Measures for the administration of pollution prevention and control in Chongqing drinking water source protection areas

chapter I general provisions article 1 in order to prevent and control the pollution of centralized drinking water sources and protect human health, these measures are formulated in accordance with the law of the people's Republic of China on the prevention and control of water pollution and the regulations of Chongqing municipality on environmental protection. Article 2 These Measures shall apply to the prevention and control of pollution of surface water sources of centralized drinking water within the administrative area of this Municipality. Article 3 People's governments at all levels shall be responsible for the quality of drinking water sources within their respective jurisdictions, incorporate the prevention and control of pollution in drinking water source protection areas into the overall urban planning, comprehensive improvement of urban environment and water pollution prevention and control planning, and ensure that the water quality in drinking water source protection areas meets the prescribed standards. Article 4 Pollution prevention and control in drinking water source protection areas shall adhere to the principles of overall planning, rational layout, prevention first, combination of prevention and control, and comprehensive improvement. Article 5 The competent administrative department of environmental protection of the people's government at or above the county level shall exercise unified supervision and management over the drinking water source protection areas under its jurisdiction.

the relevant administrative departments of construction, municipal administration, public utilities, health, water conservancy, planning, ports and port supervision at all levels shall, according to their respective responsibilities, cooperate with the administrative department of environmental protection to supervise and manage the drinking water source protection areas. Chapter II Establishment of Protected Areas Article 7 Drinking water source protected areas are divided into first-class protected areas, second-class protected areas and quasi-protected areas. Article 8 the division of drinking water source protection areas in Chongqing urban section of the Yangtze River and Jialing River:

(1) The water area on the same side (bounded by the center of the river, the same below) from 211m upstream to 51m downstream of the water intake of the water plant is the first-class protection area;

(2) The water area on the same side of the water intake of the water plant is 211m to 1111m upstream and 51m to 111m downstream, which is the second-class protected area;

(3) The waters in the urban section outside the secondary protection zone shall prevail;

(4) The land areas of the first-class and second-class protected areas and quasi-protected areas of drinking water sources are the riverbanks corresponding to the corresponding waters, and the control elevation is the perennial flood level. Article 9 the division of drinking water source protection areas in cities and counties along the Yangtze river, Jialing river (except the urban section of Chongqing) and Wujiang river:

(1) the water area on the same side of the water intake of the water plant from 1111 meters upstream to 111 meters downstream is the first-class protection area;

(2) The water area on the same side of the water intake from 1111 meters to 2111 meters upstream and from 111 meters to 211 meters downstream of the water intake is the second-class protected area;

(3) The waters in the urban section outside the secondary protection zone shall prevail;

(4) The land areas of the first-class and second-class protected areas and quasi-protected areas of drinking water sources are the riverbanks corresponding to the corresponding waters, and the control elevation is the perennial flood level. Article 11 The division of other drinking water source protection areas shall be put forward by the district, city and county environmental protection administrative department in conjunction with the administrative departments of construction, health and water conservancy in accordance with the relevant provisions, and implemented after being approved by the district, city and county governments, and reported to the municipal environmental protection administrative department for the record. Eleventh municipal public water supply units of drinking water source protection areas, signed by the local environmental protection administrative department, the municipal environmental protection administrative department for approval. The establishment of drinking water source protection areas for other water intake units shall be approved by the competent administrative department of environmental protection of cities and counties in the local area. Twelfth approved drinking water source protection areas must be set up with unified signs.

Chapter III Prevention and Control of Pollution Article 13 The water quality of the first-class protection zone for drinking water sources shall not be lower than the Class II standard stipulated by the state (GB 3838-88 "Environmental Quality Standard for Surface Water");

the water quality of the secondary protection zone of drinking water source shall not be lower than the Class III standard stipulated by the state (GB 3838-88 "Environmental Quality Standard for Surface Water");

in principle, the water quality of drinking water source quasi-protected areas shall be controlled according to Class III standard (GB 3838-88 "Environmental Quality Standard for Surface Water"). Article 14 The following provisions must be observed in the drinking water source protection areas:

(1) The vegetation in the drinking water source protection areas shall not be destroyed;

(2) industrial waste residue, domestic garbage, excrement and other wastes shall not be dumped;

(3) Vessels and vehicles transporting toxic and harmful substances, oils and feces must be equipped with anti-seepage, anti-overflow and anti-leakage facilities, and shall not engage in activities that pollute drinking water sources and endanger the water quality of water intakes;

(4) Do not use highly toxic pesticides, and do not use explosives or drugs for fishing.

(5) The position of sewage discharge channel shall not be changed without authorization, which will affect the water quality of water intake. Article 15 The following acts are prohibited in the first-class protected areas of drinking water sources:

(1) discharging industrial sewage and domestic sewage into water areas;

(2) stacking waste residue, garbage and other harmful substances;

(3) setting up oil depots, docks and berthing ships unrelated to water supply;

(4) stocking livestock and cage culture;

(5) engaging in other activities that pollute water sources. Article 16 The following provisions must be observed in the second-class protected areas of drinking water sources:

(1) No new construction projects or expansion projects that discharge sewage into water areas are allowed, and the pollutant discharge of reconstruction projects must be reduced as required;

(2) The original sewage outfalls must reduce sewage discharge and pollutant discharge;

(3) docks for loading and unloading garbage, excrement, oil and toxic substances shall not be set up;

(4) No aquatic catering and entertainment facilities shall be set up.
