Harbin City, to prevent the harm of second-hand tobacco smoke Ordinance (2020 Amendment)
Article 1 In order to prevent the hazards of second-hand tobacco smoke, protect public health, improve the degree of civilization of the city, according to relevant laws and regulations, combined with the actual situation in the city, the formulation of these regulations. Article 2 This Ordinance applies to the city within the urban area to prevent second-hand tobacco smoke hazards. Article III of these regulations referred to second-hand tobacco smoke (hereinafter referred to as second-hand smoke), refers to the cigarette or other tobacco products from the burning end of the tobacco smoke emitted and exhaled by smokers.

The secondhand smoke hazard referred to in these regulations means that it has been scientifically and clearly proven that passive exposure to secondhand smoke caused by human death, disease and loss of function. Article 4 to prevent secondhand smoke hazards, the implementation of categorized management, each responsible for its own, public supervision, effective protection of the principle. Article 5 The people's governments of cities and districts are responsible for the organization and implementation of these regulations.

The municipal and district health administration departments are responsible for the daily work of preventing the hazards of secondhand smoke. Article 6 The relevant administrative departments of the municipal and district people's governments shall be responsible for the prevention of the hazards of secondhand smoke in accordance with the following provisions:

(1) The administrative departments of education shall be responsible for the prevention of the hazards of secondhand smoke in schools and pre-school educational institutions;

(2) The administrative departments of culture, radio and television, and tourism, sports and civil affairs shall be responsible for the prevention of the hazards of secondhand smoke in cultural, recreational and tourist attractions, sports venues and social welfare institutions;

(3) transportation administration is responsible for the prevention of secondhand smoke hazards in public **** transportation and its related places;

(4) market supervision administration is responsible for the prevention of secondhand smoke hazards in catering and pharmaceutical wholesaling and retailing establishments;

(5) public security network (E) public security network supervisory bodies, public security management agencies are responsible for the prevention of second-hand smoke hazards of Internet Internet service business establishments, bath business establishments and hotels, respectively; fire rescue agencies are responsible for the anti-smoking work of wholesale and retail business establishments of commodities;

(F) management of institutional affairs departments are responsible for the prevention of second-hand smoke hazards of the indoor places of the institutions under their management;

(VII) Health (vii) Health administration departments are responsible for the prevention of secondhand smoke hazards in medical and healthcare institutions;

(viii) the prevention of secondhand smoke hazards in other places stipulated in these regulations shall be the responsibility of the administrative departments designated by the people's governments of the cities and districts.

The administrations of finance, postal services, communications, power supply, airports and railroads are responsible for the prevention of secondhand smoke hazards in places related to their industries.

The administrative departments stipulated in the first paragraph of this Article shall designate the corresponding law enforcement agencies for the prevention of secondhand smoke hazards and their responsible persons to be in charge of the law enforcement work for the prevention of secondhand smoke hazards. Article 7 It is prohibited to smoke or carry lighted cigarettes, cigars or pipes in the following places:

(1) indoor and outdoor places of pre-schools, primary and secondary schools and other places where minors are concentrated;

(2) indoor and outdoor places of colleges and universities;

(3) indoor and outdoor places of maternity and child health-care centers(institutes), children's hospitals, children's welfare homes, as well as other health care institutions and Indoor places of nursing homes (old age apartments), sanatoriums;

(4) Indoor places of sports, fitness venues and outdoor audience seating, competition stadium area;

(5) Indoor places of libraries, theaters, concert halls, exhibition halls, museums, art galleries, museums, museums, science and technology museums, archives and other types of public **** cultural venues;

(6) State organs, enterprises and public institutions, social organizations of the indoor premises;

(vii) commodity wholesale, retail business premises of the indoor premises;

(viii) finance, postal services, telecommunications, stock exchanges and other business premises of the indoor premises of the enterprise business premises;

(ix) tourist attractions (points) of the indoor premises;

(j) public **** electric cars, rental cars, rail transit vehicles, passenger ferries, trains, airplanes and other public **** transportation and its ticket office, waiting room;

(xi) video halls (rooms), singing (dance) halls, amusement halls (rooms), beauty (hair) room, Internet cafes, lottery outlets and other indoor places;

(xii) other laws and regulations prohibit smoking in public **** places. Article 8 In places where smoking is prohibited, there shall be no smoking rooms or designated smoking areas.

Smoking rooms or designated smoking areas in areas other than prohibited places shall comply with the following provisions:

(1) meet the requirements of fire safety;

(2) set up a clear sign;

(3) and prohibited places effectively separated;

(4) away from densely populated areas and pedestrians have to pass through the passageway. Article 9 The operator or manager of a no-smoking place shall fulfill the following duties:

(1) establish a no-smoking management system, and set up a unified no-smoking signs and the relevant administrative departments in a conspicuous position to report and complain about the phone number;

(2) no smoking-related appliances are not set up in the no-smoking place;

(3) to the smoking of no-smoking place

(C) for smoking in places where smoking is prohibited, to persuade them to stop smoking; for those who do not listen to persuasion, to ask them to leave the premises; for those who do not listen to persuasion and do not leave the premises, to report to the relevant administrative departments, complaints; for those who do not listen to persuasion and affect the order of the public ****, to the public security organs to report the case.

The operator or manager of a no-smoking place shall designate a person responsible for the fulfillment of the duties set forth in paragraph (c) of the preceding paragraph. Article 10 In places where smoking is prohibited, any person may exercise the following rights:

(1) to dissuade smokers from stopping smoking;

(2) to inform the operator or manager of the place where smoking is prohibited to fulfill the duty of stopping smoking;

(3) the right to report to the relevant administrative departments to report or complain to the operators or managers of the places where smoking is prohibited who fail to fulfill their duty of stopping smoking.
