These regulations shall not apply to the construction activities carried out by citizens on their own homesteads. Article 3 The term "dust pollution on construction sites" as mentioned in these Regulations refers to the pollution to the atmospheric environment caused by dust particles generated in the process of building construction, reconstruction, expansion, repair and demolition, and storage, stacking and removal of building materials and construction waste. Article 4 The prevention and control of dust pollution on construction sites shall adhere to the principles of prevention first, source control, public participation and liability for damage. Article 5 The people's governments at all levels in this Municipality shall be responsible for the prevention and control of dust pollution in construction sites within their respective administrative areas, and incorporate the prevention and control of dust pollution in construction sites into the air pollution prevention and control plan, and establish a comprehensive prevention and control system for dust pollution.
According to the authorization of laws and regulations or the entrustment of relevant administrative departments, the Development Zone Management Committee is responsible for the prevention and control of dust pollution on construction sites within its jurisdiction. Sixth city, county (city, district) people's government urban management law enforcement departments for the urban planning area of the construction site dust pollution prevention and control work of the administrative department; Housing and urban-rural construction department is the administrative department in charge of dust pollution prevention and control of construction sites outside the urban planning area.
The ecological environment protection, public security, transportation, natural resources, planning and other departments of the people's governments of cities and counties (cities, districts) shall be responsible for the prevention and control of dust pollution on construction sites according to their respective responsibilities. Seventh construction site dust pollution prevention and control administrative departments should make full use of the information platform to implement online monitoring and video monitoring of construction site dust pollution, to achieve data interconnection and information sharing. Eighth to encourage and support relevant enterprises and industry associations to formulate and implement the construction site dust pollution prevention and control norms, strengthen self-discipline management. Ninth construction units shall comply with the following provisions:
(a) environmental impact assessment in accordance with the law, the construction project environmental impact assessment documents shall include the evaluation content and prevention measures of construction dust pollution;
(two) in the construction contract, the responsibility of the construction unit to prevent and control dust pollution is clearly defined, and the cost of dust pollution prevention and control is included in the project cost and paid in full and on time;
(three) to supervise the installation of supporting dust prevention facilities before the start of construction;
(four) the construction land that can not be started temporarily covers the bare ground, and is afforested, paved or covered for more than three months. Tenth construction units shall comply with the following provisions:
(a) to formulate the implementation plan for the prevention and control of construction dust pollution, and if it needs to be filed according to law, it shall be filed with the competent department in time;
(two) to ensure the normal operation of dust pollution prevention and control facilities, and shall not be dismantled or stopped without authorization;
(three) the implementation of dust pollution prevention measures, control dust pollution sources;
(four) the rational use of dust pollution prevention and control costs, to ensure earmarking;
(five) set up public signs for the prevention and control of dust pollution at the entrance and exit of the construction site, and publish information such as dust pollution prevention measures, relevant responsible persons and dust supervision and management departments;
(six) large and medium-sized construction sites should have full-time personnel responsible for the implementation and supervision of dust prevention measures. Each construction site should have a special person who is responsible for sealing, covering, sprinkling water and cleaning vehicles for dust-laden materials, garbage, muck and exposed land, and recording the implementation of dust control measures. Eleventh construction dust pollution prevention and control implementation plan shall include the following contents:
(a) the basic situation of the construction unit;
(two) the project name, construction site, construction scale and construction content;
(three) information on the person responsible for the prevention and control of dust pollution;
(four) the planned use of dust pollution prevention and control expenses;
(five) dust pollution prevention facilities and equipment, use regulations and related control measures. Twelfth construction units shall take the following dust prevention measures:
(a) around the construction site should be set up hard closed enclosure, the height of not less than 2.5 meters;
(two) the entrance to the construction site, construction roads, material stacking and processing areas, office areas and other areas should be hardened, green or solidified;
(3) Vehicle cleaning facilities and supporting drainage and mud sedimentation facilities shall be set in the entrance and exit of the construction site to prevent mud from overflowing. Vehicles should be washed before driving out of the construction site, and mud is not allowed on the road;
(four) according to the provisions of the route in and out of the site materials, muck, garbage transport vehicles, should be sealed to ensure no leakage;
(5) Earthwork and demolition works shall be carried out in sections, and dust suppression measures such as sprinkling water and spraying shall be taken;
(6) Materials that are prone to dust pollution such as cement, lime soil, sand and gravel, and engineering dregs piled on the construction site shall be covered tightly or stored in warehouses;
(seven) in the loading and unloading of cement, lime soil, sand and gravel, engineering residue, construction waste and other operations that are easy to produce dust, it should be closed or sprayed to prevent dust pollution;
(eight) the exposed ground on the construction site shall be covered with dust-proof net and dust-proof cloth, and regularly sprinkle water to suppress dust or carry out vegetation greening to prevent dust pollution;
(nine) it is forbidden to mix concrete and mortar on site in urban construction sites, and dust-proof devices should be installed in construction projects in other areas where mortar mixers are on site;
(10) During the construction period, a dense mesh dust-proof net or dust-proof cloth which can effectively suppress dust shall be set on the outside of the scaffold of the building structure on site;
(eleven) to clean up the ground construction waste, it should be sprinkled, sprayed, sealed and removed;
(12) The vertical transportation of materials, dregs or wastes shall be transported from elevator tunnels, internal pipes and closed pipes of buildings, or packed, and shall not be scattered in the air;
(thirteen) waste soil, waste and other construction waste generated in the construction should be removed in time. Stacked for more than a week, should be covered with dust net and dust cloth, and regularly spray dust to prevent wind erosion and water erosion migration;
(fourteen) other measures stipulated by laws and regulations.
