Chapter I General Provisions Article 1 In order to strengthen the management of construction waste disposal, protect and improve the urban and rural environment, and promote the sustainable development of economy and society, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Implementation Measures of the Law of the People's Republic of China on Road Traffic Safety and the Regulations of Sichuan Province on Comprehensive Management of Urban and Rural Environment, and in combination with the actual situation in Chengdu. Article 2 Those who engage in disposal activities such as the discharge, transportation and consumption of construction waste within the administrative area of this Municipality shall abide by these Regulations.

The construction waste mentioned in the preceding paragraph refers to the dregs, gravel, waste and other wastes produced by units and individuals in the process of new construction, renovation, expansion, demolition and repair of various buildings (structures), pipe networks, road construction and house decoration.

Hazardous wastes generated by the acts listed in the preceding paragraph shall be disposed of in accordance with the provisions of relevant laws, regulations and rules. Article 3 The disposal of construction waste shall follow the principles of reduction, harmlessness and recycling.

If construction waste can be reused or recycled, it should be recycled; If it cannot be reused or recycled, it shall be disposed of in accordance with relevant laws, regulations and the provisions of these regulations. Article 4 This Municipality encourages the emission reduction of construction waste and advocates the comprehensive utilization of construction waste by adopting new technologies, new processes, new materials and new equipment.

City and district (city) county people's governments shall arrange certain funds in the annual budget to support the activities of emission reduction and comprehensive utilization of construction waste. Fifth units and individuals that produce construction waste shall bear the responsibility for the disposal of construction waste and pay the disposal fee in accordance with the relevant provisions.

Units and individuals that discharge, transport and consume construction waste shall bear the responsibility of eliminating pollution in time. On behalf of the elimination, the required expenses shall be borne by the responsible person. Article 6 The principle of territorial priority and district management shall be applied to the disposal of construction waste.

The administrative department in charge of urban management is responsible for the supervision and management of construction waste disposal.

The construction administrative department shall supervise and manage the construction waste disposal activities within the scope of the construction site in accordance with the statutory duties. The traffic administrative department and the traffic administrative department of the public security organ shall supervise and manage the construction waste transportation activities in accordance with the statutory duties. Planning, environmental protection, housing management, land, water, safety supervision, forestry and landscape departments shall, according to their respective functions and duties, do a good job in the supervision and management of construction waste disposal activities.

Sub-district offices and town (township) people's governments shall, under the business guidance of urban management and other administrative departments, supervise and inspect the construction waste disposal activities within their respective jurisdictions. Chapter II Emissions Section 1 Emission Reduction Article 7 This Municipality encourages construction units and engineering design units to choose energy-saving and environmental-friendly materials, and encourages construction units to optimize construction measures to reduce the consumption of building materials and the generation of construction waste. Article 8 This Municipality encourages construction industrialization to gradually promote the standardized design, factory production and on-site assembly of building accessories.

Advocate new house development and construction units to directly provide users with fully renovated finished houses. Ninth construction units and construction units shall not use the construction technology, equipment, materials and products prohibited by the relevant provisions of the state and province.

Encourage the use of reusable materials to build temporary buildings and fences at the facility site. Article 10 This Municipality encourages construction units with on-site classification conditions to classify construction waste according to the classification requirements in combination with construction or demolition steps.

Encourage construction units to recycle construction waste at the construction site. The construction unit shall give priority to recycling the construction waste generated and available at the construction site as the filler of the construction project. Section 2 Discharge Permit Article 11 The construction unit or construction unit shall, 20 days before the commencement date, assess the quantity of construction waste generated by the project, prepare an assessment report on the discharge situation, and apply for a construction waste disposal (discharge) certificate to the district (city) county urban management administrative department where the project is located with the following materials:

(1) Legal documents such as Construction Permit for Construction Project, Decision on House Expropriation or Approval for Building Structure Safety;

(2) Assessment report on construction waste emission;

(3) Construction waste disposal plan;

(four) proof of payment of construction waste disposal fee.

The disposal plan in Item (3) of the preceding paragraph shall include the name of the project and the construction unit, the construction address, the type and quantity of construction waste, the transportation enterprise, the disposal site, recycling and other contents. Twelfth because of emergency rescue, disaster relief and other special circumstances need emergency discharge of construction waste, the provisions of article eleventh of these regulations do not apply. However, the construction unit or the construction unit shall report to the district (city) county urban management administrative department for the record within three days after the danger and disaster are eliminated. Thirteenth district (city) county urban management administrative departments shall conduct an audit within five days from the date of accepting the application. In accordance with the provisions, it shall issue a "construction waste disposal (discharge) certificate"; Do not meet the requirements, shall not be issued, and inform the applicant in writing. Fourteenth construction waste disposal (discharge) certificate shall specify the name of the project, the construction unit and construction address, as well as the type, quantity, discharge period, the name of the transportation enterprise and the disposal site.

The construction unit or construction unit shall discharge construction waste in accordance with the requirements of the construction waste disposal (discharge) certificate.

It is forbidden to alter, lease, lend, transfer or resell the construction waste disposal (discharge) certificate.
