Chapter I General Principles
Article 1 In order to further promote the expansion of consumer demand, improve the utilization efficiency of resources and energy, reduce environmental pollution, and promote the development of energy conservation and emission reduction and circular economy, according to the Letter of the Ministry of Finance, the Ministry of Commerce and the Ministry of Environmental Protection on Printing and Distributing the Work Plan for Promoting Household Appliances Trade-in (Guo Shui Fa [2065 438+00] 190) and the Implementation Measures for Printing and Distributing Household Appliances Trade-in, Ministry of Commerce, Ministry of Industry and Information Technology, Ministry of Environmental Protection, Inspection and Quarantine (Shang Shang Fa [2010] No.231) Article 2 The term "trade-in of household appliances" as mentioned in these Measures refers to the behavior of consumers to trade-in old household appliances. Article 3 The implementation period of the trade-in policy for household appliances is tentatively set at 201September 10 to 2011February 3 1. In the meantime, we should do a good job in connection with the policy of setting up a fund for the treatment of waste electrical and electronic products stipulated in the Regulations on the Management of Recycling and Treatment of Waste Electrical and Electronic Products (the State Council Decree No.5565438 +0). Article 4 The principle of "simple procedures, direct subsidies, safety, high efficiency, energy saving and environmental protection" shall be followed in exchanging old household appliances for new ones. Chapter II Subsidy Policy Article 5 Subsidy methods and objects: 1. Where during the implementation of "trade-in of household appliances" in our district, legal entities registered in Xinjiang Autonomous Region (including Corps) or individuals with household registration in Xinjiang Autonomous Region (hereinafter referred to as buyers) sell old household appliances and buy new ones from enterprises that have won the bid for home appliance sales, they can enjoy subsidies for home appliances when buying new ones. Units and individuals that sell old household appliances and buy new ones must be consistent. New home appliances that have enjoyed the subsidy policy of "home appliances going to the countryside" may not enjoy the old-for-new subsidy repeatedly.
2. During the implementation of the policy, the successful home appliance recycling enterprise (hereinafter referred to as the recycling enterprise) that buys old home appliances from buyers and sells them to the designated dismantling enterprise for dismantling can enjoy the freight subsidy. 3. Dismantling enterprises can enjoy dismantling subsidies if they dismantle old household appliances sold by buyers during the policy implementation period. 4. During the implementation of the policy, the total number of new household appliances purchased by individuals shall not exceed 5; Units to buy new home appliances, the total does not exceed 50 units. The purchase of new household appliances is not subject to the corresponding restrictions on the varieties of old household appliances sold. Article 6 Subsidies for replacing old appliances with new ones include televisions, refrigerators (including freezers), washing machines, air conditioners and computers.
Article 7 The subsidy standard is: 1. Subsidies for home appliances. Units or individuals that sell old household appliances and buy new ones will be subsidized at 10% of the sales price of new household appliances after being audited by the successful sales enterprise. The maximum subsidy is: TV 400 yuan/TV, refrigerator (including freezer) 300 yuan/TV, washing machine 250 yuan/TV, air conditioner 350 yuan/TV and computer 400 yuan/TV. 2. Freight subsidy. Successful home appliance recycling enterprises can enjoy freight subsidies when they buy old home appliances and sell them to designated home appliance dismantling and processing enterprises during the policy implementation period. Freight subsidies are determined according to the types, specifications and transportation distance of recycled old household appliances. (See Annex 1 for specific subsidy standards). Simple recycling enterprises determined by Xinjiang (including Corps) bidding shall be implemented in accordance with the Supplementary Notice of the Ministry of Finance on Freight Subsidies for Household Appliances Trade-in (Cai Jian [2010] No.44); Other related matters are still implemented according to the relevant provisions of the Ministry of Finance's Measures for Freight Subsidies for Household Appliances Trade-in (Cai Jian [2009] No.498) document.
3. Dismantling subsidy: During the implementation of the policy, dismantling enterprises take 30 working days as a settlement period, and each settlement period will be given a fixed subsidy according to the actual amount of dismantling. The specific subsidy standards are: TV 15 yuan/Taiwan, refrigerator (including freezer) 20 yuan/Taiwan, washing machine 5 yuan/Taiwan, computer 15 yuan/Taiwan; Air conditioning is not subsidized.
Eighth, new household appliances should meet the requirements of relevant national safety and environmental protection standards. Chapter III Operation Process
Article 9 Household appliance sales enterprises and recycling enterprises shall be determined by the Department of Commerce of the Autonomous Region and the Bureau of Commerce of the Corps in conjunction with the Department of Finance of the Autonomous Region and the Bureau of Finance of the Corps through bidding, and dismantling enterprises shall be determined by the Environmental Protection Department of the Autonomous Region and the Environmental Protection Bureau of the Corps. The bidding and EIA results are reported to the Ministry of Commerce, the Ministry of Finance and the Ministry of Environmental Protection for the record, and the list and contact information of the successful home appliance sales and recycling enterprises are announced to the public.
Article 10 Buyers choose recycling enterprises. Buyers voluntarily choose the way of recycling first and then purchasing or purchasing first and then recycling, and apply for the sale of old household appliances through the internet, telephone, etc., so that recycling enterprises can purchase old household appliances in time; Or the buyer buys new home appliances first, and the win-win enterprise of home appliance sales recycles old home appliances while distributing new home appliances to the buyer. For those who meet the requirements, the home appliance sales enterprises timely collect the relevant information of the buyers, cash the subsidy funds that the buyers should enjoy, complete the advance payment of the subsidy funds, and replace the home appliance sales invoices with the old-for-new certificates formulated by the state. No unit or individual may transfer or sell the old-for-new certificate of household appliances and obtain financial subsidies. The recycling enterprise shall timely and accurately enter all the information of the certificate of household appliances trade-in, including the category, brand, product manufacturer, model and number of the recycled household appliances, the name and ID number of the purchaser, the recycling price of the used household appliances and the number of the certificate of household appliances trade-in, and paste the serial number generated by the system on the old household appliances without the serial number of the body. Article 11 The main parts and components of recycled old household appliances shall be complete and sold in strict accordance with the standards in Annex 3 of these Rules, otherwise the recycling or dismantling enterprise may refuse to accept them as appropriate. (See Annex 2) Article 12 The buyer chooses the winning sales enterprise, and buys new home appliances from the home appliance sales enterprise with valid identity documents and home appliance trade-in certificate. For those who meet the requirements, home appliance sales enterprises directly advance subsidy funds to buyers when selling new home appliances, and input relevant information into the home appliance trade-in management information system. Thirteenth old household appliances purchased by recycling enterprises should be sold to the designated dismantling enterprises for dismantling. To meet the requirements, the dismantling and processing enterprise shall pay transportation subsidies to the recycling enterprise in advance, and input the relevant information into the management information system of household appliances trade-in. Article 14 A household appliance sales enterprise shall apply for subsidy funds from the financial (financial) department at the same level with the sales invoices of new household appliances, trade-in vouchers and the Declaration Form of Subsidy Funds for Trade-in of Household Appliances (Household Appliances) and other materials after being audited by the competent commercial departments of the city, county and regiment. Article 15 Dismantling enterprises shall, according to the settlement cycle, apply for prepaid freight subsidies and dismantling subsidies to the financial (service) departments at the same level with the old-for-new vouchers, the application form for old-for-new (freight) subsidies for household appliances, the application form for old-for-new (dismantling) subsidies for household appliances and other materials, after being audited by the environmental protection departments of the cities, counties and regiments. Sixteenth refer to the recycling and dismantling prices of old household appliances in nine pilot provinces and cities, combined with the actual situation in Xinjiang, and formulate the recycling and dismantling prices of old household appliances in our region (see Annex 2). Chapter IV Household Appliance Recycling Enterprises Article 17 In order to facilitate buyers to sell old household appliances, the recycling of old household appliances adopts diversified recycling methods. Household appliance manufacturers (after-sales service agencies), sales enterprises, professional recycling enterprises, etc. You can participate in the bidding activities of home appliance recycling enterprises organized by the Department of Commerce of the autonomous region and other relevant departments. Article 18 The household appliance recycling enterprises determined by bidding shall have corresponding service capabilities and good reputation, and meet the following basic conditions: 1. There are recycling outlets with reasonable layout and wide coverage; 2. Recycling outlets have the ability to record and check the information related to household appliances trade-in through the trade-in management information system; 3. There are storage places that meet the requirements of environmental protection and sufficient transportation support capacity; 4. There are trained recycling personnel with certain professional and technical knowledge; 5. Good commercial credit status in the past three years. Article 19 The Department of Commerce of the Autonomous Region and the Bureau of Commerce of the Corps shall report the recycling enterprises and qualified recycling outlets to the Ministry of Commerce and the Ministry of Finance for the record. Local competent commercial departments guide recycling enterprises to apply to the local administrative department for industry and commerce to increase the business scope of renewable resources recycling, and apply to the local competent commercial department for the record of renewable resources enterprises, and standardize their operations in accordance with the provisions of the Measures for the Administration of Renewable Resources Recycling. Recycling enterprises that meet the requirements stipulated in the Notice of the Ministry of Finance of State Taxation Administration of The People's Republic of China on the VAT Policy for Renewable Resources (Caishui [2008]157) can enjoy relevant preferential VAT policies. Article 20 A recycling enterprise shall sign a commitment agreement, pay a performance bond, ensure the timely purchase of old household appliances sold by buyers at the price stipulated in these Measures, standardize the issuance of certificates for exchanging old household appliances for new ones, inspect and recycle old household appliances in strict accordance with relevant regulations, sell all the recovered old household appliances to designated dismantling and processing enterprises, and do not resell the certificates for exchanging old household appliances for new ones, dismantle and treat old household appliances without authorization, engage in fraud, and engage in illegal activities such as selling old household appliances for new ones. Chapter V Household Appliance Sales Enterprises Article 21 Professional household appliance chain sales enterprises, comprehensive large-scale retail enterprises and household appliance production enterprises (sales organizations) may participate in the bidding activities of household appliance trade-in sales enterprises organized by the Department of Commerce of the autonomous region and other departments. Article 22 The sales enterprise determined by bidding shall have strong strength, good reputation and sound sales network, and meet the following basic conditions: 1. Sales outlets cover a wide range, and Xinjiang sales enterprise outlets cover the county (regiment) level; 2. Sales outlets have the ability to record and check the information related to the trade-in of household appliances through the trade-in management information system; 3. Strong warehousing and distribution capabilities; 4. Have a perfect after-sales service system for home appliances delivery, installation, debugging and maintenance; 5. Good commercial credit status in the past three years. Twenty-third successful sales enterprises shall sign a commitment agreement and pay a performance bond to ensure the sale of new household appliances at normal market prices, strictly control the purchase of goods, and prevent counterfeit and shoddy products from entering the market. Chapter VI Dismantling and Disposal Enterprises Article 24 According to the principle of rational distribution and centralized disposal, the environmental protection departments of the autonomous region and the Corps shall jointly determine the dismantling and disposal enterprises and military and civilian enterprises. Non-fixed-point dismantling and processing enterprises shall not buy and process old household appliances with old ones for new ones. Article 25 The dismantling enterprise shall meet the requirements of relevant national laws and regulations on environmental protection and meet the following basic conditions: 1 Independent legal entities listed in the list of electronic waste dismantling, utilization and disposal units (including temporary list) according to the Administrative Measures for the Prevention and Control of Environmental Pollution by Electronic Waste (Order No.40 of the former State Environmental Protection Administration), excluding individual industrial and commercial households; 2. Having management and technical personnel related to environment, quality and safety; 3. It has related facilities and equipment such as classification, packaging, storage, and dismantling that are suitable for the dismantling of old household appliances; 4. Old household appliances and their disassembled products that cannot be treated in depth should be properly utilized or disposed of; 5. Have the ability to record and check the data of dismantling and processing old household appliances through the management information system of household appliances trade-in; Establish a record book system for the operation of old household appliances; 6. It has not been punished by the environmental protection department in the past three years. Article 26 The dismantling enterprise shall sign a commitment agreement and pay a performance bond, and purchase the used household appliances sold by the recycling enterprise at the dismantling price determined in these Measures, so as to ensure that the used household appliances sold by the recycling enterprise will not be rejected without reason, and the purchased used household appliances will not be circulated again, and they will not engage in illegal activities such as exchanging old appliances for new ones and manufacturing and selling old household appliances. The dismantling enterprise shall complete the dismantling within the time limit prescribed by the local environmental protection administrative department. Dismantling enterprises shall, in principle, complete dismantling within 60 working days after receiving old household appliances. Twenty-seventh dismantling enterprises should set up a video monitoring system before 20 10 10 3 1 to supervise all key areas such as import and export, dismantling and storage 24 hours a day. The dismantling plant should have only one entrance and one exit. Article 28 A dismantling enterprise shall set up a signboard in a prominent position in the factory to publicize the daily reception, dismantling and storage of old household appliances, and report the reception, dismantling and storage to the local environmental protection administrative department for the record every 15 days. The original vouchers related to the receipt, disassembly and storage of old household appliances shall be properly kept for future reference. Chapter VII Declaration, Examination and Payment of Subsidy Funds I. Subsidies for household appliances
Twenty-ninth buyers to sell old household appliances, should obtain a unified national certificate of household appliances from recycling enterprises. The recycling enterprise shall indicate the product brand, specification, model, fuselage number, buyer's name and ID number of old household appliances on the trade-in certificate. Thirtieth buyers directly declare home appliance subsidies when purchasing new home appliances. 1. The purchase subsidy shall be paid by the home appliance sales enterprise to the purchaser in advance, and an application for subsidy settlement shall be submitted to the local financial (service) department. Sales enterprises that have won the bid in the autonomous region, home appliance trade-in sales enterprises (sales outlets) established within the jurisdiction of prefecture, prefecture, city and county, which have passed the examination and filing, sign a settlement agreement on prepaid subsidies with the local financial department, and the outlets directly advance to the local financial department that signed the settlement agreement on prepaid subsidies. 2. Corps headquarters (including Shihezi, Aral, Wujiaqu, Tumushuke) set up in the area under the regimental farm and passed the audit of home appliance trade-in sales enterprises (sales filing outlets), and signed an agreement on settlement of prepaid subsidies with the Corps Division and the Corps financial department according to the principle of proximity, and the financial department was responsible for accepting the settlement of subsidies from local or Corps qualified purchasers. For those who meet the subsidy conditions, the sales enterprises (sales record outlets) will issue invoices to the buyers according to the sales price, instruct the buyers to fill out the Declaration Form of Subsidy Funds for Home Appliances Trade-in (household appliances), pay the subsidy funds on the spot, and collect the payment according to the normal sales price of new home appliances minus the subsidy amount. If it does not meet the subsidy conditions, it shall immediately inform the buyer and collect the payment according to the sales price. Article 31 The information that the buyer should provide when declaring subsidies: (1) Trade-in voucher; (2) invoices for purchasing new household appliances; (3) "Home Appliances Trade-in (Home Appliances) Subsidy Fund Declaration Form"; (four) the identity card of the purchaser or the relevant certificates of the relevant legal entity. Thirty-second home appliance sales enterprises (sales record outlets) organize the application materials of buyers once every two months, and apply for home appliance subsidies to the financial (service) departments at the same level after being audited by the local commercial departments. The financial (service) department shall complete the subsidy examination and confirmation within 7 working days after receiving the declaration, and directly pay the approved subsidy funds to the basic account opened by the household appliance sales enterprise (sales filing outlet) in the bank through centralized payment from the state treasury. If there is any doubt about the application materials, it shall inform the home appliance sales enterprises to make amendments and supplements. Financial (financial) and commercial departments at all levels should strengthen the supervision and inspection of subsidies issued by home appliance sales enterprises to prevent fraudulent subsidies. Two. Freight subsidy Article 33 The dismantling and processing enterprise shall review and recycle the freight subsidy materials declared by the enterprise. If the materials meet the requirements, the prepaid freight subsidy shall be calculated according to the corresponding number of old household appliances. Thirty-fourth recycling enterprises directly declare freight subsidies according to the actual number of used household appliances sold, which will be audited by dismantling and processing enterprises. To meet the requirements, direct payment of freight subsidies, and guide recycling enterprises to fill out the "Application Form for Home Appliances Trade-in" (freight subsidies). Do not meet the requirements of subsidies, should immediately inform the recycling enterprises. Article 35 The materials that recycling enterprises should provide when applying for subsidies are: (1) trade-in certificate; (2) Sales invoice of used household appliances; (3) Home appliance trade-in (freight) subsidy declaration form. Thirty-sixth dismantling enterprises shall sort out and recycle the application materials of enterprises on a monthly basis, and apply for freight subsidies to the finance (service) department at the same level after being audited by the local environmental protection department. The financial (service) department shall conduct examination and confirmation within 7 working days after receiving the declaration, and directly pay the subsidy funds to basic account, where the household appliance dismantling and processing enterprise is established in the bank, through centralized payment from the state treasury.
Three. Dismantling subsidies Article 37 Dismantling enterprises shall make monthly statistics on the varieties and quantities of dismantled old household appliances, fill out the Application Form for Dismantling Subsidies for Household Appliances Trade-in, and apply for subsidy funds from the financial (financial) department at the same level after being audited by the local environmental protection department. After examination and confirmation by the financial (service) department, the subsidy funds will be directly allocated to the basic account opened by the dismantling and processing enterprise in the bank. Article 38 When applying for dismantling subsidies, dismantling enterprises shall provide the following information: (1) Application Form for Dismantling Subsidies for Household Appliances Trade-in; (2) Certificate of trade-in of household appliances; (3) Sales invoice of used household appliances issued by household appliance recycling enterprises (with purchase list attached); (4) Dismantle the prepaid freight voucher of the enterprise (with freight receipt); (5) Disassembly record form and sales certificate or disposal certificate of disassembled products. Thirty-ninth dismantling enterprises should check the old household appliances purchased one by one, and the information such as product category, specification and model provided by the old-for-new certificate and the old-for-new household appliances management information system should be consistent. If the audit is inconsistent, the dismantling subsidy shall not be declared. According to the requirements of the competent department of environmental protection, the dismantling of old household appliances should be completed within the specified time, and it is not allowed to trade old appliances for new ones. Fortieth local environmental protection departments at all levels should strengthen the preliminary examination of the subsidy declaration form of dismantling and processing enterprises, and review whether the old household appliances have been dismantled, whether the processing procedures are in line with the regulations, and the direction of dismantled products. It is necessary to strengthen the supervision and management of dismantling and processing enterprises in conjunction with the financial department, establish a regular verification system, prevent fraud, false reporting and other acts, and ensure the safety of financial funds. Chapter VIII Sources, Appropriation and Liquidation of Subsidy Funds Article 41 The subsidy funds for replacing old household appliances in Xinjiang shall be fully borne by the central finance. The management and use of subsidy funds follow the principles of openness, transparency, targeted use and dynamic supervision. After the central subsidy funds are in place, the Finance Department of the autonomous region and the Finance Bureau of the Corps will issue the subsidy funds budget step by step through transfer payment. State, prefecture and municipal finance bureaus, corps divisions and regimental finance bureaus adopt centralized payment from the state treasury when specifically settling subsidy funds.
Forty-second subsidy funds shall be paid by the state treasury in accordance with the relevant provisions of special transfer payment. Article 43 In the process of implementing the trade-in policy for household appliances, when there is a gap in subsidy funds, the financial department of the autonomous region will advance the gap in central financial subsidy funds and return it after the central financial subsidy funds are in place. Chapter IX Organizing and Implementing the Division of Duties
Article 44 The Autonomous Region shall set up a leading group for the trade-in of household appliances, headed by the vice chairman in charge, with the participation of the Department of Commerce, the Department of Finance, the Department of Environmental Protection, the Propaganda Department of the Party Committee of the Autonomous Region, the Development and Reform Commission of the Autonomous Region, the Economic and Information Commission of the Autonomous Region, the Industrial and Commercial Bureau of the Autonomous Region, the Quality Supervision Bureau of the Autonomous Region, the Bureau of Commerce of the Corps, the Finance Bureau of the Corps and the Environmental Protection Bureau of the Corps. According to their respective responsibilities and the provisions of these Rules, the office of the leading group is located in the Department of Commerce of the Autonomous Region
Article 45 The Department of Commerce of the Autonomous Region and the Bureau of Commerce of the Corps shall, jointly with the Department of Finance of the Autonomous Region and the Bureau of Finance of the Corps, strengthen the supervision of enterprises and outlets that win the bid for recycling sales, do a good job in publicity and training, and ensure the smooth development of household appliances. It is necessary to give full play to the function of the "123 12" complaint service center, set up complaint telephones and mailboxes, accept complaints from consumers and enterprises, strengthen market supervision in conjunction with the departments of industry and commerce, quality and technical supervision, and severely crack down on illegal acts such as counterfeiting.
Forty-sixth local, prefecture, city, county, corps division, regimental farm commercial departments should set up a complaint telephone number and mailbox to receive reports and complaints. After receiving reports and complaints from recycling and sales enterprises within their jurisdiction, they shall, together with relevant departments, find out the facts and deal with them within 15 working days; It is necessary to establish a publicity system and give play to the role of mass supervision. Illegal information and complaint handling of sales outlets shall be announced to the public through the network and media.
Article 47 The Finance Department of the Autonomous Region and the Finance Bureau of the Corps shall timely implement the central financial subsidy funds. Financial (service) departments at all levels shall, according to the implementation of the old-for-new household appliances policy, properly arrange the necessary working funds for strengthening business expenses such as policy propaganda, business training, supervision and inspection of sales outlets, publicity and necessary equipment purchase.
Article 48 The Environmental Protection Department of the autonomous region shall strengthen the supervision and management of household appliance dismantling enterprises, guide enterprises to carry out the dismantling of discarded household appliances with old ones for new ones, implement the dismantling tasks, and guide environmental protection departments at all levels to supervise the dismantling of household appliances.
Article 49 The Propaganda Department of the Party Committee of the Autonomous Region, the Department of Commerce of the Autonomous Region, the Department of Finance of the Autonomous Region, the Environmental Protection Department of the Autonomous Region, the Bureau of Commerce of the Corps, the Finance Bureau of the Corps, the Environmental Protection Bureau of the Corps and other departments are responsible for organizing the policy publicity and training of the corresponding business of "trade-in" of household appliances.
Fiftieth Autonomous Region Economic and Information Committee shall strengthen the management of household appliances production and assembly enterprises in our region, supervise and guide the production enterprises to improve and ensure the quality of household appliances.
Article 51 The administrative departments for industry and commerce at all levels in our district shall standardize the qualifications and business practices of household appliances sales enterprises, recycling enterprises and second-hand household appliances markets according to law, and investigate and ban unlicensed business practices. It is necessary to intensify the investigation and punishment of selling fake and shoddy goods in the process of "trade-in" household appliances, and severely crack down on trademark infringement, counterfeiting and other acts; Strengthen the supervision of the second-hand household appliances market and severely crack down on illegal activities such as replacing old household appliances with new ones.
Article 52 Give full play to the "123 15" administrative law enforcement system of the industrial and commercial departments and the role of the Consumer Rights Protection Committee (Consumer Association), promptly accept and handle the complaints and reports of consumers on "trade-in" of household appliances according to law, and earnestly safeguard the legitimate rights and interests of consumers.
Fifty-third quality supervision departments at all levels in our district should strengthen the product quality supervision of home appliance manufacturers. For enterprises whose products have potential safety hazards and may cause damage to human health and life safety, the quality supervision department shall order the production enterprises to recall relevant products, investigate and deal with them according to law and announce them to the public in a timely manner.
Fifty-fourth autonomous region development and Reform Commission shall strengthen the supervision of the sales price of household appliances "trade-in" products according to law; In conjunction with commerce, finance, environmental protection and other departments, formulate and publish the recycling and dismantling price of old household appliances in our district.
Fifty-fifth local, state, city and county governments, corps divisions and regiments should refer to the working mechanism of the autonomous region, and set up a leading group to deal with the daily affairs of household appliances.
Fifty-sixth the establishment of household appliances trade-in work reporting system, all member units should be "trade-in" work progress and new situations and new problems in the implementation process, timely report to all levels of household appliances trade-in work leading group office.
Chapter IX Supervision and Management Article 57 If a sales enterprise that wins the bid commits any of the following acts, it will be punished by withholding the deposit, suspending or canceling the qualification of winning the bid of "replacing old appliances with new ones". The decision on punishment shall be made and announced by the Department of Commerce of the Autonomous Region and the Bureau of Commerce of the Corps jointly with the Department of Finance of the Autonomous Region and the Bureau of Finance of the Corps.
1. Failing to fulfill the bid commitment and bid-winning agreement, with outstanding sales and service problems;
2. Selling fake and inferior commodities, making false propaganda and harming consumers' interests;
3. In violation of the relevant provisions of the Measures for the Administration of Retailers and Suppliers, taking advantage of the bid-winning qualification of "exchanging old appliances for new ones", maliciously deducting the payment for goods, depressing the payment for goods or harming the interests of suppliers in other ways;
4. In violation of the relevant provisions of the Measures for the Administration of Retailers' Promotion, conduct false promotion, fail to put on record on schedule, shoddy and other acts that harm the interests of consumers;
5. Fictitious relevant certificates to defraud financial subsidy funds;
6. Failing to report relevant data in time as required by the commercial department.
Fifty-eighth sales enterprises belong to the following acts, the local competent department of commerce shall immediately order them to make corrections within a time limit; If it fails to make corrections within the time limit, the local competent department of commerce shall suspend its qualification of sales outlets, and if it still fails to meet the requirements after rectification, it shall cancel its qualification of "trade-in" sales outlets for household appliances:
1. There are no promotional materials and explanations about "trade-in" of household appliances in the store;
2. In violation of the "three guarantees" provisions of the state household appliances, the after-sales service fails to meet the relevant requirements, and the service is delayed for various reasons;
3. False propaganda in the process of "trade-in" of household appliances, misleading consumers;
4. Restrict the buyer's freedom of consumption for various reasons, such as restricting the buyer's choice of brands and requiring the buyer to show the "trade-in" certificate in advance;
5. The sale of new household appliances is not clearly marked according to the regulations, or the old-for-new buyers are treated differently from other ordinary consumers in the sales price, which harms the interests of buyers;
6 does not meet the "trade-in" bid for home appliance outlets for the record related conditions.
Fifty-ninth in the process of selling "old-for-new" products of household appliances, the losses caused to consumers by the bad behavior of sales outlets shall be borne by the relevant successful sales enterprises.
Article 60 If a recycling enterprise commits one of the following acts, it will be punished by suspending or canceling the qualification of winning the bid for "replacing old appliances with new ones". The decision on punishment shall be made and announced by the Department of Commerce of the Autonomous Region and the Bureau of Commerce of the Corps jointly with the Department of Finance of the Autonomous Region and the Bureau of Finance of the Corps.
1. The bid-winning recycling enterprise fails to purchase or reject waste household appliances at the public price stipulated in these Measures without justifiable reasons, and has been reported and verified for more than two (inclusive) violations;
2. Failing to establish the archives of waste household appliances, the commerce department shall order it to make corrections within a time limit;
3. The issuance of "trade-in" vouchers is not standardized, which damages the interests of buyers or disrupts the work progress of "trade-in";
4. Failing to sell all the old household appliances to the designated dismantling and processing enterprises according to the regulations, or dismantling and processing the old household appliances and core components without authorization, and engaging in illegal activities such as trading in old ones for new ones;
5. Other acts violating the market economic order.
Article 61 If an dismantling enterprise commits one of the following acts during the policy implementation period, the Environmental Protection Department of the autonomous region, the Environmental Protection Bureau of the Corps, the Finance Department of the autonomous region and the Finance Bureau of the Corps will cancel its qualification as a designated enterprise for dismantling and treating used household appliances.
1. Violation of laws and regulations related to environmental protection for more than two times (inclusive);
2. Refuse to recycle old household appliances sold by enterprises without justifiable reasons;
3. Take advantage of market monopoly to maliciously depress the recycling price of old household appliances, which harms the interests of recycling enterprises and buyers and affects the promotion of the "trade-in" policy;
4. Failing to do a good job of recycling and dismantling old household appliances in accordance with the regulations, or circulating the recycled old household appliances into the second-hand market;
5. Forge relevant vouchers to defraud financial subsidy funds.
Sixty-second home appliances "trade-in" business entities (including sales, recycling and dismantling enterprises) have the following acts in violation of laws and regulations related to commodity production and operation, and the industrial and commercial and quality supervision departments at all levels shall give administrative penalties according to their duties:
1. Use the winning bid or the designated enterprise to engage in acts that violate the market economic order, such as bullying the market, industrial monopoly or unfair competition;
2. Producing and selling fake and inferior commodities and making false propaganda, which harms the interests of consumers;
3. Dismantle and assemble waste household appliances without authorization, and renovate old household appliances into the second-hand market;
4. Other acts in violation of relevant laws and regulations on product production and circulation.
Sixty-third household appliances "trade-in" business entities (including sales, recycling and dismantling enterprises) have the following acts, and the competent price departments at all levels shall give administrative penalties according to law:
1. Not clearly marked as required;
2. Using false or misleading pricing methods and means to conduct price fraud;
3. Other acts in violation of price laws and regulations.
4. Failing to set the recycling and dismantling price of old household appliances in accordance with regulations during the implementation of "trade-in" of household appliances;
Sixty-fourth household appliances "trade-in" business entities (including sales, recycling and dismantling enterprises) to defraud the "trade-in" financial subsidy funds, according to the "Regulations on Punishment of Financial Violations" (the State Council Decree No.427th).
Chapter X Supplementary Provisions
Article 65 These detailed rules will be revised and improved according to the new national regulations on the trade-in of household appliances or the actual needs in the implementation process.
Article 66 These Rules shall come into force as of the date of promulgation.
Article 67 The Bureau of Commerce, the Finance Department, the Environmental Protection Department, the Economic and Information Commission, the Development and Reform Commission, the Administration for Industry and Commerce, the Quality Supervision Bureau, the Bureau of Commerce, the Finance Bureau and the Environmental Protection Bureau of the Corps shall be responsible for the interpretation of these Detailed Rules according to their respective responsibilities.

4. Washing machine: the shell, inner container or drum, motor and other main components are complete;
5. Computer: monitor, chassis, power supply, motherboard, CPU, memory stick and other major components are complete.
