Chapter six? Legal liability

Article 58? In violation of the provisions of this law, anyone who commits any of the following acts shall be ordered by the competent department of housing and urban and rural construction and the fire rescue agency to stop construction, stop using or stop production and business, and be fined between 30,000 yuan and 300,000 yuan:

(a) the construction project that should be subject to fire protection design review according to law, without examination according to law or unqualified examination, without authorization;

(two) the construction project that should be subject to fire inspection according to law has not been put into use without fire inspection or fire inspection is unqualified;

(3) Other construction projects specified in Article 13 of this Law fail to pass random inspection according to law after acceptance, and do not stop using them;

(four) the public gathering place without fire safety inspection or inspection does not meet the requirements of fire safety, unauthorized use, business.

If the construction unit fails to report to the competent department of housing and urban and rural construction for the record in accordance with the provisions of this law after acceptance, the competent department of housing and urban and rural construction shall order it to make corrections and impose a fine of not more than 5,000 yuan.

Article 59? In violation of the provisions of this law, any of the following acts shall be ordered by the competent department of housing and urban and rural construction to correct or stop the construction, and a fine of not less than 10,000 yuan but not more than 100,000 yuan shall be imposed:

(a) the construction unit requires the architectural design unit or the construction enterprise to lower the technical standards of fire control for design and construction;

(two) the architectural design unit does not carry out fire protection design in accordance with the mandatory requirements of fire protection technical standards;

(three) the construction enterprise does not follow the fire protection design documents and fire protection technical standards, which reduces the quality of fire protection construction;

(four) the project supervision unit colludes with the construction unit or the construction enterprise to resort to deceit and reduce the quality of fire control construction.

Article 60? If a unit violates the provisions of this Law and commits any of the following acts, it shall be ordered to make corrections and be fined between 5,000 yuan and 50,000 yuan:

(a) fire facilities, equipment or fire safety signs configuration, settings do not meet the national standards, industry standards, or not kept in good condition and effective;

(two) damage, misappropriation or unauthorized removal, stop using fire control facilities and equipment;

(3) Occupying, blocking or sealing evacuation passages and exits or other acts that hinder safe evacuation;

(four) burying, occupying, blocking the fire hydrant or occupying the fire prevention space;

(five) occupy, block or close the passage of fire engines, which hinders the passage of fire engines;

(six) in crowded places, set up obstacles on doors and windows that affect escape and fire fighting and rescue;

(seven) after being notified by the fire rescue agency, failing to take timely measures to eliminate fire hazards.

Individuals who commit any of the acts listed in the second, third, fourth and fifth items of the preceding paragraph shall be given a warning or imposed a fine of not more than 500 yuan.

Anyone who commits any of the acts in Item 3, Item 4, Item 5 and Item 6 of the first paragraph of this article and refuses to correct it after being ordered to do so shall be enforced, and the expenses required shall be borne by the violator.

Article 9? The fire protection design and construction of building projects must conform to the national technical standards for fire protection of engineering construction. Construction, design, construction, project supervision and other units shall be responsible for the fire protection design and construction quality of construction projects according to law.

Article 10? In accordance with the national technical standards for fire protection in engineering construction, the fire protection design review and acceptance system for construction projects shall be implemented.

Article 11? For special construction projects stipulated by the competent department of housing and urban-rural construction in the State Council, the construction unit shall submit the fire protection design documents to the competent department of housing and urban-rural construction for review, and the competent department of housing and urban-rural construction shall be responsible for the review results according to law.

For other construction projects other than those specified in the preceding paragraph, the construction unit shall, when applying for a construction permit or approving the commencement report, provide fire protection design drawings and technical data that meet the construction needs.

Article 12? Without the fire design review or review unqualified special construction projects, the construction unit, the construction unit shall not be constructed; For other construction projects, if the construction unit fails to provide fire protection design drawings and technical data that meet the construction needs, the relevant departments shall not issue construction permits or approve the commencement report.

Thirteenth the State Council urban housing and urban-rural construction departments should apply for fire inspection and acceptance. After the completion of the construction project, the construction unit should apply to the housing and urban-rural construction departments for fire inspection and acceptance.

Other construction projects other than those specified in the preceding paragraph shall be reported to the competent department of housing and urban and rural construction for the record after acceptance by the construction unit, and the competent department of housing and urban and rural construction shall conduct spot checks.

Construction projects that should be subject to fire control acceptance according to law are prohibited from being put into use without fire control acceptance or unqualified fire control acceptance; Other construction projects that fail to pass random inspection according to law shall stop construction.

Fourteenth specific measures for fire design review, fire acceptance, filing and spot check of construction projects shall be formulated by the competent department of housing and urban and rural construction in the State Council.

Fifteenth before the public gathering place is put into use or business, the construction unit or the user unit shall apply to the fire department of the local people's government at or above the county level for fire safety inspection.

The fire rescue agency shall, within ten working days from the date of accepting the application, conduct fire safety inspection on the place according to the technical standards and management regulations on fire control. Without fire safety inspection or inspection does not meet the requirements of fire safety, it shall not be put into use or business.
