Customers eating flies, mosquitoes, hair and other foreign bodies in restaurants are foods that do not meet the quality requirements. Article 24 of the Consumer Protection Law stipulates that restaurants should return or exchange goods for customers according to their requirements.
Attention-return, this is the most basic right of customers.
If this link is not handled well and customers are not satisfied, they still have the following rights-
■2. complain
Customers can complain to the US Food and Drug Administration, the Industrial and Commercial Bureau, the Health Bureau, the Consumer Association, etc. Of course, the evidence that customers need to provide: physical samples or photos with foreign objects, invoices for proof of eating, etc.
■3. Ten times compensation
It should be noted that this is a new regulation last year, and many catering friends still don't understand it-
According to the provisions of the Food Safety Law, consumers can demand compensation of ten times the price from the producers or sellers when they buy dishes or foods that are deteriorated, rancid, moldy, unclean, mixed with foreign substances, adulterated or have abnormal sensory properties.
Note that ten times compensation here refers to ten times the price of this dish.
For example, the price of this dish with foreign objects is 38 yuan, and the customer can ask for compensation for 380 yuan at the highest, which is a normal compensation protected by law.
If the incident happens here, the customer is still determined; If something worse happens, such as customers feeling uncomfortable, the restaurant has other responsibilities-
■4. Punitive double indemnity
Customers who feel unwell after eating should seek medical advice promptly. After seeing a doctor, you can ask the restaurant for compensatory compensation and punitive compensation less than twice the loss.
Among them, compensatory compensation includes: medical expenses, nursing expenses, transportation expenses and other reasonable expenses for treatment and rehabilitation, as well as lost time; If disability is caused, it shall include the cost of living AIDS for the disabled and disability compensation; If death is caused, funeral expenses and death compensation shall also be included.
The purpose of listing these is to let every friend in the catering industry better understand the "worst result" when encountering such problems, and then make more favorable judgments and treatment methods.
For restaurant operators, no matter whether these laws and regulations are reasonable or not, if customers insist on not reconciling, restaurants will indeed face huge economic risks.
