Measures of Hangzhou Municipality on the Administration of Tourism
Chapter I General Provisions Article 1 In order to strengthen tourism management, standardize the order of the tourism market, safeguard the legitimate rights and interests of tourists and tour operators, and promote the development of tourism, these Measures are formulated in accordance with the relevant provisions of the state and combined with the actual situation of this Municipality. Article 2 All units and individuals (hereinafter referred to as tour operators) engaged in tourism business services and tourism activities within the administrative area of this Municipality (including counties and cities under the jurisdiction of this Municipality) shall abide by these Measures. Article 3 The term "tourism" as mentioned in these Measures refers to an industry that uses tourism resources and facilities to attract and receive tourists and provide them with comprehensive services such as transportation, sightseeing, catering, accommodation, shopping, culture and entertainment. Article 4 The tourism administrative department of Hangzhou Municipal People's Government shall be responsible for the overall planning, comprehensive coordination, supervision and inspection of the city's tourism industry, and implement industry management of the city's tourism industry. Its main responsibilities are:

(a) in conjunction with the planning department to prepare the city's long-term tourism planning and annual implementation plan and organize their implementation;

(two) in conjunction with the relevant departments to conduct a general survey of tourism resources, the preparation of the city's tourism resources protection and development and utilization planning, guidance, coordination and supervision of tourism resources protection, development and utilization;

(five) according to the provisions of the examination and approval of travel agencies, designated tourist units and tourist hotels star rating, management of tour guides;

(six) to organize and guide the education and training of tourism managers and tour guides, and to evaluate the technical and professional level of tourism professionals;

(seven) in conjunction with the relevant departments to guide the work of tourism safety;

(eight) to accept complaints from tourists and safeguard the legitimate rights and interests of tourists;

(nine) to undertake other duties entrusted by the Municipal People's government.

County (city) tourism administrative department is responsible for the tourism management within its jurisdiction.

The management institutions of scenic spots and tourist resorts shall be responsible for the tourism management in their respective areas under the macro guidance of the tourism administration department.

All relevant departments shall, in accordance with their respective responsibilities, cooperate with the tourism administrative departments to do a good job in tourism management. Article 5 To develop tourism, we must adhere to the unity of social benefits, economic benefits and environmental benefits, give full play to the advantages of tourism resources, highlight local characteristics and ensure quality services. Article 6 The Municipal People's Government shall formulate a tourism development plan for Hangzhou. The county (city) people's government shall formulate the local tourism development plan and incorporate it into the local national economic and social development plan. Seventh people's governments at all levels should take effective measures to protect and rationally develop and utilize tourism resources. No unit or individual may destroy tourism resources. Eighth development and utilization of tourism resources should adhere to the principle of "unified planning, development according to law, reflecting characteristics, rational utilization and scientific protection", and conform to the tourism development plan and the overall urban planning. Article 9 Encourage the development of leisure and holiday tourism, exhibition tourism, business tourism, eco-tourism and folk tourism, enrich the cultural connotation of tourism activities, and promote the comprehensive and coordinated development of the six elements of "travel, food, housing, transportation, shopping and entertainment". Tenth to encourage state-owned, collective, individual and private, foreign investment and other economic sectors to participate in the development and operation of tourism in Hangzhou, and attract social funds to develop tourism through various channels and forms. People's governments at all levels should formulate corresponding policies to encourage and support foreign enterprises to invest and travel in Hangzhou; Encourage foreign investors to invest in tourist attractions; Encourage enterprises in this city to produce tourism commodities with local characteristics, and give support in technological transformation, new product development and external promotion. Chapter II Tourism Management Section 1 General Provisions Article 11 The operation of tourism business shall be subject to the examination and approval of the competent department, the approval and registration of the administrative department for industry and commerce, and the business license. Twelfth tour operators should operate according to law, improve service quality, consciously fulfill the prescribed service standards or agreements with tourists, and protect the personal and property safety of tourists. Thirteenth tourism operators should carry out professional ethics education and professional training for their employees, and improve the quality of employees and the quality of tourism services. Those who have not passed the training shall not take up their posts. Fourteenth tourism professionals should abide by professional ethics, and shall not engage in acts that harm the interests of the state and personal dignity. It is forbidden to accept kickbacks or extra fees by taking advantage of work; Tourism operators shall not give kickbacks or extra fees to tourism professionals. Fifteenth tour operators must publicize the service items and service charges in their business activities, clearly mark the price, ensure the quality of service, and shall not raise the service charges without authorization; Do not peddle and buy and sell everywhere; Shall not sell fake and shoddy goods; Do not deceive or coerce tourists to buy goods; Don't extort money from tourists Sixteenth tourism operators to participate in overseas international tourism fairs or set up tourism offices, should be in accordance with the relevant provisions of the municipal tourism administration department for examination and approval.

Tourism operators hold national tourism promotion activities, or foreign tourism operators set up tourism offices in this city to hold tourism promotion activities, which shall be reported to the municipal tourism administration department and submitted for approval in accordance with relevant state regulations.
