First of all, the current problems
(1) Decentralization. Tourism is a comprehensive and highly related industry, and the management of various tourism elements is delegated to the competent departments of various industries. Cultural tourism resources are in the cultural sector, temples and Taoist temples are in the religious sector, reservoirs, lakes and rivers are in the water conservancy sector, forest tourism resources are in the forestry sector, catering services are in the food and drug administration sector, and tourist souvenirs are in the commercial sector. However, the tourism authorities themselves do not have tourism resources.
(2) The power and responsibility are vague. Due to decentralization, responsibilities and powers are blurred. First, the development of tourism will inevitably encounter the problems of tourism service quality and tourists' complaints. Who should accept the complaints? Second, there are problems such as tourists' safety, illegal construction and environmental sanitation in scenic spots, and traffic diversion during peak tourist hours in scenic spots. Whoever investigates them will be responsible for the current management system. The above management responsibilities vary from place to place, and there is no clear experience for reference, so there is a problem of mutual shirking.
(3) Weakening of support system. First, the management system is chaotic. At present, there are corresponding tourism management departments from country to place, but the names, grades and responsibilities of each place are different. Grass-roots tourism management departments lack the support of superior policies, funds, regulations and industry standards, and are fragmented, understaffed, and unreasonable internal institutions. Second, the lack of legal system support. Compared with more than a dozen laws and regulations of other departments such as agriculture, forestry, water, transportation and health, tourism legislation is less. Tourism Law, promulgated on April 25th, 20th13rd, came into force on October 25th, 20th13rd, and is the first special tourism law so far. Apart from the Tourism Law, there is a lack of legal support for implementing the detailed rules and regulations. Third, in the management mechanism, horizontal and vertical separation. Vertically, the tourism department is territorial management, and the guidance and support ability of the higher authorities is very weak. Tourism is the industry with the least geographical boundaries, the least restrictions by administrative regions and the most pursuit of cross-regional and cross-border development. Horizontally, the cooperation between tourism-related departments and scenic area management committees in counties and counties is loose and scattered, so it is difficult for tourism authorities to coordinate and organize relevant departments to jointly promote, and it is impossible to effectively regulate the tourism market and form a joint force of tourism development and management.
Second, the countermeasure research
(1) countermeasures.
After investigating various scenic spots, scenic towns and tourism-related departments, we solicited opinions extensively and summarized the following ideas.
1. Pay attention to comprehensive coordination. As a highly related industry, tourism involves many enterprises and relatively independent industries such as tourist attractions, travel agencies, hotels, restaurants, transportation, entertainment and shopping. This characteristic of tourism determines that the tourism management system is different from other industries, and the management system must pay attention to comprehensive coordination.
2. Clear division of responsibilities and rights. As a comprehensive industry, tourism involves tourism, industrial and commercial quality supervision, health, public security, fire protection, taxation, transportation and other related functional departments. It is necessary to solve the coordination problem of these functional departments, clearly divide management responsibilities and rights, and leave no functional gaps and overlapping responsibilities.
3. Give full play to the main role of the market. Tourism is a kind of market consumption behavior. In addition to the administrative actions managed by the government, we should also give full play to the self-discipline and normative role of tourism enterprises and trade associations to improve service quality and service level.
4. Improve the establishment of tourism management institutions. According to the local situation in Hongya, the tourism management department must perform the functions of comprehensive coordination and tourism law enforcement, and should be defined as comprehensive coordination department. They should enter government departments as administrative agencies, and their internal institutions and subordinate institutions should focus on coordination and law enforcement. In addition, corresponding institutions should be set up as a supplement to undertake service-oriented auxiliary work.
(2) Specific plan.
According to the tourism-related laws, regulations and policies on organization setting, four management system schemes are put forward according to the above ideas, and the organization setting scheme is put forward accordingly.
1. Integrated coordination system
(1) Overview. Tourism management is divided into two levels: tourism macro-management and specific affairs management, and the management agencies at different levels are responsible for it. On the macro-management level of tourism, a permanent deliberation and coordination organization as the leading core of the county's tourism industry development is established to be responsible for the unified management and coordination of tourism-related departments. The specific affairs management level includes the responsibilities of scenic spot planning and construction, tourism market supervision, tourism monitoring and statistical analysis. , continue to be borne by the original functional departments, but subject to the unified management of the leading core of tourism industry development.
(2) institutional setup. The Tourism Industry Development Committee is established as a permanent deliberation and coordination body, with the principal leaders of the government as the director and the relevant departments and units involved in tourism as the member units. The office of the Tourism Industry Development Committee is located in the competent department of tourism and undertakes specific work. The organization forms of the Tourism Industry Development Committee and the Office of the Tourism Industry Development Committee are equivalent to the establishment committee and the editing room. Other functional departments and tourist attractions (resorts) institutions shall work under the leadership of the Tourism Industry Development Committee according to their respective responsibilities and jurisdiction.
(3) Function setting.
It is clear that the Tourism Industry Development Committee has the right to manage tourism resources, examine and approve the general rules of tourism, manage the use of tourism funds, recommend personnel in the tourism system and evaluate tourism performance, and establish the leading core position of the county tourism Committee through three necessary powers: centralization, financial power and human rights.
As the office of the Tourism Industry Development Committee, the competent tourism department not only undertakes its own legal responsibilities, but also undertakes the responsibilities of comprehensively coordinating the relevant tourism departments and units, and is responsible for the collection and summary of the topics of the meetings of the County Tourism Industry Development Committee, the preparation and hosting of the meetings, the drafting and submission of important documents, the decomposition and implementation of meeting decisions, tracking and supervision, performance evaluation suggestions and other specific implementation responsibilities.
The management committee of each scenic spot is responsible for the daily affairs management after the completion of the scenic spot, including the responsibilities of safety, environmental sanitation, market order, daily monitoring of scenic spot tourism dynamics, etc., and no longer undertakes the responsibilities of scenic spot planning and construction, project investment attraction, etc.
Villages and towns in scenic spots are responsible for the land acquisition and demolition required for the construction of scenic spots, and the transfer responsibility of contradictions and disputes between scenic spots and the masses in scenic spots, and are no longer responsible for the daily affairs management of scenic spots.
(4) law enforcement management. Take the form of comprehensive law enforcement. Tourism administrative departments set up tourism law enforcement brigade, involving tourism, industrial and commercial quality supervision, food and drug supervision, public security, county transportation, maritime affairs, transportation management, environmental sanitation improvement, housing construction planning and other joint law enforcement departments. All departments should deploy 2-3 law enforcement officers to enrich the tourism law enforcement brigade, which is directly managed by the Tourism Industry Development Committee, and 3-5 law enforcement officers are stationed in each scenic spot. The deployed law enforcement personnel are under the dual management of the Ministry and the law enforcement team. The law enforcement team that needs to be deployed shall be put forward by the tourism authorities in consultation with the tourism-related departments, reported to the Tourism Industry Development Committee for examination and approval, and reported to the county target office, the county restructuring office and the county finance bureau for the record. Priority shall be given to the work arrangement, working expenses, travel expenses, target assignment and performance appraisal and reward of the law enforcement team. The establishment of wage relations and specific law enforcement work shall be managed by the department, and the law enforcement shall be carried out in the name of the county-level department.
2. Big tourism system.
(1) Overview. Further strengthen the integration of departmental systems, expand the scope of tourism concepts, set up a big tourism bureau, and form a big tourism supervision mechanism with richer tourism resources, wider supervision scope and more specific law enforcement projects.
(2) Function setting.
Integrate the main supervision and law enforcement contents of the tourism market, including food and drug supervision duties, industrial and commercial quality supervision duties, tertiary industry and service industry supervision duties, and price supervision duties, and form a unified big market supervision mechanism.
Integrate the responsibilities of tourism supervision, ethnic and religious supervision, price supervision, cultural relics supervision, ecological civilization construction, excavation and protection of local cultural county records, urban and rural environmental protection and rectification, festival planning and preparation, and foreign affairs tourism reception. Comprehensive tourism affairs include the management and protection of tourism resources, the planning and construction of scenic spots, the use of tourism funds, the standardization of tourism market, the statistical analysis of tourism data monitoring, and the evaluation of tourism performance. Comprehensive law enforcement of tourism includes law enforcement of tourism resources protection, law enforcement of tour guides and travel agencies, and law enforcement of environmental sanitation.
(3) institutional adjustment.
Integrate the price management unit of the middle-level institutions of the Bureau of Industry and Commerce Quality Supervision, the Bureau of Commerce and the County Development and Reform Bureau of the Food and Drug Administration to form the Hongya County Market Economy Administration. Relevant subordinate institutions will be transferred as a whole and integrated according to similar responsibilities. Rename the original quality supervision bureau for industry and commerce in villages and towns as the market economy management office.
The Tourism Bureau, the Ethnic and Religious Affairs Bureau, the Local Records Office, the Ecological Office, the Urban and Rural Environmental Renovation Office and the Reception Office will be adjusted into government agencies, and will be integrated with the County Wenguang New Bureau to form the Tourism, Culture, Ecology and Ethnic and Religious Affairs Bureau, which involves the transfer of subordinate institutions of departments and will be integrated according to similar responsibilities.
The existing four tourist attractions (resorts) will be renamed as tourist complaint service center, tourist development service center, tourist information consultation service center and tourist dispatch center, and will be adjusted into subordinate institutions of the Tourism, Culture, Ecology, Nationalities and Religion Bureau. Tourism complaint service centers set up acceptance points in scenic spots, and tourism development service centers set up contact points in towns and villages, which are not regarded as entities.
(4) law enforcement management.
Tourist complaints involving foreign tourists are accepted by the tourist complaint service center, and are mediated on the spot or handed over to relevant departments for law enforcement. County-level departments with agencies shall, in accordance with the authorized provisions of specific law enforcement laws, enforce the law in the name of the agencies or report to the county-level departments for punishment. Common law enforcement matters without agencies shall be accepted by the county-level departments on duty in scenic spots and reported to the county-level departments for punishment.
Commonly used law enforcement agencies and workplaces are responsible for law enforcement. If the law authorizes law enforcement agencies, they can enforce the law in scenic spots. If they are not authorized, they can report to the county-level competent department for law enforcement in the name of the competent department. Forestry, environmental protection, planning, construction, road administration and safety law enforcement are not commonly used, and the county tourism bureau takes the lead in organizing relevant departments at the county level to carry out special law enforcement.
(5) Division of responsibilities with scenic spots and towns. The county party Committee and the county government issued a document clearly defining the types of scenic spots. Planning, within the scope of the scenic spot under construction, conflicts and disputes between the resettlement and reemployment of landless peasants caused by land acquisition and demolition and the surrounding people will be led by the township where the scenic spot is located, and the mass work service center of the scenic spot will cooperate with mediation. Within the scope of scenic spots that have been opened to the outside world, the contradictions and disputes between scenic spots and the masses, and between tourists and the masses in scenic spots are led by the mass work service center in the scenic spots, and the towns and villages where they are located cooperate with mediation. The township where the scenic spot is located will no longer undertake tourism development, tourism management and tourism law enforcement.
3. Development zone system.
(1) Overview. Referring to the model of Emei Mountain Tourism Economic Development Zone, we will set up a deputy county-level institution to uniformly manage the tourism work of the four scenic spots (resorts) in the county, and uniformly manage the towns (or development zones entrusted by the county party committee and county government) where the four scenic spots are located. Tourism-related joint supervision and law enforcement is the responsibility of county-level departments, and branches are set up in the development zone.
(2) institutional adjustment.
The Party Working Committee of Hongya Tourism Economic Development Zone and the Tourism Economic Zone Management Committee (hereinafter referred to as the Party Working Committee and the Management Committee) are established as the deputy county-level institutions of the county party committee and county government, and the administrative establishment is approved. The required administrative establishment is adjusted from the administrative establishment of county-level departments. According to the actual needs, set up internal institutions and verify the number of leadership positions. The organization, establishment and personnel of the four scenic towns will not be adjusted, and the county party Committee and county government will entrust the Party Working Committee and the Management Committee to manage them. The deputy director of the Tourism Economic Zone Management Committee will also serve as the party secretary of the scenic spot and town.
The existing management committees of four tourist scenic spots (resorts) were renamed as tourist complaint service centers, tourist development service centers, tourist information consultation service centers and tourist dispatch centers, and reorganized into party working committees and management committees.
County government departments such as industrial and commercial quality supervision, food and drug supervision, public security, forestry, urban management and law enforcement, planning and construction set up branches in the development zone, which are under the dual leadership of the county bureau organs and the Party Working Committee and Management Committee of the development zone, and are mainly managed by the Party Working Committee and Management Committee of the development zone. The agency level of Development Zone Branch is metre, with 2-4 approved staff, transferred from the county bureau.
The county tourism bureau is adjusted by the listing agency of the department to the working department of the county government, and co-located with the Party Working Committee and Management Committee of the Development Zone. It has two brands and a set of people. 1 The deputy director of the Management Committee is also the director of the Tourism Bureau.
(3) Function setting. According to the authorization (or entrustment) of the county party committee and the county government, the Party Working Committee and the Administrative Committee shall perform some political duties and overall economic and social duties of the scenic spots and towns under their jurisdiction. Specifically responsible for the county's tourism planning, the decomposition and release of tourism indicators, the assessment of tourism objectives, the arrangement of the use of tourism funds, tourism resource projects, unified foreign investment promotion and marketing of tourism, quality standard management and other responsibilities, responsible for organizing the law enforcement of county-level departments in the scenic area and assessing the effectiveness of law enforcement.
(4) law enforcement management. The joint law enforcement of scenic spots is the responsibility of each development zone branch, and the law enforcement is carried out in the name of the branch. Unusual means of law enforcement are reported to the county bureau for investigation.
4. Essence and truth are integrated.
(1) Overview. Four tourist attractions (resorts) are entrusted to the management of townships, and the secretary of the township party Committee is also the secretary of the party working Committee of the scenic spot, and the head of the township is also the director of the scenic spot (resort) management Committee. The county party committee and the county government implement the bundled assessment of scenic spots and towns, and the administrative parks are deeply integrated.
(2) law enforcement management. Take a combination of authorized law enforcement and entrusted law enforcement. County-level departments with agencies in scenic spots and towns, including county industrial and commercial quality supervision bureau, county food and drug administration and county public security bureau, are directly enforced by county-level departments. The dispatched agencies are under the dual leadership of county-level departments and scenic towns, mainly the leaders of scenic towns, and the law enforcement work is guided by county-level departments. The annual assessment of law enforcement personnel of dispatched agencies accounts for the township indicators, and the work arrangement, work expenses, travel expenses and target rewards are included in the unified management of scenic spots and towns. The list of law enforcement personnel of specific institutions shall be put forward by the county-level departments, and after the towns and villages operating scenic spots are determined, they shall be reported to the county target office, the county commission office and the county finance bureau for the record.
County-level departments without agencies in scenic spots and towns entrust scenic spots and towns with simple law enforcement procedures, which shall be borne by the township comprehensive law enforcement brigade. The department to be entrusted shall be proposed by the Party Working Committee and submitted to the county government for examination and approval, and the entrustment procedure shall be submitted to the Legislative Affairs Office of the county government for the record. Law enforcement that is not suitable for entrustment shall be investigated and dealt with by county departments.
Third, the conclusion
In addition to the above management system scheme, a variety of scheme ideas are put forward, such as establishing and reforming associations and chambers of commerce to play the role of industry self-discipline, the person in charge of tourism development enterprises concurrently serving as the deputy director of scenic spot management institutions (part-time but not part-time), integrating tourism police, and providing one-stop service for complaints and law enforcement. But in general, the exploration of tourism system reform is not a panacea, and it needs a combination of various schemes. At present, our county has carried out the preliminary exploration of tourism industry associations and tourism police, and the initial response is good.
The perfection of tourism management system needs further exploration and brewing, and it needs a certain opportunity. At present, our bureau serves the overall situation of the county, constantly explores and practices, and strives to make new breakthroughs in the tourism management system.
