Ordering to stop production or business is a punishment that restricts and deprives citizens, legal persons or other organizations of their capacity to act. It requires the punished person to stop the ongoing production and operation and various business activities, which is different from property punishment such as fines and confiscation. It restricts and deprives the punished person of his capacity for behavior, which is a kind of behavioral punishment. Ordering to stop production or business is a punishment that requires citizens, legal persons or other organizations to fulfill their obligations of omission. In other words, people who are punished by this kind have the obligation of inaction, that is, they may not continue to engage in production and business activities. Ordering to stop production or business is usually accompanied by a time limit. If the punished person corrects the illegal act within a certain period of time, he can resume production and operation.
Legal basis: Article 134th of People's Republic of China (PRC) Food Safety Law.
If a food producer or business operator violates the provisions of this Law for three times within a year and is ordered to stop production or suspend business or revoke his license, the food safety supervision and administration department shall order him to stop production or suspend business until his license is revoked.
