provisions of the state, and examine and approve it in accordance with the examination and approval authority.
Water conservancy projects that are approved to be scrapped and have potential safety hazards or seriously affect the ecological environment shall be dismantled and cleaned within a time limit by the water administrative department of the people's government at or above the county level.
The design service life of the water conservancy project has been reached, but the basic functions of the project have not been lost, which meets the requirements of safe operation. With the approval of the original examination and approval department, the service life of the project can be extended.
