Recently, the Ministry of Emergency Management of the People's Republic of China promulgated
Regulations on Fire Safety Management of High-rise Civil Buildings.
It is mentioned that an individual who refuses to make corrections by parking an electric vehicle or charging it in the lobby of a high-rise civil building can be fined up to 1,111 yuan. It shall come into force as of August 1, 2121. In violation of these regulations, anyone who commits any of the following acts shall be ordered by the fire rescue agency to make corrections, and fined from 2,111 yuan to 11,111 yuan for business units and individuals, and from 1,111 yuan to 1,111 yuan for non-business units and individuals: (1) conducting naked fire operations such as electric welding and gas welding in high-rise civil buildings, failing to perform hot work approval procedures, making public announcements, or failing to implement fire site monitoring measures; (2) Outdoor billboards and external decorations set up in high-rise civil buildings hinder smoke control, escape and fire fighting and rescue, or change or destroy the fire prevention structure of the building facade; (three) the prompt and warning signs of the external wall insulation materials are not set, or the damaged, cracked and detached external wall insulation system is not repaired in time; (four) failing to implement the duty system of the fire control room in accordance with the provisions, or arranging personnel who do not have the corresponding conditions to be on duty; (five) failing to establish a full-time fire brigade, volunteer fire brigade and other fire control organizations in accordance with the provisions; (six) due to maintenance and other needs to stop using the building fire protection facilities without announcement, failure to formulate emergency plans or failure to implement preventive measures; (seven) in the high-rise civil buildings, public halls, evacuation walkways, stairwells, emergency exits, parking electric bicycles or charging electric bicycles, refusing to make corrections. Minister Huang Ming June 21, 2121 Provisions on Fire Safety Management of High-rise Civil Buildings Chapter I General Provisions Article 1 In order to strengthen fire safety management of high-rise civil buildings, prevent fires and reduce fire hazards, these Provisions are formulated in accordance with the Fire Protection Law of the People's Republic of China and other laws and administrative regulations and the relevant provisions of the State Council. Article 2 These Provisions shall apply to the fire safety management of high-rise civil buildings (including high-rise residential buildings and high-rise public buildings) that have been completed and put into use according to law. Article 3 The fire safety management of high-rise civil buildings shall implement the policy of putting prevention first and combining prevention with elimination, and implement the fire safety responsibility system. High-rise civil buildings with a building height exceeding 111 meters should be subject to stricter fire safety management. Chapter II Fire Safety Responsibilities Article 4 The owners and users of high-rise civil buildings are the main bodies responsible for fire safety of high-rise civil buildings and are responsible for fire safety of high-rise civil buildings. Where the owner or user of a high-rise civil building is a unit, its legal representative or principal responsible person is the person in charge of fire safety of the unit. Owners and users of high-rise civil buildings may entrust professional service units (hereinafter referred to as fire service units) such as property service enterprises or fire technical service institutions to provide fire safety services, and shall stipulate the specific contents of fire safety services in the service contract. Article 5 If there are two or more owners and users of the same high-rise civil building, each owner and user shall be responsible for the fire safety of its exclusive part and be jointly responsible for the fire safety of some parts of * * *. If there are two or more owners and users in the same high-rise civil building, they shall entrust the realty service enterprise, or specify an owner and user as a unified manager to implement unified management of some fire safety, coordinate and guide the owners and users to do a good job in fire safety of the whole building, and stipulate the fire safety responsibilities of all parties in writing. Article 6 Where a high-rise civil building is handed over to a contractor, lessee or manager for use in the form of contracting, leasing or entrusted operation and management, the parties concerned shall specify the fire safety responsibilities of all parties when concluding contracts such as contracting, leasing and entrusted management. The entrusting party and the lessor may, in accordance with the law, coordinate and manage the fire safety work of the contractor, lessee and trustee in a unified way. When contracting, leasing or entrusting operation and management, the owner shall provide buildings that meet the requirements of fire safety and urge users to strengthen fire safety management. Article 7 Owners and users of high-rise public buildings shall perform the following fire safety duties: (1) Abide by fire laws and regulations, establish and implement fire safety management systems; (two) clear fire safety management institutions or fire safety management personnel; (three) to organize fire inspections and inspections to eliminate fire hazards in a timely manner; (four) to ensure that evacuation routes, safety exits, and fire engines are unblocked; (five) regular inspection and maintenance of building fire control facilities and equipment to ensure that they are in good condition and effective; (six) to organize fire prevention publicity and education training, formulate fire fighting and emergency evacuation plans, and organize regular fire drills; (seven) in accordance with the provisions of the establishment of full-time fire brigade, volunteer fire brigade (micro fire station) and other fire organizations; (eight) other fire safety duties as prescribed by laws and regulations. Where a realty service enterprise is entrusted, or a unified manager is defined to implement fire safety management, the realty service enterprise or unified manager shall perform the duties of fire safety as stipulated in the preceding paragraph in accordance with the agreement, and the owner and user shall urge and cooperate with the realty service enterprise or unified manager to do a good job in fire safety. Article 8 The owner, user, realty service enterprise or unified manager of a high-rise public building shall designate a special person as the fire safety manager to be responsible for the fire safety management of the whole building, and publicize his name, contact information and fire safety management responsibilities in a prominent position in the building. The fire safety manager of high-rise public buildings shall perform the following fire safety management duties: (1) to draw up the annual fire work plan and organize the implementation of daily fire safety management; (two) to organize fire inspection, inspection and rectification of fire hazards; (three) to organize the implementation of the maintenance of fire control facilities and equipment for buildings; (four) the management of full-time fire brigade, volunteer fire brigade (micro fire station) and other fire control organizations; (five) to organize publicity, education and training on fire safety; (six) to organize the preparation of comprehensive plans for fire fighting and emergency evacuation and to carry out drills. The fire safety manager of high-rise public buildings should have fire safety knowledge and management ability suitable for their duties. For high-rise public buildings with a building height exceeding 111 meters, the relevant units are encouraged to employ registered fire engineers of corresponding levels or personnel with intermediate or above professional technical positions in related engineering as fire safety managers. Article 9 Owners and users of high-rise residential buildings shall perform the following fire safety obligations: (1) Abide by the fire safety matters agreed in the fire safety convention and management regulations of residential quarters; (two) the use of buildings in accordance with the purposes stated in the certificate of ownership of immovable property; (three) to cooperate with the fire service units to do a good job in fire safety; (four) to bear the cost of fire control services and the related expenses for the maintenance, renewal and transformation of building fire control facilities in accordance with the law; (five) to maintain fire safety, protect fire control facilities, prevent fire, report fire, and adults participate in organized fire fighting work; (six) other fire safety obligations stipulated by laws and regulations. Article 11 The entrusted realty service enterprise of high-rise residential buildings shall perform the following fire safety duties according to law: (1) Implement the fire safety responsibilities, formulate the fire safety system, and draw up the annual fire safety work plan and organizational guarantee scheme; (two) clear specific departments or personnel responsible for fire safety management; (three) regular inspection and maintenance of fire control facilities, equipment and fire signs in the management area to ensure that they are in good condition and effective; (four) to organize fire inspections and inspections to eliminate fire hazards in a timely manner; (five) to ensure the smooth flow of evacuation routes, safety exits and fire engines, and to stop the illegal acts such as occupying, blocking and closing evacuation routes, safety exits and fire engines; Stop invalid, timely report to the fire rescue agencies and other relevant administrative departments in accordance with the law; (six) to urge the owners and users to fulfill their fire safety obligations; (seven) regularly inform the owners' committee and the owners and users of the residential area where they are located about the fire safety situation, and remind them of the fire safety risks; (eight) to organize regular fire prevention publicity and education; (nine) to formulate fire fighting and emergency evacuation plans, and organize regular drills; (ten) other fire safety responsibilities stipulated by laws and regulations and agreed in the contract. Eleventh fire rescue agencies and other institutions responsible for fire supervision and inspection shall conduct fire supervision and inspection of high-rise civil buildings according to law, and urge owners, users and entrusted fire service units to implement fire safety responsibilities; Notify the relevant units or individuals to take immediate measures to eliminate the fire hazards found in the supervision and inspection. Fire rescue agencies should strengthen the publicity of fire safety laws and regulations of high-rise civil buildings, and urge and guide relevant units to do a good job in fire safety publicity and education of high-rise civil buildings. Twelfth villagers' committees and residents' committees shall organize the formulation of fire safety conventions according to law, conduct fire safety inspections on high-rise civil buildings, and assist the people's governments and relevant departments to strengthen fire prevention publicity and education; Carry out targeted fire prevention publicity and education for the elderly, minors and the disabled, and strengthen fire safety assistance. Thirteenth water supply, power supply, gas supply, heating, communications, cable television and other professional operating units shall be responsible for the fire safety of facilities and equipment managed by them in high-rise civil buildings, and conduct regular inspections and maintenance. Chapter III Fire Safety Management Article 14 During the construction of high-rise civil buildings, the construction unit shall clarify the fire safety responsibilities of the construction site with the construction unit. During the construction period, the on-site preventive measures shall be strictly implemented, fire-fighting equipment shall be allocated, special persons shall be assigned for guardianship, and fire-fighting separation measures shall be taken, so as not to affect the safe evacuation of personnel in other areas and the normal use of building fire-fighting facilities. Owners and users of high-rise civil buildings are not allowed to change the use function of the building, change the fire and smoke prevention zones without authorization, and are not allowed to use flammable and combustible decoration materials in violation of fire control technical standards. Fifteenth high-rise civil building owners, users or property services companies, unified managers should implement strict fire safety management for the use of open fire operations, and shall not use open fire in places with fire and explosion hazards; If it is necessary to carry out open flame operations such as electric welding and gas welding due to special circumstances such as construction, it shall go through the formalities for examination and approval of hot work in accordance with the regulations, implement the on-site guardian, equip with fire-fighting equipment, and announce it in a prominent position at the main entrance of the building and the job site. Operators shall hold relevant certificates in accordance with the law, strictly abide by fire safety regulations, remove inflammable and combustible materials around and below, and take fire prevention and isolation measures. After the operation is completed, a comprehensive inspection shall be conducted to eliminate the residual fire. Shopping malls and public entertainment places in high-rise public buildings are not allowed to carry out hot work during business hours. In the high-rise public buildings, no fire and no smoking areas shall be determined, and obvious signs shall be set up. Article 16 The installation and use of electrical equipment in high-rise civil buildings, as well as the laying, maintenance and testing of its lines, shall conform to the technical standards for fire control and management regulations. Owners, users or fire service units of high-rise civil buildings shall arrange professional institutions or electricians to regularly inspect the electrical equipment and lines managed by them in the management area; Those that do not meet the safety requirements shall be repaired and replaced in time. Seventeenth high-rise civil buildings in the installation and use of gas appliances and pipeline laying, maintenance and testing should comply with fire technical standards and management regulations. It is forbidden to install, modify or dismantle gas equipment and appliances without authorization in violation of the provisions on the safe use of gas. The use of gas in high-rise civil buildings should adopt pipeline gas supply. It is forbidden to use liquefied petroleum gas in the underground part of high-rise civil buildings. Article 18 It is forbidden to produce, store or deal in Class A and Class B fire dangerous goods in high-rise civil buildings in violation of state regulations. Article 19 For a high-rise civil building with external thermal insulation system, the management unit shall set up suggestive and warning signs at the main entrance and relevant prominent positions around it to indicate the burning performance and fire prevention requirements of external thermal insulation materials. Damage, cracking and shedding of the external thermal insulation system of the external wall of high-rise civil buildings shall be repaired in time. During the construction of external wall thermal insulation system of high-rise civil buildings, the construction unit shall take necessary measures of fire prevention and isolation, as well as restrictions on occupancy and use, to ensure the safety of personnel in the building. It is forbidden to use flammable and combustible materials as external thermal insulation materials for external walls of high-rise civil buildings. It is forbidden to set off fireworks and firecrackers in its buildings and surrounding forbidden areas; It is forbidden to pile up combustible materials around its external wall. For high-rise civil buildings that use flame-retardant external thermal insulation materials or external thermal insulation systems with cavities between primary walls and decorative layers, it is forbidden to use electricity when using fire on their external walls. Twentieth high-rise civil buildings, such as cable wells, pipe wells and other vertical tube wells and cable bridges should be blocked by fire at each floor, and the tube well inspection door should adopt fire doors. It is forbidden to occupy cable wells and pipe wells, or pile up sundries in vertical pipe wells such as cable wells and pipe wells. Twenty-first outdoor billboards and exterior decorations of high-rise civil buildings shall not use flammable and combustible materials, and shall not interfere with smoke prevention and evacuation, fire fighting and rescue, and shall not change or destroy the fire prevention structure of the building facade. It is forbidden to set obstacles that affect escape and fire fighting and rescue in the external windows of high-rise civil buildings. Decorations and billboards set on the external walls of high-rise civil buildings with a building height of more than 51 meters shall be made of incombustible materials and easy to dismantle. Twenty-second it is forbidden to set up structures, parking berths, fixed isolation piles and other obstacles in the fire truck passage and fire truck climbing operation site. It is forbidden to set up overhead pipelines, billboards, decorations and other obstacles that hinder the operation of fire engines above the passage of fire engines and on the climbing operation surface. Twenty-third high-rise public * * building catering business units shall promptly clean the kitchen stoves and fume hood facilities, and the fume exhaust pipeline shall be inspected and cleaned at least once every quarter. High-rise residential buildings, the public * * * oil smoke exhaust pipeline should be regularly inspected, and take fire prevention measures. Twenty-fourth in order to meet the use function of high-rise civil buildings, it is forbidden to set up other warehouses in high-rise civil buildings, except for temporary warehouses for personal use, archives and reference rooms. The affiliated storerooms of high-rise civil buildings shall take corresponding fire separation measures and strictly abide by the relevant fire safety management regulations. Article 25 Equipment rooms such as boiler room, power distribution room, air-conditioning room, self-provided generator room, oil storage room, fire water pump room, fire water tank room, smoke exhaust fan room, etc. in high-rise civil buildings shall be set up in accordance with fire technical standards, identified as key fire safety parts, set up obvious fire signs, and strictly managed, and shall not occupy or pile up sundries. Twenty-sixth high-rise civil building fire control room should be implemented by the management unit of the 24-hour duty system, each class should not be less than 2 personnel on duty. The operator on duty in the fire control room shall obtain the professional qualification certificate of the special type of work in the fire protection industry of the corresponding level according to law, master the fire alarm handling procedures and requirements, and check the operation of automatic fire control facilities and linkage control equipment in accordance with the relevant provisions to ensure that they are in normal working condition. The fire control room shall keep the general layout of high-rise civil buildings, the plan layout, the system diagram of fire control facilities and the description of control logic, the maintenance records and test reports of building fire control facilities.
