article 2 these regulations shall apply to the city appearance and environmental sanitation management activities in the urban areas where the people's governments of counties and cities are located within the administrative region of this province.
the urban areas of towns other than those specified in the preceding paragraph may be implemented with reference to these regulations upon the decision of the people's government at the next higher level.
the construction administrative department of the third provincial people's government is responsible for the city appearance and environmental sanitation management in this province; The administrative department of city appearance and environmental sanitation of the people's governments at the city, state and county level (hereinafter referred to as the administrative department of city appearance and environmental sanitation) shall be responsible for the management of city appearance and environmental sanitation within their respective administrative areas.
the relevant departments of the people's governments at or above the county level, such as health, environmental protection, public security, industry and commerce administration, transportation and water conservancy, shall, according to their respective functions and duties, do a good job in the management of city appearance and environmental sanitation.
article 4 the people's governments at or above the county level shall strengthen their leadership over the work of city appearance and environmental sanitation, incorporate the cause of city appearance and environmental sanitation into the national economic and social development plan, organize the preparation of the professional plan of city appearance and environmental sanitation, and organize its implementation.
people's governments at or above the county level should establish and improve the diversified investment mechanism of city appearance and environmental sanitation with public finance as the main body, attach importance to and support scientific research, popularize and apply advanced technologies and facilities, and improve the management level of city appearance and environmental sanitation.
people's governments at or above the county level and their relevant departments should strengthen the publicity and education of laws and regulations on city appearance and environmental sanitation, enhance citizens' awareness of city appearance and environmental sanitation, and advocate a civilized and hygienic lifestyle.
article 5 in the management of city appearance and environmental sanitation, the competent department of city appearance and environmental sanitation and relevant departments should insist on combining the construction of city appearance and environmental sanitation facilities with management according to law, and combining education and guidance with strict and civilized law enforcement.
article 6 communities and residents' committees may organize residents to formulate conventions for the maintenance of city appearance and environmental sanitation, encourage residents to actively participate in the management of city appearance and environmental sanitation, and create clean, beautiful and civilized communities.
article 7 citizens have the right to enjoy a good sanitary environment and the obligation to maintain the city appearance and environmental sanitation, and have the right to discourage and report acts that undermine the city appearance and environmental sanitation and damage environmental sanitation facilities.
all units and individuals should respect the work of city appearance and environmental sanitation workers, and shall not hinder or obstruct their normal work.
article 8 units and individuals that have made outstanding achievements in city appearance and environmental sanitation shall be commended and rewarded by the people's government and its relevant departments. Article 9 The buildings, structures and other facilities of a city shall conform to the city appearance standards stipulated by the state, and be neat, intact and beautiful.
article 11 the design style and color of buildings in a city shall conform to the requirements of urban planning, and new, expanded and rebuilt buildings shall be in harmony with the surrounding city appearance and environment.
the fa? ades of buildings and structures should be kept clean and tidy, and the person in charge of city appearance and environmental sanitation should be cleaned, painted and decorated regularly according to the provisions of the city people's government.
The buildings on both sides of the main street in the city and the buildings facing the street in key areas are not allowed to hang, dry, pile up articles that affect the city appearance or build structures on the roofs, balconies and windows.
windows, outdoor air conditioners, awnings and other facilities shall be installed on the facades of buildings on both sides of main streets in cities and buildings facing the street in key areas, which shall be kept safe and tidy and shall not affect the passage of pedestrians.
the specific scope of the main streets and key areas of the city shall be determined and announced by the people's government of the city.
article 11 no unit or individual may, without authorization, pile materials and erect buildings, structures or other facilities on both sides of urban roads and public places.
due to special needs such as construction, temporary stacking of materials on both sides of urban roads and public places to build non-permanent buildings, structures or other facilities must be approved by the competent department of city appearance and environmental sanitation, and the surrounding environment should be kept clean and tidy.
It is forbidden to dry or hang articles on trees, guardrails, telephone poles, road signs and other facilities in urban roads and other public places.
Article 12 Where buildings on both sides of major urban roads need to be demarcated from streets, walls, fences, hedges, flower beds (pools) and lawns with panoramic or semi-panoramic views should be selected as the demarcation line according to local conditions.
Article 13 The installation of various public facilities such as transportation, telecommunications, postal services, electric power, environmental sanitation, fire protection, water supply, drainage, gas, etc. on urban roads and other public venues shall conform to the requirements of relevant regulations and norms, and keep the facilities intact, clean and safe; In case of pollution, damage, displacement or loss, which affects the appearance of the city, the property right unit and the maintenance unit shall timely repair, replace, reset or supplement.
Article 14 No unit or individual may occupy urban roads, bridges, squares, underpasses and other public places without authorization to set up stalls, sell or process commodities. Temporary occupation of urban roads or other public places for business or activities with legal approval shall be carried out in accordance with the approved time, place and requirements.
the operators of shopping malls and stores facing the street are not allowed to go out of doors, set up stalls outside the windows, operate, do homework or display goods.
article 15 vehicles running in urban areas should be kept clean and tidy in appearance, and those with untidy bodies should be cleaned and maintained in time.
vehicles carrying granular and fluid substances must have well-sealed protective facilities, and there must be no leakage, spillage or road pollution.
sixteenth city night lighting facilities should be unified planning. Landscape lighting facilities such as roads, squares, green spaces, buildings and structures in the planning area shall meet the requirements of urban lighting planning. Conditional cities should bring landscape lighting facilities into the centralized control system according to the needs.
article 17 outdoor advertisements shall be planned in a unified way and set in accordance with the prescribed requirements and deadlines.
the names, shop names, signs and other plaques of organs, organizations, enterprises and institutions and individual industrial and commercial households shall conform to the standards of city appearance.
the setters of outdoor facilities, such as outdoor advertisements, plaques, light boxes, galleries, slogans, billboards, etc., should strengthen the daily management of the facilities and keep them beautiful, safe, firm and functional. If the picture is defaced, the font is incomplete, and the lighting display is incomplete, it shall be repaired or replaced in time.
article 18 the competent department of city appearance and environmental sanitation shall set up public information columns in accordance with the plan for the public to release information, and be responsible for daily management and cleanliness.
no unit or individual may depict, scribble or post on trees, ground, buildings, structures or other public facilities. Article 19. Citizens should consciously safeguard urban environmental sanitation, and must not commit the following acts that affect public environmental sanitation:
(1) spitting and urinating;
(2) littering fruits and skins, scraps of paper, cigarette butts, beverage cans, lunch boxes, chewing gum, plastic bags and other wastes;
(3) dumping sewage, feces and animal carcasses;
(4) burning leaves, garbage or other wastes in open spaces or public garbage collection containers;
(5) throwing and burning articles on roads or public places;
(6) other acts that affect urban environmental sanitation as stipulated by laws and regulations.
Article 21 Units and individuals shall dump domestic garbage in the place and manner specified by the competent department of city appearance and environmental sanitation.
catering operators and service providers should collect and treat kitchen waste separately in accordance with relevant regulations.
article 21 industrial solid wastes, medical wastes and other hazardous wastes must be collected, transported and disposed separately in accordance with state regulations, and it is forbidden to mix them with municipal solid wastes.
article 22 muck, silt, branches and leaves and other wastes generated by the installation, maintenance and conservation of municipal, power supply, water supply, gas, communication, air defense, transportation, fire protection, greening and sanitation facilities shall be removed in time.
article 23 a unit that produces construction waste shall apply to the competent department of city appearance and environmental sanitation, and can only dispose of it after obtaining the approval of construction waste disposal.
the garbage generated by residents' house decoration shall be put into the designated place according to the regulations, and shall not be mixed with domestic garbage.
article 24 the construction unit shall set up temporary environmental sanitation facilities such as shelter fences, vehicle washing facilities, temporary toilets and garbage containers on the construction site, and keep them clean and in good condition.
the construction unit shall not pile up construction waste, engineering dregs and building materials outside the fence of the construction site without authorization. Garbage and muck generated during construction shall be piled up in a centralized way, removed in time, and measures shall be taken to prevent dust and sewage from polluting the surrounding environment.
after the completion of the construction project, the construction unit shall level the construction site in time, remove the construction waste and dismantle the temporary construction facilities.
article 25 it is forbidden to keep chickens, ducks, geese, rabbits, sheep, pigs, edible pigeons and other poultry and livestock in the urban areas where the city is set up. Because of teaching, scientific research and other special needs, in accordance with the relevant provisions.
Residents' keeping of pets and homing pigeons shall not pollute the environment, and the keepers shall immediately remove the excrement discharged by pets on roads and other public venues.
Article 26 No unit or individual may clean vehicles in public places such as urban roads and squares.
those who are engaged in vehicle cleaning, repair, waste purchase and waste acceptance shall maintain the environmental sanitation around the business premises and take measures to prevent sewage from flowing out or waste from scattering outward.
article 27 the classified collection of municipal solid waste shall be carried out step by step, and it shall be treated according to the principles of harmlessness, reduction and resource utilization, and waste recovery and comprehensive utilization shall be encouraged.
the producer of municipal solid waste shall pay the treatment fee of municipal solid waste in accordance with the relevant provisions of the state. Domestic waste disposal fees can be entrusted to collect and remit.
article 28 establish and improve the market operation system of environmental sanitation, and open the market for the construction and operation of environmental sanitation and garbage disposal facilities. Encourage units and individuals with corresponding funds, technology, personnel and equipment to set up environmental sanitation enterprises.
those who engage in the business services of cleaning, collecting, transporting and treating municipal solid waste shall be examined and approved by the competent department of city appearance and environmental sanitation.
the competent department of city appearance and environmental sanitation shall be equipped with professionals or entrust relevant units and individuals to be responsible for the cleaning and management of public toilets.
article 29 the competent department of city appearance and environmental sanitation shall strengthen the management of environmental sanitation, urge the environmental sanitation operation units to clean and remove garbage in time according to the regulations, and arrange the operation time and mode reasonably so as not to hinder the citizens' travel and normal life. Thirtieth city appearance and environmental sanitation departments shall, according to the professional planning of urban environmental sanitation and the standards for setting environmental sanitation facilities, formulate the construction plan of environmental sanitation facilities and organize their implementation. Environmental sanitation facilities refer to garbage transfer stations, garbage disposal sites, garbage collection containers, public toilets, etc.
article 31 the planning for the construction of new urban areas, the transformation of old cities, industrial areas, commercial areas, airports, stations, docks and tourist attractions shall include the provision of environmental sanitation facilities.
the construction unit shall build environmental sanitation facilities in accordance with the standards for setting up urban environmental sanitation facilities, and design, construct and put into use simultaneously with the main project, and the required investment funds shall be included in the budgetary estimate of the construction project.
article 32 the construction of environmental sanitation facilities such as municipal solid waste and construction waste disposal sites shall meet the requirements of environmental sanitation facilities standards and technical specifications.
business units or management units of various public places, passenger vehicles and other places where people gather and distribute shall set up garbage collection containers according to the standards for setting environmental sanitation facilities.
Article 33 Units that manage and use environmental sanitation facilities shall strengthen the management of environmental sanitation facilities, and carry out regular maintenance and repair to keep them clean and in good condition.
article 34 no unit or individual may occupy, damage or dismantle, relocate or close environmental sanitation facilities without authorization, and may not change the use nature of public environmental sanitation facilities without authorization. If it is really necessary to dismantle environmental sanitation facilities due to urban construction, the construction unit shall put forward a plan for demolition and reconstruction in advance and report it to the competent department of city appearance and sanitation for approval.
the land for environmental sanitation facilities determined by urban planning shall not be changed without authorization. Thirty-fifth city appearance and environmental sanitation departments shall establish and organize the implementation of the responsibility system for city appearance and environmental sanitation, divide the areas of responsibility, and implement the responsible persons. The specific scope and responsibility requirements of the city appearance and environmental sanitation responsibility area shall be informed in writing by the competent department of city appearance and environmental sanitation.
article 36 the owners of buildings, structures and other facilities and places are the persons responsible for city appearance and environmental sanitation. Where the owner, manager and user agree on management responsibility, such agreement shall prevail.
The person in charge of city appearance and environmental sanitation in the following areas of responsibility shall be determined according to the following provisions:
(1) Urban roads and their ancillary facilities such as pedestrian bridges and underground pedestrian crossings, and the person in charge shall be a professional environmental sanitation operation unit;
(2) The responsible person of the residential area with property management is the property management unit, and the responsible person of the residential area without property management is the sub-district office or the original property right unit;
(3) for various commodity trading places, the responsible person is the business management unit;
(4) highways, railways, urban rail transit, bridges, tunnels and their jurisdiction, and the responsible persons are business management units;
(5) rivers, lakes and their shorelines, dikes and culverts shall be managed or used by people;
(6) The construction unit is responsible for the construction site of the construction project;
(7) for the land to be built, the responsible person is the land use right holder;
(8) Urban green spaces, parks, airports, railway stations, long-distance bus stations, bus stop facilities, wharves, theaters, exhibition halls, museums, gymnasiums (fields), squares and other public places, and the responsible persons are business management units;
(9) The responsible area of organs, organizations, enterprises and institutions is the unit.
if the responsible person is not clear according to the provisions of the preceding paragraph, it shall be determined by the local city appearance and environmental sanitation department; Cross administrative regions, determined by the competent department of city appearance and environmental sanitation at the next higher level.
Article 37 The person in charge of city appearance and environmental sanitation shall perform the following duties:
(1) Keep the city appearance clean and tidy, and do not set up stalls, set up structures, post, scribble, depict, hang or pile up in disorder;
(2) Keep the environment clean and tidy, free of exposed garbage, feces, sewage, stains and dregs, and free of water and sludge on the road surface;
(3) keep the environmental sanitation facilities clean and in good condition.
the responsible person has the right to dissuade and stop the damage and destruction of city appearance and environmental sanitation in the area of responsibility for city appearance and environmental sanitation, and report to the competent department of city appearance and environmental sanitation.
if the competent department of city appearance and environmental sanitation fails to perform its responsibilities, it can be notified. Thirty-eighth city appearance and environmental sanitation departments shall publish the city appearance and environmental sanitation management standards and regulations according to law, as the basis for the implementation of city appearance and environmental sanitation supervision and inspection.
article 39 the competent department of city appearance and environmental sanitation shall strengthen the construction of law enforcement team, strictly educate and manage, standardize law enforcement behavior and improve the level of law enforcement. The fault accountability system shall be implemented for inaction and chaos in law enforcement.
fortieth city appearance and environmental sanitation departments shall establish and standardize the city appearance and environmental sanitation inspection system, and accept complaints and reports.
