article 5? The competent department of housing and urban construction of the provincial people's government is responsible for the supervision and management of kitchen waste in the province.
the competent department of city appearance and environmental sanitation of the people's governments of cities and counties (cities, districts) is responsible for the supervision and management of kitchen waste within their respective administrative areas.
the relevant departments of the local people's governments at or above the county level, such as development and reform, public security, environmental protection, agriculture, commerce, health, industry and commerce, quality supervision, price, food and drug supervision, shall do a good job in the supervision and management of kitchen waste according to their respective responsibilities.
article 6? The local people's governments at or above the county level shall, in accordance with the national economic and social development plan, ensure the investment of funds for the treatment of kitchen waste. Chapter II Governance Planning and Facilities Construction
Article 11? The competent department of city appearance and environmental sanitation of the people's government of the city or county (city) shall, jointly with the relevant departments, prepare a special environmental sanitation plan in accordance with the national economic and social development plan and the overall urban planning.

article 12? The construction of kitchen waste collection and disposal facilities shall conform to the special planning of environmental sanitation.
construction projects with kitchen waste disposal facilities of more than 111 tons/day shall be examined and approved by the investment department of the provincial people's government. The investment department of the provincial people's government shall solicit the opinions of the competent department of housing and urban construction of the provincial people's government when examining and approving the project.
the construction project of kitchen waste disposal facilities serving across administrative regions shall be examined and approved by the investment department of the people's government at a higher level. The investment department of the people's government at a higher level shall solicit the opinions of the competent department of city appearance and environmental sanitation of the people's government at the same level when examining and approving the project.
article 13? The survey, design, construction and supervision of the construction of kitchen waste collection and disposal facilities shall strictly implement the relevant laws, regulations and technical standards.
article 14? After the kitchen waste collection and disposal facilities project is completed, the construction unit shall organize the completion acceptance according to law, handle the completion acceptance record with the competent construction department of the local people's government and submit the construction project file; At the same time, inform the local people's government department in charge of city appearance and environmental sanitation. Without acceptance or unqualified acceptance, it shall not be delivered for use.
for the kitchen waste disposal facilities that have been completed and put into operation, the competent department of housing and urban-rural construction of the provincial people's government shall, jointly with relevant departments, formulate a harmless rating standard. Harmless rating shall be organized and implemented by the competent department of housing and urban construction of the provincial people's government.
chapter iii declaration, collection and transportation of kitchen waste
article 15? Kitchen waste shall be classified, collected and transported professionally.
article 16? The kitchen waste generating unit shall sign an agreement with the kitchen waste collection and transportation service enterprise and report it to the competent department of city appearance and environmental sanitation of the local people's government for the record; When applying for registration or license to environmental protection, food and drug supervision and other departments, they should take the initiative to produce the agreement.
article 17 a kitchen waste generating unit shall regularly report to the competent department of city appearance and environmental sanitation of the local people's government on the generation of kitchen waste in the next year.
the newly established kitchen waste generating unit shall report the generation of kitchen waste to the competent department of city appearance and environmental sanitation of the local people's government within 11 days from the first generation of kitchen waste.
when reporting the situation of kitchen waste generation, the kitchen waste generation unit shall submit a copy of the agreement signed with the kitchen waste collection and transportation service enterprise.
when the business premises of the kitchen waste generating unit change or the amount of kitchen waste changes greatly, it shall promptly report to the competent department of city appearance and environmental sanitation of the local people's government.
article 18? Kitchen waste generating units shall abide by the following provisions:
(1) Set up kitchen waste collection containers that meet the standards;
(2) Categorize kitchen waste and non-kitchen waste, store them separately, and set up pollution prevention facilities such as oil-water separators or grease traps in accordance with the relevant provisions of environmental protection;
(3) Ensure that the kitchen waste collection containers and pollution prevention facilities are intact, sealed and tidy, and keep the surrounding environment clean and tidy;
(4) hand over the kitchen waste to the kitchen waste collection and transportation service enterprise that has signed an agreement with it within 24 hours after the kitchen waste is generated;
(5) kitchen waste shall not be discharged into rainwater pipes, sewage pipes, rivers, lakes, reservoirs, ditches and public toilets.
article 19? The competent department of city appearance and environmental sanitation of the people's government of the city or county (city) shall make a decision on the license for the collection and transportation of kitchen waste through fair competition such as bidding, issue a license for the collection and transportation of kitchen waste to the successful bidder, and sign an agreement for the collection and transportation of kitchen waste with the successful bidder. The operating agreement on the collection and transportation of kitchen waste shall clearly stipulate the operating period, service standards, liability for breach of contract, etc., and serve as an annex to the service license for the collection and transportation of kitchen waste.
units that have not obtained the service license for the collection and transportation of kitchen waste shall not engage in the business collection and transportation of kitchen waste.
article 21? Engaged in the business collection and transportation services of kitchen waste, it shall meet the following conditions:
(1) It shall be qualified as an enterprise legal person with a registered capital of not less than RMB 3 million;
(2) The kitchen waste should be collected in a fully enclosed special collection container with the function of classified collection;
(3) The kitchen waste should be transported by fully enclosed automatic unloading vehicles, which have the functions of preventing odor from spreading, spilling and dripping;
(4) having a sound technology, quality, safety and monitoring management system and being effectively implemented;
(5) having a legal road transport business license and vehicle driving license;
(6) having a fixed office and parking place for machinery, equipment and vehicles;
(7) Other conditions stipulated by laws and regulations.
article 21? Enterprises engaged in kitchen waste collection and transportation services shall abide by the following provisions:
(1) Collect and transport kitchen waste in a timely manner within a specified time in accordance with environmental sanitation operation standards and norms. Go to the kitchen waste generating unit to remove the kitchen waste at least once a day;
(2) transporting the collected kitchen waste to the kitchen waste disposal place that meets the requirements of these Measures;
(3) The vehicles used for collecting and transporting kitchen waste shall be fully enclosed and automatically unloaded, ensuring that they are sealed, intact and tidy, and shall be painted with specified identification marks;
(4) The generation, collection, transportation and disposal of kitchen waste shall be carried out in a single system;
(5) establish a ledger system for the collection and transportation of kitchen waste, and the collection and transportation ledger shall be submitted to the competent department of city appearance and environmental sanitation of the local people's government once a month;
(6) Without the approval of the competent department of city appearance and environmental sanitation of the local people's government, it is not allowed to suspend business or close its business without authorization.
article 22? Where the kitchen waste is transported outside the administrative area for disposal, the kitchen waste collection and transportation enterprise shall report to the competent department of city appearance and environmental sanitation of the local people's government for the record, and provide the following materials:
(1) a copy of the business license of the disposal unit and a copy of the disposal permit document;
(2) certification materials that the products produced by the disposal unit meet the product quality standards or are subjected to harmless treatment;
(3) the certificate that the competent department of city appearance and environmental sanitation of the local people's government of the disposal unit agrees to receive the disposal.
if the materials specified in the preceding paragraph are not provided and have not been put on record, the kitchen waste shall not be transported outside the administrative area for disposal.
Chapter IV Disposal of Kitchen Wastes
Article 23? Centralized disposal of kitchen waste shall be implemented, and no unit or individual may dispose of kitchen waste at will.

article 24? The adoption of new technologies and equipment shall be organized by the competent department of housing and urban construction of the provincial people's government for technical demonstration.
article 25? The competent department of city appearance and environmental sanitation of the people's government of the city or county (city) shall make a decision on the license for the disposal of kitchen waste through fair competition such as bidding, issue a service license for the disposal of kitchen waste to the successful bidder, and sign a business agreement for the disposal of kitchen waste with the successful bidder. The operating agreement for kitchen waste disposal shall clearly stipulate the operating period, service standards, liability for breach of contract, etc., and serve as an annex to the service license for kitchen waste disposal.
units that have not obtained the service license for the disposal of kitchen waste shall not engage in the business disposal of kitchen waste.
article 26? To engage in the business disposal service of kitchen waste, the following conditions shall be met:
(1) Having the qualification of an enterprise as a legal person, with a registered capital of not less than RMB 5 million; If the scale is more than 111 tons/day, the registered capital shall be no less than RMB 51 million;
(2) The site selection conforms to the urban and rural planning, and the corresponding planning permission documents have been obtained;
(3) The technologies and processes adopted meet the relevant standards;
(4) It has a sound management system for process operation, equipment management, environmental monitoring and protection, financial management, production safety, metrology and statistics, etc. and has been effectively implemented;
(5) It has a feasible technical scheme for the treatment of kitchen waste water, waste gas and waste residue, and a discharge scheme up to standard;
(6) Other conditions stipulated by laws and regulations.
article 27? Enterprises engaged in kitchen waste disposal services shall abide by the following provisions:
(1) Dispose of kitchen waste in strict accordance with relevant regulations and technical standards;
(2) The waste water, waste gas and waste residue generated in the disposal process meet the environmental protection standards to prevent secondary pollution;
(3) The use of microbial agents to treat kitchen waste shall comply with the relevant provisions of the state and take corresponding safety control measures;
(4) The products produced shall meet the relevant quality standards;
(5) Receiving kitchen waste according to the specified time and requirements;
(6) equip kitchen waste disposal facilities and equipment as required, and ensure their good operation;
(7) set up kitchen waste storage facilities in the kitchen waste disposal site (factory) and meet the environmental standards;
(8) monitoring the environmental impact as required, testing and evaluating the performance and environmental protection indicators of kitchen waste disposal facilities, and reporting the testing and evaluation results to the competent department of city appearance and environmental sanitation and the competent department of environmental protection of the local people's government;
(9) kitchen waste disposal, generation, collection and transportation shall be carried out in a single system;
(11) Establish a ledger system for kitchen waste disposal;

article 31? The competent department of development and reform shall strengthen the research and improvement of relevant policies and measures, promote the resource utilization and harmless treatment of kitchen waste, and actively support the development of related enterprises.
the competent financial department should strengthen the supervision and management of the funds for the operation and construction of kitchen waste collection, transportation, harmless treatment and resource utilization facilities that are included in the management of urban public utilities.
the competent pricing department should reasonably formulate the charging policy of municipal solid waste treatment fees and related sewage charges, and do a good job in monitoring the price cost of kitchen waste collection, transportation and disposal.
article 31? The competent agricultural department shall strengthen the supervision and management of fertilizer products processed from kitchen waste, and investigate and deal with the behavior of feeding livestock and poultry with kitchen waste without harmless treatment according to law.
