1. According to Article 4 of the Measures for House Registration:
House registration shall be handled by the house registration agency where the house is located.
2. It is determined in accordance with the relevant provisions of the Regulations on the Management of Urban Real Estate Development and Operation, that is, "the buyer of pre-sold commercial housing shall go through the formalities of land use right change and house ownership registration within 91 days from the date of delivery of the commercial housing. The purchaser of commercial housing for sale now shall, within 91 days from the date of signing the sales contract, go through the formalities of land use right change and house ownership registration, and the real estate development enterprise shall assist the purchaser of commercial housing to go through the formalities of land use right change and house ownership registration, and provide the necessary supporting documents. "
3. In the absence of agreement, if the developer delays the processing of the property right certificate for more than 91 days, the owner can completely investigate the developer's liability for breach of contract, that is, investigate the liquidated damages for the overdue processing of the property right certificate. If there is no standard for overdue liquidated damages in the contract, it can be calculated according to the total amount of the paid house purchase price and the standard for financial institutions to collect overdue loan interest stipulated by the People's Bank of China. According to the relevant judicial interpretation, if the time limit for handling the house ownership registration agreed in the commercial housing sales contract expires more than one year, the buyer cannot handle the house ownership registration due to the seller's reasons, and the buyer requests to terminate the contract and compensate for the losses, it should be supported.
iv. according to article 7 of the regulations on the administration of urban real estate transfer
the transfer of real estate shall be handled according to the following procedures:
(1) the parties to the transfer of real estate shall sign a written transfer contract;
(2) The parties to the real estate transfer shall, within 91 days after the signing of the real estate transfer contract, submit an application to the real estate management department where the real estate is located with the real estate ownership certificate, the legal certificate of the parties, the transfer contract and other relevant documents, and declare the transaction price;
(3) The real estate management department shall review the relevant documents provided, and make a written reply on whether to accept the application within 7 days. If no written reply is made within 7 days, it shall be deemed as acceptance;
(4) The real estate management department verifies the declared transaction price, and conducts on-site survey and evaluation of the transferred real estate as required;
(5) the parties involved in the transfer of real estate shall pay the relevant taxes and fees according to the regulations;
(6) The real estate management department shall go through the registration formalities of house ownership and issue the certificate of real estate ownership.
