Measures of Wuxi Municipality on the Administration of Bidding for Construction Projects (20 14)
Chapter I General Provisions Article 1 These Measures are formulated in accordance with the Bidding Law of People's Republic of China (PRC), the Regulations on the Implementation of the Bidding Law of People's Republic of China (PRC), the Regulations on Bidding and Bidding of Jiangsu Province, the Regulations on the Administration of Construction Market of Jiangsu Province and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the bidding activities of construction projects and goods and services related to construction projects within the urban area of this Municipality. Article 3 The term "construction projects" as mentioned in these Measures refers to all kinds of newly built, rebuilt and expanded housing construction and municipal infrastructure projects, including:

(1) Buildings and their ancillary facilities;

(two) the installation, decoration, demolition and maintenance of the lines, pipelines and equipment supporting the building;

(three) urban roads, tunnels, rail transit, urban lighting, water supply, drainage, gas, heat, sewage treatment, sanitation, garbage disposal, underground public facilities and ancillary facilities, civil engineering, pipelines, equipment installation, landscaping and other municipal infrastructure projects.

The goods related to construction projects as mentioned in these Measures refer to the equipment and materials that constitute part of the project and are necessary to realize the basic functions of the project.

The term "construction-related services" as mentioned in these Measures refers to services such as survey, design, supervision, engineering consultation and project management required for the completion of the project. Article 4 Bidding for construction projects shall adhere to the principles of openness, fairness, impartiality, selection of the best and good faith. Article 5 The municipal construction administrative department shall be responsible for the supervision and management of the bidding activities of construction projects within the urban area of this Municipality.

Development and reform, finance, supervision and other departments shall, in accordance with their respective responsibilities, be responsible for doing a good job in the bidding activities of construction projects. Article 6 The municipal construction administrative department shall establish a unified integrity information management system for construction project bidding, and collect, review, record, publish and manage the integrity information of the bidding parties. Seventh municipal construction administrative departments shall establish a collegiate bench system for bidding and tendering, and shall be responsible for giving opinions on matters such as the improvement of qualification level, the merger of different professional qualifications and the handling of complaints in bidding and tendering activities. Chapter II Bidding Article 8 The scope and scale of construction projects that must be subject to bidding according to law shall be implemented in accordance with national and provincial regulations and standards.

No unit or individual may break up a construction project that must be subject to bidding according to law or evade bidding by other means.

Encourage construction projects that must be tendered according to law to contract out through tendering. Ninth construction projects that must be subject to bidding according to law shall be subject to bidding activities in the Municipal Construction Engineering Trading Center (hereinafter referred to as the Trading Center); Encourage construction projects that must be tendered according to law to conduct bidding activities in the trading center.

The trading center shall establish a network security mechanism, emergency plan and system management system, build a platform for information collection, storage and release, provide information release, consultation, electronic bidding and other services for construction project bidding activities, and accept the supervision and management and business guidance of the municipal construction administrative department. Tenth to encourage the parties to tender to use the information network for electronic bidding.

The bidding parties involved in electronic bidding shall enter the unified electronic bidding database of construction projects in the whole city, comprehensively and truly enter relevant information, and shall not resort to deceit.

The information used in electronic bidding activities shall be based on the information in the bidding database. Eleventh construction project bidding shall meet the following conditions:

(a) the tenderer has been established according to law;

(two) in accordance with the provisions of the relevant examination and approval, approval and filing procedures;

(3) Having technical data or design drawings that meet the requirements of the tender;

(four) the required funds or sources of funds within the scope of bidding have been implemented;

(5) Other conditions stipulated by laws and regulations.

If the project agent construction system is implemented, the power of attorney of the tenderer and the agreement signed between the tenderer and the project manager shall also be issued; If it is built by BT or BOT, relevant approval documents or materials shall also be provided.

Bidding for goods and services related to construction projects shall comply with relevant laws and regulations. Twelfth construction projects that must be tendered according to law, the tenderer shall meet the following conditions, and report the relevant materials to the municipal construction administrative department for the record:

(1) Having the qualifications of a legal person or other organization;

(2) Having the technical strength in terms of technology, cost, finance and management that is suitable for the construction project;

(three) there are more than three persons with the ability of bidding business;

(4) Having the ability to prepare bidding documents and organize bid opening, bid evaluation and bid selection;

(5) Other conditions stipulated by laws and regulations. Thirteenth bidders do not meet the requirements of organizing their own bidding, they should entrust a bidding agency with corresponding qualifications to organize bidding, sign an entrustment contract, and report to the municipal construction administrative department for the record.

All or mainly state-owned capital investment projects (hereinafter referred to as state-owned capital investment projects) shall be entrusted to tender, and the tendering agency shall be determined on the basis of open selection. Specific measures shall be formulated by the municipal construction administrative department jointly with relevant departments.
