Article 2 These Regulations shall apply to the control of smoking in public places within the administrative area of this Municipality.
the public places mentioned in these regulations refer to places that the public can enter and leave or places for collective use, including catering service places, accommodation and rest service places, public entertainment places, workplaces, public transportation vehicles and public elevators.
Smoking as mentioned in these Regulations refers to the act of inhaling and exhaling tobacco smoke or electronic cigarette aerosol. Possession of lighted tobacco products is regarded as smoking. Article 3 The control of smoking in public places in this Municipality adheres to the principle of * * * governance by the government and the society, and implements the principles of government leading, classified management, place responsibility, public participation, individual self-discipline and social supervision. Article 4 The people's governments of cities, districts and counties (autonomous counties) shall strengthen their leadership over smoking control in public places, incorporate smoking control in public places into the national economic and social development plan, establish a joint meeting system for smoking control in public places, and promote the construction of work system.
township people's governments and sub-district offices are responsible for smoking control in public places within their respective jurisdictions. Article 5 The municipal, district and county (autonomous county) health authorities are the authorities in charge of smoking control in public places, and shall perform the following duties according to law:
(1) Deploy, organize, guide and coordinate the publicity on smoking control and health education on tobacco hazards in public places;
(2) Organizing, monitoring and evaluating the smoking control in public places;
(3) organizing medical and health institutions to provide smoking cessation medical services and provide smoking cessation consultation and guidance;
(4) Other duties as stipulated by laws and regulations.
relevant departments of the people's governments of cities, districts and counties (autonomous counties) are responsible for smoking control in relevant public places according to their respective responsibilities. Article 6 The whole society should support smoking control in public places.
any unit or individual has the right to dissuade smoking in violation of these regulations, to require the operators and managers of no-smoking places to fulfill their obligation to control smoking in public places, and to complain and report.
Encourage social organizations and individuals such as tobacco control associations and volunteer organizations to participate in smoking control in public places or provide various kinds of help and support for smoking control in public places through various forms according to law. Article 7 State organs, enterprises and institutions, social organizations and other social organizations shall incorporate smoking control in public places into the daily management of their own units, and stop smoking in violation of these regulations.
relevant departments at the municipal level should incorporate the smoking control in public places into the evaluation system established by sanitary cities (districts), civilized cities (districts) and civilized units.
tobacco products and electronic cigarettes are not allowed to be provided or used in all kinds of official activities in this city. Article 8 Smoking is prohibited in indoor areas of public places. However, smoking areas can be designated or set up in the indoor areas of the following public places:

(3) Public places of entertainment.

(1) Public places with minors as the main activity groups such as primary and secondary schools, kindergartens, children's welfare homes, children's palaces, youth activity centers and training institutions;
(2) Maternal and child health care institutions and children's hospitals;
(3) public sports venues, sports and fitness venues and performance venues;
(4) waiting area for public transport;
(5) Other places where smoking is prohibited as stipulated by laws and regulations.
the people's governments of cities, districts and counties (autonomous counties) may, according to the needs of holding large-scale activities, temporarily designate outdoor areas where smoking is prohibited in areas other than those specified in the preceding paragraph. Article 11 Smoking areas may be set up in outdoor areas of public places other than those specified in Article 9 of these Regulations, and the following conditions shall be met when setting up smoking areas:
(1) It meets the fire safety requirements;
(2) Avoid crowded areas and main passages that pedestrians must pass through;
(3) Set up obvious smoking area signs and guidance signs;
(4) Equipment for collecting cigarette ash and cigarette butts, and publicity materials that smoking is harmful to health.
setting up smoking areas in the indoor areas of public places specified in article 8 of these regulations shall meet the conditions mentioned in the preceding paragraph, and shall also meet the conditions of effectively isolating smoke from no-smoking areas or good ventilation conditions. Eleventh individuals shall abide by the provisions of these regulations, and shall not smoke in public places where smoking is prohibited; Smoking in public places where smoking is not prohibited, non-smokers should be avoided reasonably. Article 12 Operators and managers of public places shall perform the following obligations:
(1) Smoking-related appliances and articles with tobacco advertisements shall not be provided in no-smoking areas;
(2) Set up a no-smoking sign and a telephone number in a conspicuous position in the no-smoking area;
(3) discourage smokers who violate the provisions of these regulations, and report to the relevant regulatory authorities if they do not listen to dissuasion.
Operators and managers can use technical means to monitor smoking behavior according to law and strengthen the management of public places where smoking is prohibited.
