9. According to the regulations, after personnel enter the examination room, electronic devices such as mobile phones are not allowed to be taken to the examination room seats for any reason. 1. Article 2 Whoever cheats in an exam prescribed by law under any of the following circumstances shall be deemed as "serious" as stipulated in the first paragraph of Article 284-1 of the Criminal Law:

(1) Whoever cheats in an exam for the entrance examination of colleges and universities, the entrance examination for graduate students and the recruitment examination for civil servants;

(2) Causing the examination to be postponed, cancelled or enabled;

(3) the examination staff cheated in the examination;

(4) organizing candidates to cheat across provinces, autonomous regions and municipalities directly under the Central Government;

(5) organizing cheating in exams for many times;

(6) organizing more than 31 people to cheat;

(7) providing more than 51 pieces of cheating equipment;

(8) the illegal income is more than 311,111 yuan;

(9) Other serious circumstances.

Article 5 Whoever illegally sells or provides examination questions and answers prescribed by law for the purpose of cheating in the examination shall be deemed as "serious" as stipulated in the third paragraph of Article 284-1 of the Criminal Law:

(1) illegally sells or provides examination questions and answers for the entrance examination for ordinary colleges and universities, the postgraduate entrance examination and the civil service recruitment examination;

(2) Causing the examination to be postponed, cancelled or enabled;

(3) Examination staff illegally sell or provide examination questions and answers;

(4) illegally selling or providing test questions and answers for many times;

(5) illegally selling or providing test questions and answers to more than 31 people;

(6) the illegal income is more than 311,111 yuan;

(7) Other serious circumstances.

Article 6 For the purpose of cheating in exams, the determination of the crime of illegally selling or providing test questions and answers to others, if the test questions are incomplete or the answers are not completely consistent with the standard answers, shall not be affected.

article 7 whoever replaces others or lets others take the exams prescribed by law instead of himself shall be convicted and punished in accordance with the fourth paragraph of article 284-1 of the criminal law.

Article 12 If a person is sentenced to punishment for committing a crime as stipulated in this Interpretation, he/she may declare occupational prohibition according to the situation of the crime and the need to prevent recidivism; A person sentenced to public surveillance or probation may, according to the circumstances of the crime, declare a prohibition order according to law.

article 13 if the act prescribed in this interpretation constitutes a crime, the degree of harm of the crime, the amount of illegal income, the defendant's criminal record and his attitude of pleading guilty and repenting shall be comprehensively considered, and a fine shall be imposed according to law.
