However, at present, most of the off-campus custody institutions for primary and secondary school students who provide custody services have not gone through the registration procedures and are unlicensed. Supporting facilities, venues, fire protection and food safety do not meet the relevant provisions of the state, and there are potential safety hazards. It is necessary to introduce corresponding management measures to bring such custodian institutions into a standardized and legal comprehensive supervision system.

1. Schools should not assume the responsibility of supervising the off-campus custody institutions for primary and secondary school students, and it is suggested to delete Articles 6 and 7. Reasons for not adopting: The main service target of off-campus trusteeship for primary and secondary school students is primary and secondary school students. The school where the service object is located shall strengthen the safety education and training for the students in school, keep abreast of the off-campus trusteeship of the school where the students are located, and have the obligation and responsibility to cooperate with the education administrative department to strengthen the supervision of the off-campus trusteeship of primary and secondary school students.
2. When the "Administrative Measures" were reported to the Municipal Bureau of Legal Affairs for legality review, the Municipal Education Bureau put forward the following opinions: (1) The off-campus custody institutions for primary and secondary school students belong to for-profit social service institutions and do not belong to training institutions. Therefore, the competent department of business should be the county-level administrative department for industry and commerce. It is suggested to modify the relevant contents of Articles 5, 1 1, 30, 3 1 and 32. (2) Since the off-campus custodian institutions for primary and secondary school students are not allowed to carry out pre-school education and other cultural education, training and study counseling activities, there should be no statement in Article 3 that "if cultural education, training and counseling activities and custody services need to be carried out at the same business address at the same time, the custodian institution should also apply to the education administrative department of the county (city, district) for permission according to the standards of non-academic education and training schools". It is recommended to delete this content. Reasons for not accepting: According to the Guiding Opinions of Guangdong Provincial Department of Education on Doing a Good Job in After-school Service for Primary and Secondary School Students (Guangdong Education Foundation [2018] No.9), both for-profit and non-profit off-campus trust institutions serve students and perform the supervision and management of off-campus trust institutions. As the competent department of off-campus trust institutions, it is the responsibility of the education department.
(2) Opinions of Zhenjiang District Government.
1. Delete the words "guiding off-campus nursery institutions for primary and secondary school students to provide paid education counseling, child care and other services in disguise within the scope prescribed by law" in Article 5 of the responsibilities of the education administrative department. Reasons for not adopting: According to the Implementation Opinions on Reforming the Management System of Social Organizations to Promote the Healthy and Orderly Development of Social Organizations (Guangdong Office [20 17] 14), the education administrative department, as the competent department of the off-campus custody institutions for primary and secondary school students, is responsible for strengthening the daily business supervision of the off-campus custody institutions for primary and secondary school students.

3. Item (4) of Article 10 is amended as "Providing the house property certificate and the fire acceptance letter (or acceptance filing procedures) issued by the original fire department". Reasons for non-acceptance: Due to historical reasons, the fire acceptance cannot be carried out according to the new requirements and standards of the fire department.
(3) Opinions of Wujiang District Government.
1. Responsibilities of the Health and Family Planning Department Article 5 is amended as "The Municipal Health and Family Planning Department shall supervise and manage the infectious diseases, disinfection measures, drinking water, etc. of primary and secondary school students' off-campus custody institutions, and be responsible for the health examination of employees". Reasons for rejection: Wujiang District has no centers for disease control and prevention and health supervision, but this function is the function of the Health Planning Commission. Wujiang District has a Health Planning Commission, which must perform this function instead of handing over the responsibility to the Municipal Health Planning Commission;
2. The responsibilities of the fifth food and drug supervision, development and reform, public security and other departments for the supervision and management of off-campus custody institutions for primary and secondary school students are revised as follows. Reasons for non-adoption: the supervision and management functions of food and drug supervision, development and reform, public security and other departments on the off-campus custodian institutions for primary and secondary school students have been reduced to personal specific work, and the supervision of the off-campus custodian institutions for primary and secondary school students has not been fully performed in accordance with their respective functions.

1. Comments by the representative of Zhang Li. 2. Opinions of representative Dong Shujun.
(1) The off-campus custody institution for primary and secondary school students should be domestic service, and it is suggested that the competent business unit should be the human resources department. Reasons for not adopting: The service object of off-campus trusteeship institutions is primary and secondary school students, which is quite special and different from general housekeeping. Therefore, the education administrative department, as the competent business unit, is more suitable and professional than the private sector.
(2) Article 22 of the Administrative Measures stipulates: "The off-campus trust institutions for primary and secondary school students shall prevent and avoid violent incidents and protect students from physical and mental harm." It should be clear that if the custodian fails to fulfill its corresponding responsibilities and causes physical and mental harm to students, it should bear the responsibility. Reasons for non-adoption: There is no need to specify the responsibilities that the custodian should pursue when he fails to fulfill the corresponding responsibilities, because if similar incidents really occur, the corresponding responsibilities can be pursued according to the existing laws of the country.
(3) It is suggested that "encourage the off-campus trust institutions of primary and secondary school students to buy commercial insurance such as personal accident insurance for students" be changed to "must buy personal accident insurance". Reasons for not adopting: It is impossible to use "must" to stipulate that the custodian institution must buy personal accident insurance for students, and there is no relevant legal basis.
3. Represent Yin Deying's opinion.
(1) The off-campus trust institutions for primary and secondary school students belong to service organizations and do not belong to the business scope of the education administrative department. The administrative department of education should not pre-examine the custodian institution as the competent business unit, but should be jointly pre-examined by the competent department in charge of registration or representatives of various responsible departments. Reasons for rejection: Off-campus trusteeship serves primary and secondary school students, and the education administrative department, as the competent business unit, conducts daily supervision and management of trusteeship, and is duty-bound to pre-examine the establishment of trusteeship.
(2) Article 4 stipulates that "the schools affiliated to the education administrative department shall conduct targeted safety education, fire prevention and earthquake prevention emergency drills for the entrusted students" should be changed to "the fire department is responsible for on-site emergency drills for safety education, fire prevention and earthquake prevention". Reasons for not accepting: The school is the legal institution for students to receive education, and it is the responsibility and obligation of the school to carry out targeted emergency drills such as safety education, fire prevention and earthquake prevention for students at school.
4. The opinions of autumn grain representatives.
(1) In Articles 4 and 5, the word "should" in "management joint meeting system" and "coordination management mechanism" can be changed to "must". Reasons for not adopting: "management liaison meeting system" and "coordinated management mechanism" are one of the ways to strengthen the supervision of off-campus custody institutions and strengthen information enjoyment. County (city, district) governments can establish various coordination and management mechanisms according to local conditions, and cannot use the word "must" to make a one-size-fits-all rule.
(2) The client entrusted by the off-campus custody institution for primary and secondary school students is the guardian of the primary and secondary school students, and the entrusted object is the off-campus custody institution for primary and secondary school students. Therefore, the responsibility for the safety of students in custody should be borne by parents and custody institutions, and schools should not bear too much responsibility. Reasons for not adopting: The main service target of off-campus trust institutions is students at school. The school where the entrusted school is located shall strengthen the safety education and training for students, keep abreast of the situation of the off-campus custody institutions where the students are located, and have the obligation and responsibility to cooperate with the education administrative department to strengthen the supervision of the off-campus custody institutions for primary and secondary school students.
5. The opinion of representative Yu. Business units of off-campus custodian institutions suggest that the safety supervision department take the lead in solving the safety problems of off-campus custodian institutions. Reasons for rejection: The trustee serves primary and secondary school students, and the responsibility of the safety supervision department is to guide, coordinate and solve major problems in safety production, and supervise and inspect the implementation of safety production laws, regulations and standards by non-coal mines and dangerous chemicals production and operation enterprises according to law; To guide and supervise the safety production of production and business units in metallurgy, nonferrous metals, building materials, machinery, light industry, textiles, tobacco and other industries according to law.
6. Comment by the representative of Wu Haiyan.
(1) It is suggested that article 3 should add "educational contents of off-campus trusteeship institutions for primary and secondary school students", such as the cultivation of moral education, aesthetic education and emotional intelligence, so that the trusteeship institutions can become an extension of school education and a platform for extracurricular tutoring to make up for the shortcomings of school education. Don't accept opinions: The off-campus trust institutions in the Administrative Measures refer to for-profit and non-profit institutions that provide services such as lunch, lunch break and dinner for students, and may not provide extracurricular counseling and training services for students. Off-campus trust institutions should not bear the responsibility of cultivating students' moral education, aesthetic education and emotional intelligence.
(2) It is suggested to add "the content of left-behind children in rural areas" in Article 6, paying attention to left-behind children in rural areas. Do not accept the opinion: the objects of off-campus care institutions for primary and secondary school students include all primary and secondary school students, and left-behind children in rural areas are also part of them, and they can also enjoy the care services of off-campus care institutions.
(3) For the employees, it is suggested that the employees of the off-campus trust institutions of primary and secondary school students should be included in the scope of vocational skills training, and they should be certified after passing the training and examination. Do not accept opinions: from the central government to the province, there is no corresponding policy and basis to include the employees of custody institutions in the scope of vocational skills training, nor in the scope of skills training assessment, so it is impossible to achieve certificates. ;
