2. Does prepackaged foods need a food business license?
Pre-packaging refers to the food that is prepackaged quantitatively or put into (poured into) containers and provided directly to consumers.
Production and sales of prepackaged foods (including frozen food, excluding frozen food) should first obtain legal qualifications such as business license.
In China, according to the provisions of the Food Hygiene Law, food production and marketing enterprises and food vendors must obtain hygiene licenses before they can apply to the administrative department for industry and commerce for registration or change of registration. Measures for the administration of the issuance of health permits shall be formulated by the health administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.
The behaviors to which the hygiene license can be applied include the production (excluding planting and breeding), collection, purchase, processing, storage, transportation, display, supply and sale of all things. The users of hygiene licenses include all units or individuals engaged in food production and operation, including staff canteens and food vendors.
Therefore, it is certain that prepackaged foods needs to apply for a food business license.
