Based on the principle of equality and mutual benefit, in order to further clarify the responsibilities of Party A and Party B, the following terms of the agreement are reached through friendly negotiation between both parties, and both parties shall abide by them.

I. Scope of contracting

All muddy water construction projects (excluding dry hanging stones on external walls and septic tanks) of three buildings in Area C of ningnan county low-rent housing within the scope of Party A's construction.

III. Contract unit price

1. Unit price: One-time lump sum for each square meter according to the designed construction area, without any increase or decrease.

IV. Settlement of quantities and payment method

1. After the first concrete structure is completed, Party A shall return all the credit funds to Party B and pay Party B the progress according to 51% of the actual completed masonry quantities.

2. Party A shall pay 71% of the total contract price to Party B after the completion of masonry, secondary structure and internal and external painting.

3. The project payment shall be paid in full within one month after the acceptance of Jungong.

V. Duties of both parties:

(1) Duties of Party A:

1. Construction equipment: Party A shall provide hoisting equipment, mixer equipment, construction electricity and water, and electricity boxes within the third-class electrical boxes required by the operation;

2. Party A shall provide Party B with the above materials that meet the requirements of

in time. If the construction period is delayed due to Party A's tower crane mechanical equipment or power failure, Party A shall be responsible for it. (2) Responsibilities of Party B:

1. Party B must pay Party A a credit of 151,111 yuan in advance. (Party A will return it to Party B after the main building is capped)

2. Party B promises that it has the ability to pay 311,111 to 411,111 yuan.

3. Party B shall be responsible for the small tool mortar machine, mixer, hopper car, broom, internal frame erection, lights and wires for overtime lighting, and lighting other than the third-class electrical box, and transport vehicles for transferring materials in the field;

4. Be responsible for the labor and material costs of all construction machinery maintenance except tower crane.

5. Organize qualified labor to enter the site according to Party A's requirements, and strictly abide by the project rules and regulations;

6. Organize the construction in strict accordance with the construction drawings and the construction plan approved by Party A, and organize the labor, machines and tools to meet the requirements of the construction progress. And in accordance with the provisions, handle the relevant technical quality and information, after the completion of each working procedure must meet the requirements of construction progress. And handle relevant technical quality and data according to regulations. After each process is completed, it must be checked by Party A to meet the requirements agreed in the agreement before the next process can be constructed. 8. Party B shall strengthen the assessment of team management and select construction personnel with high quality and strong ability to organize the construction of this project;

9. Party B shall strictly implement the national laws and regulations on safe and civilized construction production and the safety production rules and regulations formulated by the project department;

11. Party B shall not subcontract this project to others, and the contractor must personally manage it on site and ensure that he will personally conduct it on site every day.

11. The operators of construction hanging baskets and derricks on the construction site shall be provided by Party B with employment certificates, and shall follow the arrangement of the Project Department. This fee has been included in the comprehensive unit price, and Party A is obliged to lift materials for other teams and groups.

12. If there is any inspection by the superior department, it shall be responsible for cleaning and cleaning the construction site in time.

VI. Engineering quality requirements

2. Party B must carefully construct the project in strict accordance with the current national construction specifications and the technical disclosure requirements of the project department, and the project quality must be qualified (excellent in actual measurement).

VII. Other agreements:

1. Party B promises not to apply for part-time work for all muddy water projects within the scope of design and construction drawings.

2. The personnel entering the site are not allowed to fight, steal and other violations. If there is any violation, they will be fined 1,111-2,111 yuan each time.

3. if party b violates the relevant time limit and quality stipulated in this agreement during the construction, resulting in fines and wage arrears for workers, party a has the right to deduct them from the wages. Party B shall implement the requisition system for construction materials according to the reasonable provisions of the project. Excess consumption shall be borne by Party B..

VIII. Liability for breach of contract: If Party B fails to carry out the construction according to the design drawings and national regulations and does not obey the instructions of the project department, Party A's project department has the right to impose a fine of 51-511 yuan/time.

1. Project quality: Party B is allowed to make rectification if the acceptance of single and sub-projects reaches the qualified standard during the construction process, but the rectification process cannot affect the construction period. If each sub-item fails to meet the qualified standards after repeated acceptance, Party A has the right to terminate the contract, and the quality of the completed project should be rectified to meet the requirements. The unit price after termination of the contract is calculated at 71%.

2. Time limit: If Party B fails to implement the time limit set by Party A without any reason and delays the time limit, it will be fined RMB 5,111 per day if it is overdue for more than 5 days; if it is overdue for more than 11 days, it will be fined RMB 5,111 per day.

3. during the construction, party b shall implement the national and local government regulations and the relevant safety construction regulations formulated by the project. if it violates the complete operation regulations and causes all safety accidents (except insurance compensation), party b shall bear all economic and legal responsibilities. 4. during the construction, party b shall cooperate with party a to do a good job of overall civilized construction, so as to clean up the site after the construction. if party b fails to cooperate with the cleaning up after the construction, party a shall send someone to clean up the project, and the expenses shall be borne by party B ..

5. Party B shall meet the requirements of the local government and hold relevant certificates, such as temporary residence permit, employment permit, birth permit, etc. Party B shall bear all the expenses for applying for the certificate, and shall not apply for the certificate in violation of the regulations, and all the responsibilities shall be borne by Party B..

6. If the construction is stopped due to Party A's reasons after entering the site for more than two months, Party A shall appropriately subsidize the living expenses of Party B's workers.

VI. Time limit requirements: Party B shall comply with the requirements of Party A's construction progress plan to arrange the construction, and cooperate closely unconditionally, and shall not delay the construction period for any reason, otherwise all losses caused shall be borne by Party B. The construction period shall be completed within 91 days after the main structure is capped, and a fine of RMB 2,111 yuan shall be imposed if the construction period is delayed for one day.

7. responsibilities of both parties:

2. Party B must arrange sufficient labor for construction according to the construction progress requirements of the Quartet. If the work stops or goes slow due to insufficient funds or construction strength, or the quality fails to meet the above requirements, Party A has the right to unilaterally terminate this contract without any doubt. All the previous investment of Party B in this contract will not be settled and returned as liquidated damages, and Party B's construction team must withdraw from the construction site within three days.

14. Party B shall strictly comply with the mandatory requirements for safety in production in the National Law on Safety in Production, relevant laws, regulations and national industry standards. Earnestly do a good job in production safety, and take

on-site management from the construction unit, supervision and Party A's construction and safety management personnel. In the event of a safety accident, all responsibilities shall be borne by Party B, not by Party A.. The fines imposed by Party B's construction personnel due to illegal operation or violation of factory regulations will be directly deducted from Party B's project payment, and Party B shall have no objection.

4. Party A only provides external scaffolding and passenger and cargo elevators. Other large machines and tools, such as mixers, vibrators and flat plates, personnel, mortar machines and internal frames, as well as auxiliary materials (such as plastering strips) and safety protection articles shall be borne by Party B..

⒌ Party B shall prefabricate and embed small components (such as lintels, beams, prefabricated blocks, etc.) in strict accordance with the design requirements of the drawings.

⒍When setting out the basement floor and foundation, Party B shall be responsible for sending two technicians to cooperate with the builder in setting out, and Party B shall be responsible for setting out details such as masonry, and the construction can only be started after the setting out is completed.

VIII. Contract unit price and payment method:

1. Calculation method: settlement shall be made according to the construction area calculation method and construction drawings stipulated by the state. ⒉ ? 3. Payment method:

(1) Party A shall pay the project payment according to the qualified quantities completed every month: main structure 21 yuan ∕㎡, masonry 32 yuan ∕, interior wall plastering 31 yuan ∕. ⑵. Pay 81% of the engineering quantity in the current month according to the monthly progress, 97% of the total project amount after the project is completed, and the remaining 3% is the project quality guarantee fund, which will be paid within one year after the project is completed and accepted.
