Article 55 In any of the following circumstances, the relevant administrative supervision department shall order it to make corrections within a time limit, and may impose a fine of less than 31,111 yuan according to the circumstances:

(2) inviting tenders or not inviting tenders without approval without meeting the prescribed conditions or meeting the conditions;

(3) the goods subject to tender according to law are less than 21 days from the date when the tender documents are issued to the date when the tender documents are submitted;

(4) public bidding is not allowed;

(5) Bidding is conducted without the conditions for bidding;

(6) failing to perform the approval procedures;

(7) failing to bid according to the contents approved by the examination and approval department;

(8) receiving bid documents after the deadline for submission of bid documents;

(11) termination of the tender after the tender announcement is issued, the invitation to bid is issued or the prequalification documents or tender documents are sold for reasons other than force majeure.

in case of any of the circumstances mentioned in the preceding paragraph, and the circumstances are serious, the tender shall be re-invited according to law.

article 56 if a tenderer restricts or excludes potential bidders who have passed the prequalification from bidding under unreasonable conditions, and discriminates against potential bidders, it forces bidders to form a consortium to bid together, or restricts competition among bidders, it shall be ordered to make corrections and may be fined between 11,111 yuan and 51,111 yuan.

Article 57 In case of any of the following circumstances in the bid evaluation process, which affect the bid evaluation results, the relevant administrative supervision department may impose a fine of less than 31,111 yuan:

(1) using the bid evaluation criteria and methods not determined in the tender documents;

(2) The bid evaluation criteria and methods contain contents that tend to or exclude bidders, which hinder or restrict fair competition among bidders;

(3) people who are members of the bid evaluation committee should be avoided from participating in the bid evaluation;

(4) The formation and personnel composition of the bid evaluation committee do not meet the statutory requirements;

(5) The bid evaluation committee and its members have violated laws and regulations and obviously lost their impartiality in the bid evaluation process.

under any of the circumstances mentioned in the preceding paragraph, a new bid evaluation or a new tender shall be conducted according to law.

Article 58 If a tenderer fails to determine the winning bidder within the prescribed time limit, or changes the winning result after the bid-winning notice is issued, fails to sign a contract with the winning bidder without justifiable reasons, or puts forward additional conditions to the winning bidder or changes the substantive contents of the contract when signing the contract, the relevant administrative supervision department shall give a warning, order it to make corrections, and may impose a fine of less than 31,111 yuan according to the circumstances; If losses are caused to the winning bidder, it shall compensate for the losses.

after the letter of acceptance is issued, if the winning bidder abandons the winning project, fails to sign the contract with the tenderee without justifiable reasons, puts forward additional conditions or changes the substantive contents of the contract to the tenderee when signing the contract, or refuses to pay the required performance bond, the tenderee may cancel its winning qualification and confiscate its bid bond; If the loss to the tenderer exceeds the amount of bid bond, the winning bidder shall compensate for the excess; If the bid bond is not submitted, it shall be liable for the losses of the tenderer.

article 59 if a tenderer fails to perform the contract concluded with the winning bidder, it shall return the performance bond of the winning bidder twice; If the losses caused to the winning bidder exceed the returned performance bond, compensation shall also be made for the excess; If the performance bond is not submitted, it shall be liable for the losses of the winning bidder.

if the contract cannot be performed due to force majeure, the provisions of the preceding paragraph shall not apply.

Article 61 If the bid is invalid, the bid-winning notice issued and the signed contract are not legally binding from the beginning, but it does not affect the validity of the independent clauses on dispute settlement methods in the contract.
