Legal analysis: At present, the subject of supervision has not been clearly defined in laws and regulations. After consulting relevant information, the regulations on urban gas management, the law on safety of special equipment, and the regulations on safety inspection of gas cylinders of the General Administration of Quality Supervision, Inspection and Quarantine did not clearly define the division of labor for the daily supervision and investigation of the use of civil gas cylinders. In practical work, all functional departments only have the power to enforce the law on gas enterprises or enterprises and individuals who illegally operate or fill gas, but there is no clear regulation on the irregular use of gas by small restaurants and residents, that is to say, the supervision of various departments does not extend to the use of gas. However, in 2117, the government of Shibei District of Qingdao issued the Measures for Post-event Supervision of Small Restaurants, Small Hotels and Old-age Care Institutions in Shibei District (Trial), which stipulated that the daily safety supervision of gas use should be divided into district comprehensive law enforcement bureaus, including reporting or investigating acts such as operating gas without authorization and failing to inspect gas facilities and gas burning appliances as required. Divide the daily safety supervision of gas cylinders into the district market supervision administration, including reporting or investigating the illegal filling of gas cylinders and the use of unqualified cylinders.
Legal basis: According to Article 85 of the Law of the People's Republic of China on Safety of Special Equipment, in violation of the provisions of this Law, the mobile pressure vessel and gas cylinder filling unit shall be ordered to make corrections and be fined between 21,111 yuan and 211,111 yuan; If the circumstances are serious, the filling license shall be revoked: (1) failing to implement the inspection and recording system before and after filling in accordance with the regulations; (2) filling mobile pressure vessels and gas cylinders that do not meet the requirements of safety technical specifications. Article 26 of the Measures for Post-event Supervision of Small Restaurants, Small Hotels and Old-age Care Institutions in Shibei District (Trial) stipulates that the District Comprehensive Administrative Law Enforcement Bureau shall conduct daily inspection and supervision of the following situations in the safety of small catering gas, and report to the higher authorities or investigate and deal with them according to law if necessary: (1) In violation of regulations, use gas provided by units or individuals that have not obtained gas business licenses; In the inspection, the inspectors found that the unit or individual operated the gas without permission, and reported it or investigated it together; (2) stealing gas; (3) storing and using bottled gas in high-rise buildings, basements, semi-basements and poorly ventilated places and other places that do not have safe use conditions, or using bottled gas to directly heat food in dining areas; (4) Failing to install combustible gas concentration detection and alarm devices in gas use places and gas storage places according to regulations; (5) illegal installation of gas facilities, closed, destroyed or unauthorized removal, relocation and transformation of gas facilities; (6) stacking and hanging articles with gas facilities as load-bearing supports, or using gas pipelines as grounding conductors of electrical facilities; (7) installing and using unqualified gas burning appliances, or installing and using gas burning appliances that have been explicitly eliminated; In the inspection, inspectors found that units or individuals illegally installed, sold and maintained gas burning appliances, and reported them or investigated them together; (8) Failing to accept the regular safety inspection of gas facilities and gas burning appliances by gas business units in accordance with regulations; In the inspection, the inspectors found that the gas business unit did not conduct regular safety inspections on the user's gas facilities and burning appliances, and reported them or investigated them together; (9) Prohibition of other gas use.
