The term "domestic waste" as mentioned in these Regulations refers to the solid waste generated in daily life or activities providing services for daily life and the solid waste regarded as domestic waste according to laws and regulations.
Where there are provisions in laws, regulations and rules on the management of hazardous waste, medical waste, discarded electrical and electronic products, construction waste and other solid waste, those provisions shall prevail. Article 3 Domestic garbage is divided into the following four categories:
(1) Recyclable articles refer to articles suitable for recycling and reuse;
(2) Organic perishable garbage refers to restaurant garbage, household kitchen garbage, discarded vegetables, fruits, flowers and trees and other organic perishable substances;
(3) Hazardous wastes refer to substances that cause direct or potential harm to human health and the natural environment;
(4) Other garbage refers to domestic garbage other than the first three items. Article 4 The management of domestic waste shall follow the principles of government leading, participation of the whole people, overall planning of urban and rural areas and territorial responsibility, and implement a compulsory classification system of classified delivery, classified collection, classified transportation and classified disposal, so as to gradually realize the reduction, recycling and harmlessness of domestic waste. Article 5 The people's governments of cities and counties (cities, districts) shall co-ordinate the management of urban and rural domestic garbage within their respective administrative areas, incorporate the management of domestic garbage into the national economic and social development plan at the corresponding level, define the disposal targets of domestic garbage, and implement the safeguard measures for cleaning, classified delivery, collection, transportation and disposal of domestic garbage.
Township people's governments and subdistrict offices are responsible for organizing the implementation of daily management of domestic waste within their respective jurisdictions, carrying out publicity, education and training on the reduction and classification of domestic waste, and guiding village (neighborhood) committees to organize the classified delivery and collection of domestic waste. Sixth city and county (city, district) people's government environmental health department is responsible for the supervision and guidance of domestic waste management, as well as the supervision and management of domestic waste cleaning, classification, delivery, collection, transportation and disposal.
Other relevant departments shall, in accordance with the following duties, cooperate in the management of domestic waste:
(a) the competent department of development and reform is responsible for the construction of domestic waste treatment facilities into the national economic and social development plan, and do a good job in the project approval of domestic waste classification, collection, transportation and disposal facilities;
(two) the competent department of urban and rural planning is responsible for the relevant contents of the special plan for domestic waste disposal into the urban and rural planning of the administrative region, and do a good job in the planning and reserve of relevant land;
(three) the competent department of housing and urban and rural construction is responsible for the construction of equipment and facilities for the classified collection and disposal of domestic waste, and gives guidance to the property service enterprises and construction units in implementing the classification of domestic waste;
(four) the competent department of land and resources is responsible for the construction land security of domestic waste classification treatment facilities;
(five) the competent department of commerce is responsible for promoting the construction of the recycling system of recyclable materials, formulating recycling norms and standards and publishing them to the public;
(6) The administrative department for industry and commerce is responsible for the supervision and management of providing plastic shopping bags in supermarkets, shopping malls, bazaars and other retail places;
(seven) the competent department of environmental protection is responsible for the supervision and management of centralized transfer of domestic garbage and pollutant discharge from terminal treatment facilities;
(eight) the traffic management department of the public security organ is responsible for examining and determining the driving route, time and road traffic safety of domestic waste transport vehicles;
(nine) the education department is responsible for popularizing and publicizing the knowledge of domestic waste reduction and classification in primary and secondary schools and kindergartens;
(ten) the competent financial department is responsible for formulating financial policies to support the management of urban and rural domestic waste, and implementing the fund guarantee work;
(eleven) transportation, water, agriculture, culture, radio and television news departments in accordance with laws, regulations, rules and responsibilities determined by the people's government at the same level, do a good job in the management of domestic waste. Seventh according to the requirements of functional transformation and institutional reform, environmental sanitation management and law enforcement related responsibilities are assigned to the urban management comprehensive law enforcement department, the original competent department will no longer exercise.
The administrative punishment prescribed in these Regulations and the administrative compulsory measures related to administrative punishment shall be exercised by the urban management and comprehensive law enforcement departments in the field of comprehensive law enforcement. Article 8 The people's governments of cities and counties (cities, districts) shall establish and improve the system of joint meetings attended by relevant departments such as sanitation, environmental protection, housing and urban construction, and commerce. To coordinate and solve major problems in the management of domestic waste within their respective administrative areas. Article 9 Village (neighborhood) committees shall organize, guide and supervise the cleaning, classification and collection of domestic garbage in their villages (communities), and assist the people's governments and relevant departments in the management of domestic garbage. Tenth units and individuals should consciously abide by the provisions of the classification and reduction of domestic waste, and do a good job in cleaning, sorting and putting domestic waste.
City, county (city, district) people's governments shall formulate relevant incentive measures according to local conditions to guide and promote units and individuals to actively participate in the classification and reduction of domestic waste.
