The Measures for the Administration of Food Safety in Primary and Secondary Schools in Sichuan Province was formally implemented on March 1. These Measures shall apply to the food safety management of ordinary high schools, secondary vocational schools and compulsory education schools within the administrative area of Sichuan Province. The "Measures" pointed out that schools perform the main responsibility of food safety and implement the principal responsibility system. The principal is the first person responsible for food safety. The sponsor of a private school (including the actual controller, the same below) shall ensure the food safety investment of the school and be responsible for food safety, implement the principal responsibility system, and urge the principal to perform the duties of food safety management.
Schools should establish and improve the food safety management system, and clarify the food safety management institutions, responsible persons and food safety management personnel.
School food safety management personnel must pass the examination by the food safety supervision and management department. Employees in school canteens can only take up their posts after obtaining health certificates.
School food safety management personnel shall perform the following duties:
1. Supervise employees to abide by the food safety management system and operating procedures, and implement post responsibilities; 2 organize employees to participate in food safety knowledge and skills training, assessment and health examination;
3. Organize the quality inspection of purchased food, food additives (hereinafter referred to as food) and food-related products, implement the system of claiming certificates, tickets and food samples, and establish and improve food safety files;
4. Organize the identification and recording of unqualified or suspected unqualified foods and food-related products, and remove them from the food processing zone for disposal according to law;
5 to carry out school food safety self-examination, risk investigation and hidden dangers rectification;
6. Other duties as stipulated by laws, regulations and rules of ministries and commissions.
Schools should establish a democratic supervision mechanism for food safety with the participation of school leaders, faculty representatives, students and parents. Schools should set up and publish telephone numbers, e-mails and suggestion boxes. Handle food safety complaints and handle complaints or suggestions in time. Schools that concentrate on dining should arrange relevant responsible persons to accompany them. Conditional schools can choose parents' representatives to accompany meals according to parents' applications. Faculty and catering staff who dine in the school canteen should buy meals with students in the same canteen.
It is forbidden to manufacture and sell cold food and process high-risk food.
The "Measures" stipulate that school canteens adhere to the principle of public welfare and are not allowed to make profits. Kindergarten and compulsory education school canteens operate independently in principle, and school canteen employees can use labor outsourcing or labor dispatch. If it is really necessary to implement other modes of operation, it shall be approved by the administrative department of education or the competent department of school industry.
School canteens should have bright kitchens and open food processing procedures. Encourage the use of "internet plus" and other ways to strengthen the supervision of the whole process of food source, procurement, processing and production. Conditional schools should carry out rapid food testing.
The bulk food such as rice, flour, oil, meat and condiments in the school canteen shall be subject to public bidding, and centralized and fixed-point procurement shall be implemented to ensure that the purchased food meets the food safety requirements. Schools are not allowed to buy food from suppliers with bad food safety credit records.
Schools should publicize the food safety management organization, food business license, health certificate of employees, food safety risk grading marks, records of daily supervision and inspection results, recipes, sources of purchase, brands, use of food additives and other information in a prominent position in the canteen business premises or school information platform.
In addition to prohibiting the purchase and use of food and food-related products that are explicitly prohibited by the Food Safety Law, schools should also abide by the following provisions: prohibiting the purchase, storage and use of nitrite (including sodium nitrite and potassium nitrite); Prohibit the purchase and use of bulk edible oil and salt; School canteens are prohibited from selling cold food (except fruits), raw food, decorative cakes and freshly squeezed fruit and vegetable juices; It is forbidden to process and produce high-risk foods such as green beans, wild mushrooms, fresh day lilies and blue bean sprouts in school canteens. Food vendors are not allowed to operate within 50 meters outside the school gate.
The "Measures" clarify that the processing and production of food in school canteens should be carried out in strict accordance with the "Code of Practice for Food Safety in Catering Services". The functional areas (rooms), facilities and equipment shall not be changed or used interchangeably at will.
When a school orders food from a catering unit, it shall establish and improve the off-campus catering management system, choose a catering unit that has obtained a food business license, can bear the responsibility for food safety and has a good social reputation, and sign a contract with the catering unit to clarify the rights and obligations of both parties in food safety and the handling methods of unqualified food. The school shall inspect and keep samples of the food provided by the catering unit, and make records.
When an emergency related to food safety occurs in a school, it shall promptly report to the local school industry department and education administration, food safety supervision and management, health and other departments, and the relevant departments that receive the report shall report to the local people's government and the higher authorities in accordance with the regulations. Schools and relevant departments should take the initiative to respond to food safety emergencies, pay attention to public opinions related to food safety in schools, and respond to social concerns accurately, timely and objectively.
The food safety supervision and management department shall establish a school food safety credit file, and record the license, the results of supervision and inspection, the investigation and punishment of illegal acts, the responsibility interview and the rectification. Focus on the supervision of schools with bad credit records, and notify the education administrative department and the school industry department.
Schools should strengthen food safety management in canteens, supermarkets and other food sales places on campus. Non-boarding schools are generally not allowed to set up food sales places on campus. Within 50 meters outside the school gate, it shall not be determined as the business activity area of food vendors. Food vendors are managed in accordance with the Regulations on the Administration of Small Food Workshops, Stores and Vendors in Sichuan Province. Schools should buy insurance covering food safety liability.
The relevant person in charge of the Provincial Food Safety Office said that the "Regulations on the Management of Small Food Workshops, Small Commercial Stores and Vendors in Sichuan Province" stipulates that "kindergartens, primary and secondary schools shall not be recognized as food vendors' business activities areas. "However, the specific distance range is still unclear. In order to facilitate the operability of relevant departments in the supervision process, the Measures stipulate that the business activities area of food vendors shall not be determined within 50 meters outside the school gate.

Article 9 Food industry associations shall strengthen industry self-discipline, establish and improve industry norms and reward and punishment mechanisms in accordance with their articles of association, provide food safety information, technology and other services, guide and urge food producers and operators to produce and operate according to law, promote the construction of industry integrity, and publicize and popularize food safety knowledge.
Consumer associations and other consumer organizations shall, in accordance with the law, exercise social supervision over acts that violate the provisions of this Law and harm the legitimate rights and interests of consumers.
Schools should set up and publish telephone numbers, e-mails and suggestion boxes. Handle food safety complaints and handle complaints or suggestions in time.
Article 10 People's governments at all levels should strengthen food safety publicity and education, popularize food safety knowledge, encourage social organizations, grassroots mass autonomous organizations and food producers and operators to popularize food safety laws and regulations, food safety standards and knowledge, advocate healthy eating styles, and enhance consumers' food safety awareness and self-protection ability.
News media should publicize food safety laws and regulations, food safety standards and knowledge for public welfare, and supervise food safety violations by public opinion. The publicity and reporting of food safety should be true and fair.
Twelfth any organization or individual has the right to report food safety violations, obtain food safety information from relevant departments according to law, and put forward opinions and suggestions on food safety supervision and management.
