Chapter X Bylaws Chapter I General Provisions Article 1 In order to ensure food safety and protect public health and safety of life. safeguard public health and safety of life, the enactment of this Law. Article 2 The following activities within the territory of the People's Republic of China shall comply with this Law:

The quality and safety management of primary products originating from agriculture (hereinafter referred to as edible agricultural products) for consumption shall comply with the provisions of the Law on Quality and Safety of Agricultural Products. However, the development of quality and safety standards for food and agricultural products, the publication of information on the safety of food and agricultural products, shall comply with the relevant provisions of this Law. Article 3 Food producers and operators shall engage in production and operation activities in accordance with laws, regulations and food safety standards, be responsible to society and the public, ensure food safety, accept social supervision and assume social responsibility. Article 4 The State Council establishes a food safety committee, whose duties are prescribed by the State Council.

The State Council quality supervision, industry and commerce administration and the State Food and Drug Administration in accordance with the provisions of this Law and the State Council's responsibilities, respectively, for food production, food distribution, food service activities to implement supervision and management. Article 5 The local people's governments at or above the county level are uniformly responsible for, leading, organizing and coordinating the supervision and management of food safety in their administrative regions, and establish and improve the working mechanism for the supervision and management of the whole process of food safety; unify the leadership and command of food safety emergencies; improve and implement the responsibility system for the supervision and management of food safety and the supervision and management of the food safety departments for evaluation and assessment.
Local people's governments at or above the county level, in accordance with the provisions of this Law and the State Council to determine the level of health administration, agricultural administration, quality supervision, industry and commerce administration, food and drug supervision and management departments of food safety supervision and management responsibilities. The relevant departments are responsible for the supervision and management of food safety in their respective areas of responsibility.

Article VI above the county level health administration, agricultural administration, quality supervision, industry and commerce administration, food and drug supervision and management departments should strengthen communication, close cooperation, in accordance with their respective division of labor, the exercise of authority and responsibility according to law. Article VII of the food industry associations should strengthen industry self-discipline, guide food manufacturers and operators in accordance with the law, to promote the integrity of the industry, publicity, popularization of food safety knowledge. Article VIII of the State encourages social groups, grass-roots mass self-government organizations to carry out food safety laws and regulations, as well as the popularization of food safety standards and knowledge, advocate a healthy way of eating, and enhance consumer awareness of food safety and self-protection capabilities.
The news media shall carry out food safety laws, regulations, and food safety standards and knowledge of public welfare propaganda, and public opinion supervision of violations of this Law. Article IX of the state to encourage and support the development of basic and applied research related to food safety, to encourage and support food production and operation to improve food safety by adopting advanced technology and advanced management practices. Article 10 Any organization or individual has the right to report violations of this Law in the production and operation of food, the right to the relevant departments to understand the food safety information, supervision and management of food safety to put forward comments and suggestions.
