Measures of Guangxi Zhuang Autonomous Region for the Administration of National Security Matters in Foreign-related Construction Projects and Sites
Article 1 In order to strengthen the management of national security matters in foreign-related construction projects and places, safeguard national security, and ensure the smooth progress of reform, opening up and economic construction, these Measures are formulated in accordance with the provisions of the National Security Law of People's Republic of China (PRC) and other laws and regulations, combined with the actual situation of this autonomous region. Article 2 The term "foreign-related construction projects" as mentioned in these Measures refers to new construction, expansion and reconstruction projects used for the work and life of overseas institutions, organizations and individuals.

The term "places" as mentioned in these Measures refers to places used or frequently used by overseas institutions, organizations and individuals. Article 3 All units and individuals engaged in the construction, use, transfer and management of foreign-related construction projects and sites within the administrative area of this autonomous region must abide by these measures. Article 4 State security organs at all levels are the competent departments in charge of the administration of state security matters in foreign-related construction projects and places, and are responsible for organizing the implementation of these Measures within their respective jurisdictions.

The relevant departments of the people's governments at or above the county level shall, within the scope of their respective duties, cooperate with each other to do a good job in the management of national security matters in foreign-related construction projects and places. Article 5 The following foreign-related construction projects and sites shall be examined for national security matters:

(1) Construction projects and places where foreign consulates, foreign resident offices, foreign-invested enterprises and other organizations work, produce and operate;

(two) entry and exit ports, airports, stations, ports, docks and other places;

(3) Hotels, restaurants, apartments, villas, resorts and other places used by overseas individuals for residence, entertainment and other activities for more than one year (including one year);

(four) other construction projects and places that the state security organs of the autonomous region believe should be reviewed for national security matters. Article 6 The examination of national security matters by state security organs includes:

(a) the location and use of foreign-related construction projects;

(2) Communication, monitoring, sound, alarm and detection systems for foreign-related construction projects and places, ground receiving equipment and facilities for satellite radio and television, information network detection and technical safety precautions;

(three) technical inspection and technical safety precautions for office automation systems and information networks in foreign-related construction projects and places;

(four) other contents that need to be reviewed as stipulated by the state. Article 7 Foreign-related construction projects shall be examined in accordance with the following procedures:

(1) After a foreign-related construction project is preliminarily determined, it shall be reported to the state security organ before applying for project approval or filing. Without the approval of the state security organs, the planning and economic and trade departments shall not approve the project or put it on record;

(two) when the relevant departments organize the review of the design scheme of foreign-related construction projects, the state security organs shall participate;

(three) when the foreign-related construction project is completed and accepted, the state security organ shall participate in the acceptance, and the relevant departments shall go through the relevant formalities only after the national security matters have passed the examination. Article 8 To review national security matters, materials shall be submitted in accordance with the following provisions:

(1) Providing an application for examination of national security matters, a project proposal, an opinion on planning and site selection, the business license or legal person certificate of the project owner, and the basic information of the legal representative of the project during the project initiation or filing stage of foreign-related construction projects;

(2) In the design approval stage, provide the red line map around the address of the foreign-related construction project, the construction drawings and text descriptions of the location, lines, pipelines, satellite radio and television ground receiving equipment and facilities of the communication, monitoring, sound, alarm and inspection system;

(three) review stage before construction, provide the basic situation of the construction unit;

(4) In the acceptance stage, an application for acceptance of national security matters shall be provided.

The materials submitted in the preceding paragraph shall be in duplicate, and the foreign language materials shall be accompanied by Chinese translation. Article 9 The state security organ shall make an examination decision within 3 working days from the date of receiving the application materials. Under special circumstances, the review decision can be extended to 5 working days. If the project is approved after examination, the "Review Opinions on National Security Matters" shall be issued; For those who pass the acceptance, they will be awarded the "Certificate of Acceptance of National Security Matters"; If the project is not approved or the acceptance is unqualified, the reasons shall be explained in writing.

Without the acceptance of the state security organs, it shall not be delivered for use. Article 10 Foreign-related construction projects and sites around the following units or important facilities must conform to the limited distance stipulated by the state:

(1) State organs of autonomous regions and cities divided into districts (including regional administrative offices);

(2) National key national defense scientific research and military production units and important postal and communication hubs;

(3) Military restricted zones and military administrative zones;

(four) an important place to receive party and state leaders;

(five) other important confidential departments or parts.

Due to special circumstances, the completed foreign-related construction projects and places can not reach the limited distance, and with the approval of the state security organs of the autonomous region, corresponding technical measures can be taken. Eleventh foreign-related construction projects and places listed in Article 10 of these Measures shall be undertaken by domestic companies. Article 12 Where a place has been provided for use by an overseas organization or individual for less than one year, the owner or manager of the place shall report to the state security organ for the record seven days before the place is provided for use, and submit the following materials:

(a) the basic information of the provider and the change of the ownership of the place;

(2) Basic information of users.

After being filed by the state security organ, the relevant departments can go through the relevant formalities.
